PG&E filed theAgreement on behalf of both BART and PG&E, and the California Public UtilitiesCommission (“CPUC” or “Commission”) approved the Agreement in Decision (“D.”)00-10-015 dated October 5, 2000.On February 7, 2013, PG&E filed at FERC revisions to the NITS under PG&E’s OATtariff to reflect BART’s new Richmond Parking Garage (Docket No. ER13-898).2PG&E requested that the modification have an effective date of April 9, 2013.Exhibit “C” of the Agreement corresponds with Appendix B, Table B-3 of the FERC NITS.Under the OAT tariff, Section 29.2 explains how BART is to make application for new servicepoints to change Appendix B of NITS.12

The NITS Agreement provides for network transmission service fordelivery of up to 84 MW of power delivered to BART at the Points of Delivery identified inAppendix B of the NITS Agreement. BART purchases up to 14 MW from the Western AreaPower Administration (“Western”) and up to 100 MW from the Northern California PowerAgency (“NCPA”).On January 29, 2013, BART submitted a written request, pursuant to Part III Section 29.2 of theOAT Tariff, to add the Richmond Parking Garage as a new load.
