On October 7, 2010, the Court entered an Order Granting Preliminary Approval ofthe Combined Plan of Liquidation and Disclosure Statement Filed October 1, 2010. Pursuant tothe Order, the deadline to return ballots on the Plan, as well as to file objections to finalapproval of the Disclosure Statement and objections to confirmation of the Plan, isDecember 7, 2010. A hearing to consider final approval of the Disclosure Statement andConfirmation of the Plan will be held on December 14, 2010 at 10:30 a.m., in the Courtroomof the Honorable Marci McIvor, Room 1875, 211 West Fort Street, Detroit, MI.Among other relief, the Plan provides for an amendment to the Debtors’ schedules, asamended, and incorporates an omnibus objection to various claims. Specifically, the Debtorsalso seek to amend the schedules with respect to certain claims that have been improperlyclassified, satisfied and/or released during this case. The amended and/or reclassified claimsinclude (i) proofs of claim that were filed as administrative expense claims and which relate tounpaid employee wages and/or benefits; (ii) claims asserted by the Debtors’ unionizedemployees; (iii) general liability claims and litigation claims represented by general unsecuredclaims in the nature of alleged medical malpractice and/or professional negligence by NOMCand/or its agents and physicians; (iv) claims asserted against the estates for unpaid workers’compensation benefits by employees and/or by the National Labor Relations Board; and (v)personal benefit claims filed by retirees.A list of affected claims subject to objection, reclassification, reduction or expungingis attached.
