Law 6-216; D.C. Official Code § 6-1409 (2012Repl.)) and Mayor’s Order 2009-22, dated February 25, 2009, as amended, hereby gives noticeof the adoption of the following amendments to Title 12 (D.C. Construction Codes Supplementof 2008) of the District of Columbia Municipal Regulations (DCMR), as well as the renaming ofTitle 12.This rulemaking adopts and amends the following codes published by the International CodeCouncil (ICC), as amended by this rulemaking in a new District of Columbia ConstructionCodes Supplement of 2013, as the District of Columbia Construction Codes: the 2012 edition ofthe International Building Code; the 2012 edition of the International Residential Code; the 2012edition of the International Fuel Gas Code; the 2012 edition of the International MechanicalCode; the 2012 edition of the International Plumbing Code; the 2012 edition of the InternationalProperty Maintenance Code; the 2012 edition of the International Fire Code; the 2012 edition ofthe International Energy Conservation Code; the 2012 edition of the International ExistingBuilding Code; the 2012 edition of the International Green Construction Code; the 2012 editionof the International Swimming Pool and Spa Code; and the 2011 edition of the NationalElectrical Code (NFPA 70), published by the National Fire Protection Association.With the exception of projects grandfathered pursuant to Section 123 of the District of ColumbiaBuilding Code Supplement, 12 DCMR A, this rulemaking repeals the D.C. Construction CodesSupplement of 2008, effective December 26, 2008 (published at 55 DCR 13094), which adoptedand amended the following codes published by the ICC: the 2006 edition of the ICCInternational Building Code; the 2006 edition of the ICC International Residential Code; the2006 edition of the ICC International Fuel Gas Code; the 2006 edition of the ICC InternationalMechanical Code; the 2006 edition of the ICC International Plumbing Code; the 2006 edition ofthe ICC International Property Maintenance Code; the 2006 edition of the ICC International FireCode; the 2006 edition of the ICC International Energy Conservation Code; the 2006 edition ofthe ICC International Existing Building Code; and the 2005 edition of the National ElectricalCode (NFPA 70) published by the National Fire Protection Association.A Notice of Third Proposed Rulemaking was published on October 4, 2013 at 60 DCR 13763and reflected changes made in response to comments submitted by the public. The Third Noticesuperseded a Notice of Proposed Rulemaking published on December 7, 2012 at 59 DCR 14179and a Notice of Second Proposed Rulemaking published on May 31, 2013 at 60 DCR 7728.The District of Columbia Building Code (2013), referred to as the ―Building Code,‖ consists of the 2012 edition of the International BuildingCode as amended by the District of Columbia Building Code Supplement (2013)(12 DCMR A). Pursuant to Section 10(a) of the Act, a proposed resolution approving the third proposedamendments was submitted to the Council of the District of Columbia, on December 9, 2013 fora forty-five (45) day period of review. The 45-day period of review having expired on March 5,2014 with no Council action to approve or disapprove the proposed resolution, the proposedamendments are deemed approved.No substantive changes were made to the final rulemaking. These rules were adopted as final bythe Chairperson on March 20, 2014 and will become effective upon publication in the D.C.Register.Title 12 (D.C. Construction Codes Supplement of 2008) of the District of ColumbiaMunicipal Regulations is amended as follows:The title of Title 12 is renamed as the District of Columbia Construction Codes Supplementof 2013.Subtitle 12-A (Building Code Supplement of 2008) is repealed in its entirety and replacedwith a new Building Code Supplement of 2013.Subtitle 12-B (Residential Code Supplement of 2008) is repealed in its entirety and replacedwith a new Residential Code Supplement of 2013.Subtitle 12-C (Electrical Code Supplement of 2008) is repealed in its entirety and replacedwith a new Electrical Code Supplement of 2013.Subtitle 12 D (Fuel Gas Code Supplement of 2008) is repealed in its entirety and replacedwith a new Fuel Gas Code Supplement of 2013.Subtitle 12-E (Mechanical Code Supplement of 2008) is repealed in its entirety andreplaced with a new Mechanical Code Supplement of 2013.Subtitle 12-F (Plumbing Code Supplement of 2008) is repealed in its entirety and replacedwith a new Plumbing Code Supplement of 2013.Subtitle 12-G (Property Maintenance Code Supplement of 2008) is repealed in its entiretyand replaced with a new Property Maintenance Code Supplement of 2013.Subtitle 12-H (Fire Code Supplement of 2008) is repealed in its entirety and replaced with anew Fire Code Supplement of 2013.Subtitle 12-I (Energy Conservation Code Supplement of 2008) is repealed in its entiretyand replaced with a new Energy Conservation Code Supplement of 2013.The District of Columbia Building Code (2013), referred to as the ―Building Code,‖ consists of the 2012 edition of the International BuildingCode as amended by the District of Columbia Building Code Supplement (2013)(12 DCMR A). The District of Columbia Construction Codes Supplement of 2013 (the―Construction Codes Supplement‖) shall consist of the additions, insertions, deletions andchanges to the 2012 editions of the International Codes published by the International CodeCouncil (―ICC‖) identified in Sections 101.2, 101.3 and 101.4, and the National Electrical CodeThe District of Columbia Building Code (2013), referred to as the ―Building Code,‖ consists of the 2012 edition of the International BuildingCode as amended by the District of Columbia Building Code Supplement (2013)(12 DCMR A). (2011) published by the National Fire Protection Association (―NFPA‖) (collectively, the―International Codes‖). The International Codes are adopted pursuant to the provisions of theConstruction Codes Approval and Amendments Act of 1986, effective March 21, 1987 (D.C.Law 6-216; D.C. Official Code § 6-1401 et seq. (2012 Repl.)) (the ―Construction Codes Act‖).101.1.1 The Construction Codes Scope and Intent. 12 DCMR A, Chapter 1 shall serveas the administrative and enforcement provisions for the Building Code, ResidentialCode, Electrical Code, Fuel Gas Code, Mechanical Code, Plumbing Code, EnergyConservation Code, Existing Building Code, Green Construction Code and SwimmingPool and Spa Code, except as otherwise provided herein. Administrative andenforcement provisions for the Property Maintenance Code and the Fire Code are setforth in 12 DCMR G, Chapter 1, and 12 DCMR H, Chapter 1, respectively.101.1.2 Definitions. Italicized words and terms shall have the meanings set forth in theInternational Codes or the Construction Codes Supplement.101.2 D.C. Building Code. The D.C. Building Code (2013), hereinafter referred to as the―Building Code‖, shall consist of the 2012 edition of the International Building Code(―International Building Code”), as amended by the Construction Codes Supplement (12-ADCMR, Building Code Supplement).101.2.1 Appendices. Provisions in the appendices of the International Building Codeshall not apply unless specifically adopted in the Construction Codes Supplement.101.2.2 Administration and Enforcement. Chapter 1 of the International BuildingCode is deleted in its entirety. In its place, the provisions of 12 DCMR A, Chapter 1,shall apply to the Building Code and are incorporated by this reference.101.2.3 Scope. The provisions of the Building Code shall apply to the construction,alteration, addition, repair, removal, demolition, use, location, movement, enlargement,occupancy and maintenance of all premises, including any buildings or other structures,and appurtenances attached to buildings or other structures in the District of Columbia,and shall apply to existing or proposed buildings and other structures, except as suchmatters are otherwise provided for in other ordinances or statutes or in the rules andregulations authorized for promulgation under the provisions of the Building Code.These regulations establish minimum standards: for maintenance of all structures; forbasic equipment and facilities for light, ventilation, space heating and sanitation; forsafety from fire; for space and location; for safe and sanitary maintenance of allstructures now in existence; for minimum requirements for all existing buildings andother structures for means of egress, fire protection systems and other equipment anddevices necessary for life safety from fire; for rehabilitation and reuse of existingstructures; and for construction, alterations and repairs.The District of Columbia Building Code (2013), referred to as the ―Building Code,‖ consists of the 2012 edition of the International BuildingCode as amended by the District of Columbia Building Code Supplement (2013)(12 DCMR A). Exceptions:1.Detached one- and two-family dwellings and townhouses not more thanthree stories above grade plane in height with a separate means of egressand their accessory structures shall be permitted to comply with theResidential Code defined in Section 101.3.2.Existing buildings undergoing repair, alteration, additions or change ofoccupancy shall comply with the Existing Building Code defined inSection 101.4.8 or the current Construction Codes.101.2.4 Intent. The purpose of the Building Code is to establish minimum requirementsto safeguard the public health, safety, and general welfare through structural strength,means of egress facilities, stability, sanitation, adequate light and ventilation, energyconservation, accessibility, sustainability, and safety to life and property from fire andother hazards attributed to the built environment, and to provide safety to fire fighters andemergency responders during emergency operations.101.3 D.C. Residential Code. The D.C. Residential Code (2013), hereinafter referred to as the―Residential Code,‖ shall consist of the 2012 edition of the International Residential Code(―International Residential Code”), as amended by the Construction Codes Supplement (12DCMR B, Residential Code Supplement).101.3.1 Appendices. Provisions in the appendices of the International Residential Codeshall not apply unless specifically adopted in the Construction Codes Supplement.101.3.2 Administration and Enforcement. Chapter 1 of the International ResidentialCode is deleted in its entirety. In its place, the provisions of 12 DCMR A, Chapter 1,shall apply to the Residential Code and are incorporated by this reference.101.3.3 Scope. The provisions of the Residential Code shall apply to the construction,alteration, movement, enlargement, replacement, repair, equipment, use and occupancy,location, removal and demolition of detached one- and two-family dwellings andtownhouses not more than three stories above grade plane in height with a separatemeans of egress and their accessory structures.Exceptions:1.Live/work units complying with the requirements of Section 419 of theBuilding Code shall be permitted to be built as one- and two-familydwellings or townhouses. Fire suppression required by Section 419.5 ofthe Building Code when constructed under the Residential Code shallconform to Section 2904 of the Residential Code.The District of Columbia Building Code (2013), referred to as the ―Building Code,‖ consists of the 2012 edition of the International BuildingCode as amended by the District of Columbia Building Code Supplement (2013)(12 DCMR A). 2.Owner-occupied lodging houses with five or fewer guestrooms shall bepermitted to be constructed in accordance with the Residential Code whenequipped with a fire sprinkler system in accordance with Section 2904 ofthe Residential Code.101.3.4 Intent. The purpose of the Residential Code is to establish minimumrequirements to safeguard the public health, safety, and general welfare throughaffordability, structural strength, means of egress facilities, stability, sanitation, adequatelight and ventilation, energy conservation, and safety to life and property from fire andother hazards attributed to the built environment, and to provide safety to fire fighters andemergency responders during emergency operations.101.4 Referenced Codes. The codes defined in Sections 101.4.1 through 101.4.10 andreferenced elsewhere in the Building Code shall be considered part of the requirements of theConstruction Codes to the prescribed extent of each such reference.101.4.1 D.C. Electrical Code. The D.C. Electrical Code (2013), hereinafter referred toas the ―Electrical Code,‖ shall consist of the 2011 edition of the National Electrical Code(“National Electrical Code”) published by the National Fire Protection Association(―NFPA‖) as amended by the Construction Codes Supplement (12 DCMR C, ElectricalCode Supplement).101.4.1.1 Annexes. Provisions in the annexes to the National Electrical Code areprovided for informational purposes only, in accordance with Article 90, Section90.5 of the National Electrical Code, unless otherwise specified in theConstruction Codes Supplement.101.4.1.2 Administration and Enforcement. The provisions of 12 DCMR A,Chapter 1, shall apply to the Electrical Code and are incorporated by thisreference.101.4.1.2.1 Deletions. 5.46.Are located by other written agreements either designatedby or recognized by public service commissions, utilitycommissions, or other regulatory agencies havingjurisdiction for such installations.These writtenagreements shall be limited to installations for the purposeof communications, metering, generation, control,transformation, transmission, or distribution of electricalenergy where legally established easements or rights-ofway cannot be obtained.
