HILLSBOROUGH CLASSROOM TEACHERS ASSOCIATIONandSCHOOL BOARD OF HILLSBOROUGH COUNTY CONTRACT2016-2018 2019-2022WHEREAS, both of the parties to this Agreement are desirous of reaching anamicable understanding with respect to the employer- employee relationshipwhich exists between them and to enter into an agreement covering wages,hours, and terms and conditions of employment; andWHEREAS, it is intended that the following Agreement shall be animplementation of the provisions of FS 447.100, consistent with theconstitutional authority and responsibility of the School Board of HillsboroughCounty and the statutes of the State of Florida and the amendments theretoand insofar as applicable, the Administrative rules of the Department ofEducation 6A and amendments thereof,NOW THEREFORE, it is mutually agreed as follows:1NEGOTIATIONS PROCEDURE1.1Parties To The Agreement1.1.1This agreement is made and entered into pursuant to the provisions ofnegotiation statutes governing public school teachers, FS 447.100, by andbetween the School Board of Hillsborough County herein referred to as theBoard, and the Hillsborough Classroom Teachers Association, herein referredto as the Association.1.1.2The School Board/Association contract shall be the document, which governswages and hours, terms and conditions of employment for employees in theunit. Any policy, procedure, guideline or administrative directive in conflictwith said contract shall be considered null and void. Faculty handbooks,county-wide publications and other guides shall conform to the provisions ofthe contract.1.2Responsibilities Of The Parties1.2.1Upon conclusion of negotiations, the respective parties shall implement theratification process as outlined under the applicable provisions of PERC RuleChapter 38D-20.1.2.2In the event of a declaration of impasse, all applicable provisions of FS 447and PERC Rule Chapter 38D-19 shall be implemented.1.3Recognition1.3.1The School Board of Hillsborough County (hereinafter referred to as theBoard) hereby recognizes the Hillsborough Classroom Teachers Association1

(hereinafter referred to as the Association) and agrees that the Associationshall be the exclusive bargaining agent for classroom teachers, guidancecounselors, Head Start teachers, Speech Language Pathologists, AdultEducation teachers, Pre-K teachers, District Resource teachers, pupilpersonnel (exceptional child, social workers), curriculum coordinators, teamleaders, department heads, vocational teachers, media specialists, teachersof the hospital/homebound teachers, teachers of the migrants students, caseworkers, diagnosticians, psychologists, ROTC instructors, hereafter referredto as “teachers” or “instructional personnel,” and any other position identifiedon the district salary schedule under “Instructional Represented Positions.”1.3.2The appropriateness of any new class or division of employees belonging tothe bargaining unit shall be determined jointly by the Board and theAssociation. If agreement is not possible, the matter shall be referred to thePublic Employees Relations Commission.1.4Exclusivity1.4.1Organization rights pursuant to the provisions of Chapter 447.09 are granted to thecertified exclusive bargaining agent, the Hillsborough Classroom Teachers Association,and such rights shall not be granted to any other association, union or employeeorganization.2WORK YEAR AND HOURS2.1Work Year2.1.1The work year shall be 198 days for ten monthten-month teachers, 203 days forten and one-half month teachers, 205 or 213 days for employees on theHealthPro schedule, 213 days for eleven month teachers, and 253 days fortwelve month teachers as determined by consistent with the School BoardCalendar. Individual job classifications and the accompanying work scheduleand relevant scale are listed in the District Salary Schedule document workcalendars, which are incorporated by reference,2.1.2Teachers assigned to new positions during the regular school year may berequired to attend additional inservicein-service orientation sessions. Sessionsshall be conducted within the regular workday.2.1.3Teachers shall not be required to attend any meetings away from the schoolcenter on the Teacher Workday as designated by the official school calendar.This day is specifically set aside to enable teachers to work on classroomduties.2.1.4New or vacant positions contracted for eleven or twelve months shall beadvertised on the district’s web site.2.1.5Teachers shall be afforded professional discretion regarding the use ofProfessional Study Day. Each teacher shall have the option to select from inservice meetings within his/her2

present area of assignment/certification.2.1.6School Social Workers and Student Services Personnel shall be providedspecialized in-service training on any designated Professional Study Day.2.1.7In addition to regular Pre-K training and in-service, Pre-K teachers shall beafforded the same opportunities as regular classroom teachers to attend inservice training on Professional Study Day.2.1.8Teachers shall be granted the right to utilize flexible working hours on nonstudent days, other than Professional Study Day, with the approval of the siteadministrator.2.1.9The District shall establish early release days. Early release days shall bedesignated as teacher work time. The scheduling of early release days maybe changed upon consultation agreement between the School District ofHillsborough County and the Hillsborough Classroom Teachers Association. Ifspecials and/or a duty-free lunch are not provided during the student portion ofearly release days, comp time shall be granted for loss of planning and/orlunch. If both specials and a duty-free lunch are not provided during the studentportion of early release days, the teacher shall be provided with a restroombreak in addition to comp time. No more than one hour per month may be usedfor PLCs or other data gathering/planning intended to increase studentachievement. A different activity may be scheduled during that time if afaculty – through a secret ballot vote with 2/3 approval – agrees to do so.Activities should be intended to increase student achievement.2.2Vacations For Twelve-Month Teachers2.2.1All twelve-month teachers with up to five years’ continuous service will beentitled to thirteen days’ annual vacation; teachers with five to ten years’continuous service shall be eligible for 16.25 days’ vacation annually; teacherswho have ten or more years of continuous service shall be eligible for19.5 days’ vacation annually. Vacation leave is cumulative, not to exceedeighty (80) days. Accrued vacation will be paid out at the time of termination inaccordance with normal payroll schedules and subject to the payout limitationsunder state statutes.2.2.2Employee vacation requests shall be granted whenever possible. Vacationsshall normally be taken during non- student days.2.2.3If an employee who has reached the eighty (80) day maximum as described in section2.2.1 is denied use of vacation, they shall have the right to forward their request to theChief Human Resources officer.2.3Holidays2.3.1The school holidays and the school year shall be determined3

by the Board when it adopts the annual school calendar and shall be named inthe calendar. If emergency holidays are granted, the time missed must bemade up by reduction of time designated as “vacation” on the annualcalendar.2.3.2The Board shall grant to all teachers working less than twelve months six paidholidays each school year.2.3.3Teachers must be working or be on paid leave or illness days to receive paidholidays. Teachers cannot begin employment nor return from extended leaveon a paid holiday. If teachers resign (except for retirement) on a non-work day,the effective date of resignation will be at the end of their last work day.2.4WorkDuty Hours2.4.1The duty work day for full-time teachers shall be eight hours. The normalhourly dutywork day for eight hour teachers shall be followed during preplanning, post-planning and teacher workday. On conference days/nights, thelength of day for eight hour teachers shall be six hours, including one hour forlunch.2.4.2Compensation on the basic salary schedule shall be based on eight hours ofscheduled time. The Association and Board agree to develop criteria for thepayment of supplemental salaries for teachers over and above the amountreflected in the contracted basic salary schedule. The parties will convene acommittee or committees, as determined by size and scope, to examine andmake recommendations regarding educational and athletic supplements.The committee(s) must complete their work and submit recommendations tothe parties by April 15, 2020.2.4.3Teaching time in secondary schools shall be a maximum of 300 minutes perday over no more than six class periods. This should include classes in notmore than two subject areas nor more than three teacher preparations exceptin cases where unusual circumstances require exception. Such exceptionsmust be approved by the appropriate assistant superintendent after theAssociation has been advised of the unusual circumstance.2.4.4Teaching time in elementary schools shall be a maximum of 300 minutes perday.2.4.42.4.5 An accounting procedure related to teachers reporting for work shall bedeveloped and implemented by Department Heads, Team Leaders or GradeChairmen working in conjunction with their by the Steering Committee,working with teachers at each site. Such procedure shall be submitted to thebuilding administrator for approval prior to implementation, but will not beused for payroll calculations.2.4.6The District incident management system is for safety purposes only, and itshall not be used for employee attendance, time-keeping, or other datacollection purposes.2.5Teaching An Additional Period For Compensation4

2.5.1Current teachers may be employed, on a voluntary basis, to teach anadditional period when the need exists.2.5.2When the need exists, teachers presently employed full-time may be employedfor an additional period provided that their regular day is extended by theequivalent of one hour.2.5.3Each school shall secure a list of all teachers in the school who desire toteach an extra paid period.5

2.5.4When a department needs an additional class taught, certified teachersoutside of the department may teach the additional class only if no one in thedepartment is available.2.5.5Teachers teaching an additional period shall be compensated for an extra hourper day based on their regular hourly rate.2.5.6Teachers teaching an additional period shall receive pay while onprofessional duty elsewhere.2.6Length of Day for AdministrativeDistrict Resource Teachers2.6.1District Administrative and School-Based Resource Teachers are to be onduty for eight hours dailyhave an eight hour work day, including lunch.School-based Administrative Resou
