ASPE NEWS Page 4LEGISLATIVE REPORTThura Zin CPD, GPDV.P. LegislativeFrom the 2018 UPC Guide to Important Code ChangesWhat Changed309.4 Installation Practices. Plumbing systems shallbe installed in a workmanlike manner that which is inaccordance with this code, applicable standards, and themanufacturer's installation instructions. All materialsshall be installed so as not to adversely affect thesystems and equipment or the structure of the building, and in compliance with all laws and other provisions ofthis code. All plumbing systems shall be in accordancewith construction documents approved by the AuthorityHaving Jurisdiction.code requires a minimum of 18 inches from the waterheater for installation of this piping but the standarddoes not. One must use the more stringent provision. Inthis case, the more stringent provision is contained inthe code, which supersedes the standard. This sectionalso ensures that all work installed shall not adverselyaffect the existing building system or structure even if itwas installed to the code, standard, and manufacturer'sinstruction. All changes to plans and specificationsmust be submitted to the Authority Having Jurisdiction. In addition, the term "workmanlike manner" is used todescribe the quality of work that would be performed bya worker of average skill and ability or in a manner thatis in line with other contractors in the same community. Why It ChangedThis modified language provides additional languageto clarify the intent of installation practices, direct theuser to all applicable codes and standards and affirm asplans and specifications change they must be submittedto the AHJ. Additionally, there have been many disputesconcerning construction installation practices. As aresult, "workmanlike manner" has been defined in caselaw as "the quality of work that would be done by aworker of average skill and intelligence."What It Means to MeIn this section, there are three guidelines to use forproper installation of the plumbing system. If a conflictoccurs between the standards, instructions, or code themost stringent of the three provisions must be used. Theexample used in the commentary for Section 301.2.2concerning PEX-AL PEX pipe is a perfect one. TheJeff JimenezAtlasAlex5375 E.
