MAJOR LEGISLATIONAND RULE CHANGES FOR 2022(currently effective except as otherwise noted)1. Glossary definitions for “Actively Engaged Athlete Representative”, "Delegation Event","Semi-Independent", "10-Year Athlete" and “10-Year Athlete” have been added.(Glossary)2. Development Competition Events (Article 102.1.3) and Officials for Development Meets(Article 102.10) were established [Effective Immediately]; Development CompetitionProgram requirements were outlined, at the option of the LSC. [Effective May 1, 2022](Article 205.11)3. Swim-off procedures were clarified. (Article 102.5.2)4. Personal Assistants must comply with Corporate Bylaws membership requirements. (Article105.1.3C)5. The Athletes' Advisory Council was created to comply with the USOPC Bylaws. (Article501.1.1)6. The Coach Advisory Council was created. (Article 501.1.2)7. Printed Rulebooks will be distributed annually to non-athlete members. (Article 503)8. Certain provisions in the Corporate Bylaws (Articles 4 and 6) and the Rulebook (OfficialGlossary and Articles 402.1, 407.1, 501.1 & 6.1) were amended by the House of Delegatesto comply with USOPC requirements regarding representation of 10-Year and 10-Year Athletes. Additional provisions of the Corporate Bylaws were amended by the Board ofDirectors to align with USOPC requirements. (Corporate Bylaws Articles 1.1, 5.1, 5.2, 5.3,5.4, 5.5 & 6.3)9. Marshals must be non-athlete members. (Corporate Bylaws Article 2.6.6E)10. Terms of standing committee members have changed to three (3) years. (Corporate BylawsArticle 5.1.2C)11. Elimination of the Credentials/Elections Committee. [Effective September 2022] (CorporateBylaws Article 5.4)12. The Required LSC Bylaws template was amended to add the Diversity, Equity & Inclusion(DEI) Chair/Coordinator as a voting member of the LSC Board of Directors. [EffectiveJanuary 1, 2023] (Required LSC Bylaws Template Article 5.1)1

Membership Expectations and ResourcesAll members are expected to comply with these expectations, USASwimming’s rules, policies and procedures, the USA SwimmingCode of Conduct, applicable state and federal laws, includingwithout limitation the Ted Stevens Olympic and Amateur SportsAct, as well as the USOPC rules, policies and procedures.All alleged USA Swimming Code of Conduct violations shall bereported and resolved according to the USA Swimming NationalBoard of Review Procedures located in the USA SwimmingOperating Policy Manual. Alleged Code of Conduct violations canbe reported using the online reporting tool located ReportingForm/index.html.The Secretary & General Counsel is responsible for theenforcement of the Code of Conduct. All inquiries and questionsshould be referred to the Secretary & General Counsel whosecontact information can be located on/overview#all-staff.Anti-Doping ExpectationsAll members understand and agree that the FINA Anti-Doping rulesand U.S. Anti-Doping Agency Protocol for Olympic and ParalympicMovement Testing (the “USADA Protocol”) and all other policiesand rules adopted by FINA, USADA and the USOPC apply to allmembers and that it is all members’ individual responsibility tocomply with those rules. All members agree to submit to drugtesting at any time and understand that the use of methods andsubstances prohibited by the applicable anti-doping rules wouldmake the athlete member subject to penalties including, but notlimited to, disqualification and suspension. If it is determined thatthe athlete member may have committee a doping violation, theathlete member agrees to submit to the results managementauthority and processes of USADA, including arbitration under theUSADA Protocol, or to the results management authority of FINAand/or USA Swimming, if applicable or referred by USADA.

Anti-Retaliation StatementNo USA Swimming Board members, officers, employees,members, athletes, committee members, task force members,hearing panel members, volunteers, good faith reporter or otherreasonable party (e.g., witnesses, victims, etc.) shall sufferharassment, intimidation, adverse employment or livelihoodconsequences, or any other form of retaliation (“Retaliation”) for (i)making a good faith report of a violation to USA Swimming, theUSOPC, or the U.S. Center for SafeSport (the ”Center”), or (ii)participating in an investigation by USA Swimming, the USOPC, orthe Center, or an inquiry or investigation by any court, lawenforcement, or other governmental or administrative body.“Retaliation” also includes retaliation as described in Article 307 ofthe USA Swimming Rulebook and the definition of retaliationincluded in Section 220501(b)(11) of the Ted Stevens Olympic andAmateur Sports Act (the “Act”).Additionally, no employee, contractor, agent, volunteer, or USASwimming itself shall take or threaten to take any action against anathlete as a reprisal for disclosing information to or seekingassistance from the Office of the Athlete Ombuds as outlined inSection 220509(b)(5) of the Act.USOPC Office of the Athlete OmbudsThe USOPC Office of the Athlete Ombuds offers independent,confidential advice to elite athletes regarding their rights andresponsibilities in the Olympic and Paralympic Movement, andassists athletes with a broad range of questions, disputes,complaints and concerns.Athlete Ombuds Confidentiality and Privacy Policy(A) In general.—The Office of the Athlete Ombuds shall maintainas confidential any information communicated or provided to theOffice of the Athlete Ombuds in confidence in any matterinvolving the exercise of the official duties of the Office of theAthlete Ombuds.(B) Exception.—The Office of the Athlete Ombuds may discloseinformation described in subparagraph (A) as necessary toresolve or mediate a dispute, with the permission of the parties

involved.(C) Judicial and administrative proceedings.—(i) In general.—The ombudsman and the staff of the Office of the AthleteOmbuds shall not be compelled to testify or produce evidence inany judicial or administrative proceeding with respect to anymatter involving the exercise of the duties of the Office of theAthlete Ombuds. (ii) Work product.—Any memorandum, workproduct, notes, or case file of the Office of the Athlete Ombuds—(I) shall be confidential; and (II) shall not be—(aa) subject todiscovery, subpoena, or any other means of legal compulsion; or(bb) admissible as evidence in a judicial or administrativeproceeding.(D) Applicability.—The confidentiality requirements under thisparagraph shall not apply to information relating to—(i)applicable federally mandated reporting requirements; (ii) afelony personally witnessed by a member of the Office of theAthlete Ombuds;(iii) a situation, communicated to the Office ofthe Athlete Ombuds, in which an individual is at imminent risk ofserious harm; or (iv) a congressional subpoena.Contact Information:Phone:719-866-5000Email: ombudsman@usathlete.orgWebsite: usathlete.orgUSOPC Ethics and ComplianceThe USOPC Ethics and Compliance team seeks to empowerathletes, USOPC employees and volunteers, NGB employees andvolunteers, and other individuals within the U.S. Olympic andParalympic Movement to raise and report their concerns.Specifically, the USOPC’s Ethic’s and Compliance team reviewsand investigates certain reports regarding NGB compliance withthe Ted Stevens Olympic and Amateur Sports Act and the USOPCor NGB Bylaws, including conflicts of interest and governanceissues. The team also reviews and investigates allegations ofUSOPC non-compliance and alleged code of conduct violations.The USOPC Ethics and Compliance team accepts reports relatedto NGB compliance with the Ted Stevens Olympic and AmateurSports Act and the USOPC or NGB Bylaws, including conflicts of

DOPING CONTROLMEMBERSHIP ANTI-DOPING OBLIGATIONS.It is the duty of individual members of USA Swimming, including athletes, athlete support personnel, and other persons to comply with all anti-doping rules of the World Anti-Doping Agency(WADA), FINA, the USOPC, including the USOPC National Anti-Doping Policy, and the U.S. AntiDoping Agency (USADA), including the USADA Protocol for Olympic and Paralympic MovementTesting (USADA Protocol), and all other policies and rules adopted by WADA, FINA, the USOPCand USADA. Athlete members agree to submit to drug testing by the FINA and/or USADA ortheir designees at any time and understand that the use of methods or substances prohibited bythe applicable anti-doping rules make them subject to penalties including, but not limited to, disqualification and suspension. If it is determined that an individual member may have committed adoping violation, the member agrees to submit to the results management authority and processes of USADA, including arbitration under the USADA Protocol, or to the results managementauthority of FINA, if applicable or referred by USADA.To comply with the World Anti-Doping Code, FINA, USOPC and USADA have all amended theiranti-doping rules. This List will take effect on January 1, 2022.All athletes should check the status of all medications they plan to take PRIOR to taking them.This includes over-the-counter and prescription medications. It is the responsibility of the athleteto ensure that no prohibited substance enters his/her system.The United States Anti-Doping Agency (USADA) offers a Drug Reference Line (719-785-2000)and a Drug Reference Online (www.globaldro.com) where athletes, coaches, athlete support personnel, parents and medical professionals may check to ensure that proper documentation is onfile for their medications and that they are consuming medications that are permitted.Dietary supplements are considered “Take at Your Own Risk” as claims made by the manufacturers/distributors of dietary supplements regarding the effectiveness or contents of their productsare not strictly regulated by the U.S. Food and Drug Administration. Any commercial dietary supplement is susceptible to containing substances that may appear on the Prohibited Substancelist(s) of FINA and/or the World Anti-Doping Agency. These substances may not be listed on theingredients label of the product.2
