CPS EnergyPole Attachment StandardsI.STATEMENT OF PURPOSEGiven the increasing and varied demands of pole use by a large number of disparatecommunications providers in the San Antonio area, CPS Energy has established these PoleAttachment Standards (Standards) to govern access to and use of CPS Energy Poles.Applicable to all communications providers and Communications Facilities, these Standardsprovide for a non-discriminatory, uniform, consistent, and streamlined approach for the accessand use of CPS Energy Poles in a manner that will facilitate the delivery of the variety ofCommunication Services offered today, as well as to assist with speed-to-market processes forfuture technologies in a manner that is consistent with the safe and reliable operation of CPSEnergy Facilities. These Standards will work to ensure that CPS Energy and all communicationproviders attaching to CPS Energy Poles comply with all applicable laws, standards,regulations, and ordinances.In adopting these Standards, CPS Energy has attempted to incorporate new and evolving bestpractices and recommendations that have been developed and endorsed at the national level,such as the Federal Communications Commission’s (FCC) recommendations in its NationalBroadband Plan1 related to the ability of attaching entities to perform make-ready work byutility-approved and qualified contractors. Consistent with the FCC’s rules, the Standards alsomirror and incorporate national safety standards and federal requirements, such as thosedeveloped by the Occupational Safety and Health Administration (OSHA) that are aimed atensuring the safety or workers and maintaining a safe work environment.2 At the same time, theStandards like the FCC’s pole attachment access rules do not woodenly apply national standardswhen CPS Energy’s unique operational experiences and requirements dictate the application ofpolicies, practices, and standards that are more stringent or different than national standards.As the FCC noted,Despite this specificity, the introduction to the NESC [National Electric SafetyCode] states that the code "is not intended as a design specification or aninstruction manual In addition to operating under federal, state, and localrequirements, a utility normally will have its own operating standards thatdictate conditions of access. CPS EnergyPole Attachment Standardsindustry-wide standards and applicable legal requirements are too general totake into account all of the variables that can arise. A utility's individualstandards cover not simply its policy with respect to attachments, but all aspectsof its business Particular utility work methods and equipment may requirespecific separations between attachments and may restrict the height of the polesthat a utility will use The number of variables makes it impossible to identifyand account for them all for purposes of prescribing uniform standards andrequirements. Universally accepted codes such as the NESC do not attempt toprescribe specific requirements applicable to each attachment request andneither shall we.3From a holistic perspective, the Standards seek to balance the competing needs and interests ofmultiple communications providers to access and utilize CPS Energy Poles, while at the sametime recognizing that the core purpose and function of these Poles is for CPS Energy’s safe andreliable distribution and delivery of electric services to CPS Energy customers. Hence, any useof CPS Energy’s Poles must at all times ensure the continued operational integrity, safety andreliability of CPS Energy’s Facilities, electric services, personnel and the general public.These Standards are organized into six parts:Section I -- this introductory SectionSection II -- sets out general administrative provisionsSection III -- sets out general technical provisionsSection IV -- sets out the specifications applicable to wire AttachmentsSection V -- sets out the specifications applicable to Wireless InstallationsSection VI -- contains the Appendices referenced in these StandardsUpon their effective date, these Pole Attachment Standards shall be enforceable by CPSEnergy at all times upon any entity which attaches its facilities to a CPS Energy-ownedPole regardless of the status of a Pole Attachment Agreement or Application for Permit.CPS Energy reserves the right to amend these Standards at any time and manner in response tomarket conditions and as necessary to comply with changes in applicable engineering and/orsafety standards or changes in local, state or federal law. CPS EnergyPole Attachment StandardsII.GENERAL ADMINISTRATIVE PROVISIONSA. DefinitionsFor the purposes of these Standards, the following terms, phrases, words, and theirderivations, shall have the meaning given herein. When not inconsistent with the context,words used in the present tense include the future tense, words in the plural numberinclude the singular number, and words in the singular number include the plural number.The words “shall” and “will” are mandatory and “may” is permissive. Words not definedshall be given their common and ordinary meaning.1.Affiliate means, when used in relation to an Attaching Entity, another entity thatowns or controls, is owned or controlled by, or is under common ownership orcontrol with the Attaching Entity.2.Applicable Engineering Standards means all applicable engineering and/orsafety standards governing the installation, maintenance and operation of facilitiesand the performance of all work in or around CPS Energy’s Facilities and includesCPS Energy’s clearance standards, the National Electrical Safety Code (NESC),the National Electrical Code (NEC), the Texas Health & Safety Code, Chapter 752(Vernon 1992) and any subsequent amendments which relate to the maintenance ofproper clearances and related safety issues, the regulations of the OccupationalSafety and Health Act (OSHA), applicable regulations of the FederalCommunications Commission (FCC), the Environmental Protection Agency(EPA), lawful requirements of Public Authorities, and/or other requirements ofCPS Energy that are non-discriminatory to Attaching Entity as compared to allOther Attaching Entities.3.Application means a complete Application for a Permit submitted by an AttachingEntity to CPS Energy for the purpose of requesting consent to install a newAttachment or Overlashing onto a CPS Energy Pole. The maximum number ofPoles to be considered on a single Application is one-hundred twenty (120) Poles.4.Application Fee means the non-refundable fee described in Section II.K andAppendix H of these Standards, compensating CPS Energy for the administrativeand other work required to process and review an Application.Revision: 1.0Revision Date: May 1, 2016Effective Date: August 1, 2016Page: 4

CPS EnergyPole Attachment Standards5.Application Form means the form provided in Appendix B which every AttachingEntity is required to submit to CPS Energy, along with all applicable documents,as part of a complete Application in order to request a Permit.6.Attaching Entity means any eligible public or private entity that places anAttachment on a CPS Energy Pole, in accordance with CPS Energy’s applicablerequirements, including a Pole Attachment Agreement and these Standards, toprovide Communications Service.7.Attachment means (a) each aerial cable together with its associated Messengercable, guy wire, anchors, and associated hardware, and each amplifier, repeater,receiver, appliance or other device or piece of equipment, whether comprised ofsteel, aluminum, copper, coaxial, optical fiber, or other media or material utilizedto provide Communications Services; and (b) any hardware or equipment identifiedin Section II.A.15 affixed to a CPS Energy Pole utilizing one foot or less ofCommunication Space. An Attachment occurs whether Attaching Entity’sCommunications Facilities are connected to the Pole itself or are supported by anAttachment Arm, bracket, support stand, or other support devices, providedhowever that Overlashing an existing Permitted Attachment and Service Dropsshall not count as separate Attachments. This definition shall not apply tocommunications wires or facilities installed by CPS Energy for its own internalcommunications requirements or energy Information Services such as automatedmeter reading.8.Attachment Arm means a CPS Energy approved metal or fiberglass bracket usedto support attaching wires away from the face of the Pole in order to meet requiredspecifications and standards.9.Attachment Connection Fee means the annual rental payment assessed by CPSEnergy to each Attaching Entity determined by multiplying the Attachment Rateby the total number of Permitted Attachments for the Attaching Entity.10.Attachment Rate means the annual rate per Pole determined by CPS Energyconsistent with Texas Utilities Code, §54.204(c).11.Cable Services means the provision of one-way transmission to subscribers ofvideo programming, or other programming service, and subscriber interaction, ifany, which is required for the selection or use of such video programming or otherprogramming service by a cable system. CPS EnergyPole Attachment StandardsInformation Services or Video Services, as defined in the Texas Utilities Code §66.002.12.Certificated Provider means a competitive service provider of CommunicationsServices, Cable Services, or Video Services that has received a Certificate ofConvenience and Necessity, Certificate of Operating Authority, Service ProviderCertificate of Operating Authority, or State Issued Certificate of FranchisingAuthority from the Public Utility Commission of Texas.13.City means the City of San Antonio, Texas.14.Capacity means the ability of an existing Pole to accommodate an additionalAttachment or Overlash based on Applicable Engineering Standards, includingspace, design, and loading considerations.15.Collection Notice Letter means a letter of notification produced by the CPSEnergy Claims Department itemizing charges owed to CPS Energy as a result ofdamages to CPS Energy Facilities caused by an Attaching Entity, or its contractors,subcontractors, and agents. This letter constitutes CPS Energy’s tender forrecovery of all costs associated with repairs to the damaged facilities.16.Communications Facility means a wire or cable facilities including, but notlimited to, a fiber optic, copper and/or coaxial cable or wire utilized by an AttachingEntity to provide Communications Services, including any and all associatedequipment. A Communications Facility also includes a Messenger or othermaterial, appurtenance, or apparatus of any sort necessary or desirable for use inthe provision of an Attaching Entity’s Communications Services.ACommunication Facility shall not include an antenna or wireless radio transceiver.17.Communications Services means the provision of service, including but notlimited to Telecommunications Services, Cable Services, Video Services, orInformation Services over wire or cable facilities utilizing Attachments to Poles.This definition excludes Attachments made by private entities and publicorganizations, such as schools, universities, and units of local government, thatoperate private internal networks used for non-commercial communicationspurposes.Revision: 1.0Revision Date: May 1, 2016Effective Date: August 1, 2016Page: 6

CPS EnergyPole Attachment Standards18.Communications Space means the portion of a Pole’s usable space designated forthe installation of Communications Facilities, the top of which is forty (40) inchesbelow CPS Energy’s Neutral or lowest grounded messenger line.19.Competitive Provider – Area Wide Network Deployment Process means theApplication submission and Permit approval process applicable to a CertificatedProvider engaged in a broadband network deployment within the CPS Energyservice area characterized by an Attaching Entity’s submission of Applications toattach or Overlash to Poles that would result in an estimated replacement of eighty(80) or more Poles per month; and the responsibility to prepare Make-ReadyEngineering, manage Make-Ready Electrical Construction and Make-ReadyCommunications Construction, and incur all expenses associated with Make-ReadyWork.20.Competitive Provider – Network Upgrade Process means the Applicationsubmission and Permit approval process applicable to a Certificated Providerengaged in a broadband network deployment within the CPS Energy service area;and the responsibility to prepare Make-Ready Engineering, manage Make-ReadyCommunications Construction, the option to manage Make-Ready ElectricalConstruction, and incur all expenses associate with Make-Ready Work.21.Complex Transfer means the transfer or relocation of a third-party Attachment orOverlash onto a CPS Energy Pole that will require cutting and splicing of aCommunication Facility resulting in a network and/or customer outage affectingthe Attaching Entity that owns the Communication Facility subject to transfer orrelocation, or the transfer or relocation of such an Attached or OverlashCommunication Facility located over and across a state or federal highway.22.CPS Energy Facilities means all personal property and real property owned orcontrolled by CPS Energy, including Poles.23.Critical Communications Facility means a Communications Facility that mustprovide “always on” connectivity for public safety communications or public healthoperations whose failure would pose a potential imminent threat to public health orsafety.24.Deployment Plan means a document prepared by an Attaching Entity that shallinclude: (1) footprint of the network buildout illustrated in a map depicting themunicipal jurisdiction, or parts thereof, within the CPS Energy service areaRevision: 1.0Revision Date: May 1, 2016Effective Date: August 1, 2016Page: 7

CPS EnergyPole Attachment Standardsexpected to be covered by the project; (2) overall network deployment scheduleand phasing; (3) map of backbone fiber rings routes, if any; (4) description ofoverall physical plant architecture and design; (5) description of typical ServiceDrop installations; (6) estimated number of Poles expected to be attached toincluding a reasonable “ramp-up” and “ramp-down” plan; (7) project and corporateorganizational chart for the Attaching Entity; and (8) signature page attesting to theveracity of the Deployment Plan executed by an authorized officer of the AttachingEntity. A Deployment Plan is required under the Competitive Provider – AreaWide Network Deployment Process and the Competitive Provider – NetworkUpgrade Process.25.Electrical Space or Supply Space means the upper portion of a Pole reserved forthe installation of electric distribution facilities to support existing and plannedelectric distribution equipment.26.Emergency means a situation exists which, in the reasonable discretion of CPSEnergy or the Attaching Entity, if not remedied immediately, will result in a threatto public safety, a hazardous condition, damage to property or a service outage.27.Engineer means any licensed professional engineering firm approved by CPSEnergy to complete Engineering work on CPS Energy Facilities.28.Information Services means the offering of a capability for generating, acquiring,storing, transforming, processing, retrieving, utilizing, or making availableinformation via telecommunications, and includes electronic publishing and cablemodem service, but does not include any use of any such capability for themanagement, control, or operation of a telecommunications system or themanagement of a telecommunications service.29.Inventory means a complete count of all Attachments, both authorized andUnauthorized Attachments, on CPS Energy-owned Poles in the CPS Energy serviceterritory.30.Make-Ready Charges means all reasonable administrative, engineering design,construction, inspection, and management charges associated with Make-ReadyWork.31.Make-Ready Communication Construction means that portion of Make-ReadyWork associated with construction work requiring access to CommunicationRevision: 1.0Revision Date: May 1, 2016Effective Date: August 1, 2016Page: 8

CPS EnergyPole Attachment StandardsFacilities within the Communication Space of a Pole, including, but not limited tothe movement, transfer, relocation, or modification of an existing Attachment orOverlash; the replacement of a Pole; and all other construction activities necessaryto accommodate the installation of a new Attachment or Overlash. Make-ReadyCommunications Construction shall include, where applicable, the nexus betweenaerial and underground construction.32.Make-Ready Electrical Construction means that portion of Make-Ready Workassociated with construction work requiring access to CPS Energy Facilities withinthe Electrical Space or Neutral Space of a Pole, which includes, but is not limitedto the movement, transfer, relocation, or modification of CPS Energy electricdistribution facilities; the replacement of a Pole; and all other construction activitiesnecessary to accommodate the installation of a new Attachment or Overlash.Make-Ready Electrical Construction shall include, where applicable, the nexusbetween aerial and underground construction.33.Make Ready Engineering means that portion of Make-Ready Work associatedwith the preparation of engineering design documents including but not limited to,the Pre-Construction Survey; the engineering design for Make-Ready ElectricalConstruction and Make-Ready Communications Construction; and the submissionof such design documents to CPS Energy for review, potential modification, andapproval. Make-Ready Engineering shall include, where appropriate, the approvalof a Professional Engineer, engineering design specifications related to the nexusbetween aerial and underground construction of Communications Facilities as partof Make-Ready Communications Construction and of electrical distributionfacilities as part of Make-Ready Electrical Construction.34.Make-Ready Work means all work which is required to accommodate anAttaching Entity’s Attachment or Overlash onto a Pole in compliance with allApplicable Engineering Standards. Such work includes, but is not limited to,Make-Ready Engineering, Make-Ready Electrical Construction, and Make-ReadyCommunications Construction, along with Application review, engineering designdocuments review, engineering work, construction work, permitting work, treetrimming (other than tree trimming performed for normal maintenance purposes),Pole replacement, and the Post-Construction Survey.35.Messenger means any cable owned by an Attaching Entity extending betweenPoles which is used as support for a Communications Facility.Revision: 1.0Revision Date: May 1, 2016Effective Date: August 1, 2016Page: 9

CPS EnergyPole Attachment Standards36.National Electrical Safety Code (NESC) means the current edition published bythe Institute of Electrical and Electronic Engineers (IEEE) as may be amended orsupplemented from time-to-time.37.Neutral means the conductor used to carry unbalanced current. In single-phasesystems, the conductor used for a return current path.38.Neutral Space means that space on a Pole measured from the location of theNeutral to a location forty (40) inches below the Neutral.39.Notice of Dispute Form means the form that an Attaching Entity must use todispute CPS Energy’s determination of liability associated with a claim fordamages caused to CPS Energy Facilities by the Attaching Entity, or its contractors,subcontractors, and agents.
