THE SCHOOL BOARD OF BROWARD COUNTY, FLORIDAIN A PARTNERSHIP WITH THE BROWARD STATE ATTORNEY’SOFFICE BROWARD TRUANCY INTERVENTION PROGRAM(BTIP)SCHOOL BOARD POLICY(Excerpt from the Code of Student Conduct 20162017)The Broward Truancy Intervention Program (BTIP) is a joint partnershipprogram of the Broward State Attorney’s office and the School Board ofBroward County. The program is designed to prevent excessive absencesthrough parent notification and accountability, school interventions, anddaily monitoring of attendance. Parents are expected to communicate withschool personnel regarding absences. Parents who do not comply arereferred to the State Attorney’s Office for failure to comply with FloridaStatue 1003.27 which provides that a parent commits a misdemeanor of thesecond degree, punishable as provided by law, if the parent refuses or fails tohave a child attend school regularly or refuses to participate in meetingsconcerning the child’s truancy.3

BROWARD TRUANCY INTERVENTION PROGRAM (BTIP)Overview/Best PracticesATTENDANCE MATTERS!BTIP is a partnership between Broward Schools and the Broward State Attorney’sOffice – to address chronic absenteeism in the elementary grades. Students mustattend school and be engaged, in order to achieve academic success. The intentof BTIP is to assist parents in fulfilling their responsibility, to ensure their child’s regularschool attendance.Tier One Strategies to Improve AttendanceAll schools must develop and follow a meaningful attendance plan. Success dependson collaboration, commitment and accountability. Valuable tools and informationcan be found at: www.attendanceworks.org There is a fabulous handout for parents –available in several languages – on that website. That handout can be found in theResources section of this manual.Tier Two Strategies to Improve Attendance5 unexcused absences – a meeting with the parents is scheduled at the school. Aletter is sent to parent by I&T. Meetings are always on Wednesday mornings. Someonefrom the school must be assigned to conduct that meeting. Please include yourschool social worker, if they are at the school on that day. If the social worker is notavailable for the 5-day meeting, have a process in place to refer the case to them forfollow-up - as needed.At the 5-day meeting – attendance laws, policies and procedures should be reviewed withthe parent. Find out the reasons for the absences - and address the concerns. Update thecontact information. Interventions should include (as appropriate):-Attendance Agreement: must be done prior to a 10-day BTIP meeting.-Medical Information/Interventions: Physician’s Verification Form;Hospital/Homebound Packet; medical intervention plan (asthma, diabetes,head lice, etc). Include the school nurse if available and appropriate. Notifythe parent that no future absences will be excused without a doctor’s note.-Social Services: Involve your school social worker for referrals for clothing, food,shelter, financial assistance; referrals for counseling/case management. Enrollthe student in HEART (Homeless Education Program) – if eligible. Providetransportation – if eligible. Refer student to Connect for Success/ReservistsProgram – if that program is available at your school.-Schedule Conferences with Parent and Teachers/Administrator - to discuss anyconcerns.4

Document Interventions and Parent Response. Monitor attendance and continue toprovide interventions as needed. If the parent does not attend the 5-day BTIPmeeting – have a process in place to follow-up with that parent – to assess thesituation and provide interventions as outlined above.Tier Three Strategies to Improve Attendance10 unexcused absences in a 90-day calendar period – BTIP 10-day meeting isscheduled by I&T - with representatives from the district, SAO, school personnel andparents. Parents (via certified letter/return receipt) and school personnel (includingschool social worker) – receive notice of the meeting approximately 3 weeks prior tothe meeting. Interventions should have been ongoing since 5-day BTIP meeting.-When you receive notice of the 10-day meeting, you must discuss the case withyour school social worker, and review all interventions/parent’s response.-Contact the parent ASAP – to find out the reasons for on-going absences, andput additional interventions in place. Document the interventions andresponse.-Determine – along with the school social worker – if the 10-day meeting shouldgo forward – or if there is a legitimate reason to cancel or re-schedule themeeting. Be sure to review the BTIP history (L27) when making that decision.-Notify the parent, and the Student Services Office - of your decision. Ifcancelling, or re-scheduling (only under extenuating circumstances) – be surethat interventions are in place, and there is a system to monitor theattendance. If interventions are not successful after a reasonable monitoringperiod – you must notify the Student Services Office – to reschedule the 10-daymeeting.-If the meeting is going forward – Be sure that the Student Services Office isnotified of the status of the meeting – at least one week prior to the meetingdate. Remind the parent of the date, time, and location – and advise them tobring any documentation to explain the absences. At the meeting – we willreview the current attendance and the attendance history. We will hear thereasons for the absences, and review interventions and parent’s response. Wewill provide recommendations to the parent and school personnel – to addressany concerns. We will determine whether to file the case with the SAO – or tomonitor.-At the 10-day meeting, school personnel and the school social worker shouldbe prepared to give an overview of the family circumstances. They should alsoprovide a summary of interventions that have been provided, and the parent’sresponse. Of course – many parents are not cooperative in these situations,but you MUST document your attempts to work with the family (includingdates). Home visits by the school social worker are mandatory – if the familycannot be reached by phone. Home visits are very useful for assessment datarelated to attendance issues. Develop a way to share information andresources with families who are unresponsive.5

Follow up after 10-day meeting-If the decision is to Monitor – Develop a process at your school, tomonitor the attendance. Someone must be responsible for notifying theStudent Services office – if the attendance does not improve and weneed to file the case with the SAO. The intervention will not be effective –if we are not monitoring progress and response. Monitoring isrecommended when there is no history of attendance concerns, thefamily has encountered temporary circumstances effecting attendance– which are expected to resolve with interventions, and the parent isresponding to interventions.-File – We refer cases to the SAO for further intervention – when theparent is unresponsive to interventions; the student and/or siblings havea history of chronic absenteeism; there is no legitimateevidence/documentation to explain the absences.If we decide to refer the case to the SAO, affidavits are sent to the school(teacher, attendance manager, and administrator). The BTIP Assessment is theaffidavit for the school social worker. Please be sure that you include all ofyour interventions – with dates – in your affidavits/assessment. The judgedepends on good information, for an overview of the family functioning andchallenges they may be facing. We MUST include meaningful interventions thataddress reported reasons for chronic absences. Interventions must becomprehensive and targeted, and the response must be documented – inorder for the judge to make an appropriate decision. If a parent is notcooperative – you must document all attempts to engage the parent, and theirresponse.The complete truancy packet must be picked up by your SRO or local policedepartment – within 2 weeks of the decision to file the case. We want toresolve the case ASAP. The school social worker can provide support andassistance to the school - with completing the truancy packet. A completetruancy packet will include:-3 (or more – if there are multiple children in the family who qualify forBTIP) signed and notarized affidavits from the school – Teacher (for eachchild in family – that we are filing on), Administrator (one for the family),and Attendance Manager (one for the family).-Copy of the Birth Certificate and Registration – for each child in the family- who we are filing on.-Copies of all notes from parents – including doctor’s notes – related toattendance.6

-School Social Worker - BTIP Assessment – reviewed by the StudentServices office – signed and notarized.-Copy of the Conference Form – from the 10-day BTIP meeting (copyprovided to the school – following that meeting).-Copy of the signed Attendance Agreement - and the signed Code ofConduct-All TERMS panels – listed in the affidavits – A03; A05; A06; A07; A15; A17;A21; A23; L27Once all documentation has been gathered, the school must notify the SRO orlocal police department (within 2 weeks following the 10-day meeting). Anofficer will pick up the documents and prepare a Probable Cause Statement(samples available from the SAO or Student Services Office). They will assign acase # and leave that – along with their name and contact information - withthe school. That information should be sent to the Student Services Office fortracking purposes. The case will be reviewed by the State Attorney’s Office,and a hearing will be scheduled. Continue to provide interventions andmonitor the attendance.7

The BTIP process is supported by I&T – with automatic codes entered on TERMS. TERMS codes are alsoentered by school and district personnel - to document interventions. The following flow chart - outlinesthe process for TERMS entries for BTIP cases.Broward Truancy Intervention Procedures/TERMS Codes2016/17All schools must develop an Attendance Plan, and follow it – using appropriateinterventions and documentationCode 045 – Automatic BTIP Enrollment by I&TStudents with 5 or more absences will have their FSI released to the SAO. They willsubpoena the records.Code 042 – Automatic mailing of BTIP 5 day letterI&T will mail the letter – to the parent. The letter will be signed, using the Principal’selectronic signature. The letter will specify a date and time for parent to come to theschool to discuss the attendance concerns. All meetings are held on Wednesdaymornings. School personnel can access the list of parents with 5-day meetings – fromOptispool – on Monday mornings. Letters will have the school address, as the returnaddress. Letters returned to the school indicate a need for immediate addressverification by school personnel.Code 076 – BTIP Parent Contact – Absences ExcusedSchool enters this code – following parent contact that results in absences beingexcused. This stops the BTIP process. The student will be automatically re-enrolled in BTIP– by I&T – if they accrue 5 additional unexcused absences – using Code 045. Do notuse 076 Code – if absences are NOT excused. Use parent conference code instead.Code 079 – Automatic Mailing of 10-Day BTIP LetterI&T will mail a Certified, Return Receipt Requested, letter to the parent of a student whohas accrued 10 unexcused absences. The parent will be required to attend a meetingwith school and district personnel, and a representative from the State Attorney’s Office– to develop a plan for the parent to comply with the State of Florida – CompulsoryAttendance Laws. The letter will specify the date, time and location for that meeting.School personnel are responsible for reminding the parent of that meeting.Code 080 BTIP 10-Day Meeting HeldBTIP manager will enter this code on the TERMS L-panel – when the 10-day meeting hasbeen held. A note will be entered with the outcome of that meeting. Code 081 will beentered if the meeting is canceled.8

RESOURCES-Copies of Parent Letters from Attendance Works (attendanceworks.org) – in all majorlanguages-Beginning of the School Year – BTIP letter to parents (suggested) – in all major languages-Copy of 5-day BTIP letter - sent by I&T – in all major languages-Attendance Agreements – in all major languages (to be used by school personnel –PRIOR to the BTIP 10-day meeting)-BTIP Excessive Absences Letter – in all major languages. You may use this letter when astudent has excessive absences and you are requiring documentation such as adoctor’s note – to excuse future absences.-Copy of 10-day BTIP letters – sent by I&T -in all major languages (sent to the parent –certified/return receipt)-BTIP Codes – list of all codes used by I&T, school personnel and district personnel – forBTIP cases-BTIP Log - for your internal use-School Social Worker Assessment/Affidavit – to be completed and submitted to school– when the case is being referred for court intervention. Must be reviewed andapproved by the Student Services office, signed and notorized.-Affidavits for School Personnel – Administrator (1 for family), Teacher (of each childincluded in the packet), and Attendance Manager (1 for family)-BTIP Checklist – MUST be reviewed and signed by administrator/designee – when filing acase with the State Attorney’s Office. All items on the list – must be gathered together– prior to notifying the local police department to pick up the packet for processing.-State Attorney’s Office Contact Information – list with phone numbers, mailing addressand email addresses for the staff of the Truancy Division-Student Services Office Contact Information – list with phone numbers, mailing addressand email addresses for the School Board BTIP staff-Location List for BTIP 10-Day Meetings – addresses for the meeting locations in the North,Central and South areas-Note for Police Officer - who picks up the truancy packet – advising them of thelocation for delivery and contents of the packet9

In that meeting – review attendance policiesand procedures; have parent sign an AttendanceAgreement; update contact info for parent; refer to theschool social worker – if parent expresses any need forassistance; address any parent concerns; refer to RTIteam or Attendance Intervention team for anyadditional interventions; advise parent that theattendance will be monitored and doctor’s notes arerequired to excuse further absences; advise parent that ongoing unexcused absences may result in a referral to theState Attorney’s Office – for further intervention. Ifparent fails to show for the 5-day meeting, have aprocess ina process in place – to follow up with the parent. Besuretoaddressallofthe10

interventionslistedabove,andrefer to yourschool social worker – if the parent is requestingassistance or identifying needs that are interfering withtheir child’s attendance.DateDocument interventions on the L-Panel in TERMS.Enter 076 if the absences are excused - and the parenthas provided adequate documentation to explain theabsences. This will stop the BTIP process. Theprocess will start again, if the student accumulates 5additionalunexcusedabsences.DateI&T automatically enters Code 074 on the L-panel ofTERMS – when student has 5 unexcused absences.This allows the School Board to release records to theState Attorney’s Office.DateI&T automatically enters Code 079 on the L-panelof TERMS – when a student has 10 unexcusedabsences in a 90 calendar day period. This coderesults in the electronic mailing of a 10-day BTIPletter to the parent/guardian – with a meetingdate/time/place with school and district personneland a representative from the State Attorney’s Office.School personnel will receive notice of that meetingby the Student Services Office. You must respond tothat notice within a week of the meeting – indicatingif you will proceed with the meeting or cancel becausethe parent is responding to interventions, or the schoolhas received sufficient documentations to justify theabsences.DateDiscuss the case with your school social worker.Review the interventions and determine if the parentneeds additional services. Decide if you will keep the10-day meeting as scheduled, or postpone foradditional interventions and monitoring. Inform theparent of the decision.
