Collective Agreement between the City of Surrey and CUPE, Local 402COLLECTIVE AGREEMENT2016-2020THIS AGREEMENT entered this 21st day of November 2016BETWEEN:CITY OF SURREY(Hereinafter called the "City")PARTY OF THE FIRST PART;AND:CANADIAN UNION OF PUBLIC EMPLOYEES, SURREY(CITY) B.C., LOCAL NO. 402Chartered by the Canadian Union of Public Employeesand affiliated with the Canadian Labour Congress.(Hereinafter called the "Union")PARTY OF THE SECOND PART;PREAMBLEThe purpose of this Agreement is to secure for the City, the Unionand the employees of the City the full benefit of orderly and legalcollective bargaining, and to ensure to the utmost extent possiblethe safety and physical welfare of the Employees, economy ofoperation, quality and quantity of output, and protection of property.It is recognized by the Agreement to be the duty of the City and theUnion and the Employees to cooperate fully, individually andcollectively, for the advancement of said conditions.The City and the Union agree to abide by the terms set out in thisAgreement. The Union further agrees that it will at all times instructits members to act in accordance with the terms contained in thisAgreement. Collective Agreement between the City of Surrey and CUPE, Local 402Any employees who are not employed within the meaning of the “Labour RelationsCode of B.C."1.2The Union agrees that there shall be no soliciting by any of itsindividual members of the City Council or individual members ofCouncil with respect to rates of pay, working conditions or any othermatter covered by this Agreement during the term of saidAgreement.1.3The City agrees that the bargaining authority of the Union shall notbe impaired during the term of this Collective Agreement. The Cityagrees that the only certification that it will recognize during theterm of this Agreement is that of the Union unless ordered by dueprocess of law to recognize some other bargaining authority.ARTICLE 2EMPLOYER'S RIGHTS2.1The management and the operation of, and the direction of theworking force is vested exclusively in the City, provided, however,that this will not be used for the purpose of discrimination againstEmployees, and provided that it is not against or contrary to thearticles of this Agreement.2.2The City shall have the right to select and promote its Employeesand to discipline or discharge them for proper cause, provided theEmployees shall retain the right of appeal under the GrievanceProcedure contained in this Agreement.2.3For the satisfactory and efficient operation of the City's business,the parties to this Agreement recognize the following Departments:Inside Division:Office of the MayorCity Manager’s OfficeEngineering DepartmentFinance & Technology DepartmentHuman Resources DepartmentPlanning & Development DepartmentRCMP Support Services (Civilian)Parks, Recreation and Culture Division:Parks DepartmentRecreation DepartmentCulture Department5January 1, 2016 – December 31, 2020

Collective Agreement between the City of Surrey and CUPE, Local 402Outside Division:Engineering Department – Operations Branch Roads & Drainage Section Sanitary Sewer/Construction Section Pumps & Controls Section Solid Waste Section Fleet Section Water Section Garage SectionCorporate Facilities DepartmentARTICLE 33.13.2UNION SECURITY(a)The City agrees that all present employees covered by thisAgreement shall remain members of the Union as a condition ofemployment and all future employees of the City, except thosecovered by the classifications set out in Article 1.1, of thisAgreement, shall immediately upon employment become andremain members of the Union as a condition of employment.(b)The City agrees to notify the Union, in writing, when an employee,covered by this Agreement, is hired, promoted, demoted,transferred, laid off, recalled, resigns, is suspended or isterminated.(c)In the event of the Union intending to suspend a member for nonmaintenance of membership, or for any other reasons, the Cityshall be notified by the Union in writing at least seven (7) daysbefore such suspension.The City agrees to check-off all Union Dues and assessmentslevied in accordance with the Constitution and/or Bylaws of theUnion. The Union agrees to advise the City of the amounts of suchUnion Dues, fees and/or assessments as may be determined fromtime to time by the said Union. The City, upon receipt of suchevidence from the Union, shall thereupon deduct from the earningsof the employees such dues, fees and assessments and shallforward to the Union the total of such amounts deducted togetherwith a list of those employees from whom such deductions weremade.6January 1, 2016 – December 31, 2020

Collective Agreement between the City of Surrey and CUPE, Local 402ARTICLE 4ADJUSTMENT OF GRIEVANCES4.1In the event that any difference arises out of the interpretation,application, operation or any alleged violation of this Agreement,including any question or difference arising from the suspension ordismissal of any employee, and including any question or differenceas to whether the matter is arbitrable, such question or differenceshall be finally and conclusively settled without stoppage of work inthe manner specified in Article 4.4.2Time LimitsThe time limits specified in this grievance procedure shall beconsidered binding upon both the Union and the City.The time limits to initiate a grievance, convene a grievance hearing,reply to a grievance, or refer it to the succeeding step can beextended only by explicit written agreement by the parties. For thepurposes of managing the grievance procedure, extensions soughtby the City or the Union shall be dealt with between a designatedmember of the Union, and a designated member of the HumanResources Department.4.3Designated Managers May ReplyTo expedite the investigation, hearing and reply to any grievance, aGeneral Manager may designate a Division Manager within the sameDepartment, to hear and reply
