HIPAA Opt-Out Elections for Self-Funded Non-Federal Governmental PlansThis table, which will be updated peridiocally, reflects active HIPPAA exemption elections, as authorized by section 2722(a)(2) of the Public Health Act (42 USC § 300gg-21(a)(2)), as amended,and implementing federal regulations at 45 CFR § 146.180.For plans beginning before September 23, 2010, the seven requirment categories from which sponsors of self-funded non-federal governmental plans may elect to exempt those plans were:1. Limitations on preexisting condition exclusion periods.2. Special enrollment periods.3. Prohibitions against discriminating against individual participants and beneficiaries based on health4. Standards relating to benefits for mothers and newborns.5. Parity in the application of certain limits to mental health benefits.6. Required coverage for reconstructive surgery following mastectomies.7. Coverage of dependent students on medically necessary leave of absence.Plans with plan years beginning on or after September 23, 2010 are not able to opt out of provisions #1-3 above.
