However, new sheets are occasionally added to the Tariff. When a newsheet is added between sheets already in effect, a decimal is added. For example, a new sheetadded between sheets 14 and 15 would be 14.1.B.Sheet Revision Numbers – Revision numbers also appear in the upper right corner of each page.These numbers are used to determine the most current sheet version on file with the Commission.For example, the 4th Revised Page 14 cancels the 3rd Revised Page 14. Tariff No. 3Original Page 7COMPETITIVE ACCESS PROVIDER SERVICEAPPLICATION OF TARIFFThis tariff sets forth the service offerings, rates, terms and conditions applicable to the furnishing of intrastatecompetitive access services by the Competitive Local Exchange Carrier (CLEC) operations of Lumos Networks ofWest Virginia Inc. d/b/a Segra (hereinafter “the Company”). Services supplied to Customers are for origination andtermination of traffic to and from the facilities and wire centers of the Company located within the Commonwealth ofPennsylvania.The Company is a facilities based provider of wholesale competitive access services. Service is offered via theCompany's facilities or in combination with transmission facilities of other companies. The dedicated high-speeddigital service provided includes the furnishing of intrastate interLATA and intraLATA DedicatedTelecommunications services in connection with one-way and/or two-way information transmission originating fromnonresidential user points within the Commonwealth of Pennsylvania. Tariff No. 3Original Page 1-1COMPETITIVE ACCESS PROVIDER SERVICE1.DEFINITIONSCertain terms used generally throughout this tariff for the competitive access services of this Company aredefined below.Advance Payment - Part or all of a payment required before the start of service.Access Services - The Company's intrastate communications services offered pursuant to this tariff.Application for Service - An application that includes all pertinent billing, technical and other descriptiveinformation that will enable the Company, Lumos Networks of West Virginia Inc. d/b/a Segra, to providethe specified communications services.Authorized User - A person, firm, corporation or other entity authorized by the Customer to receive or sendcommunications. Tariff No. 3Original Page 1-2COMPETITIVE ACCESS PROVIDER SERVICE1.DEFINITIONS (Cont'd)Individual Case Basis (ICB) - A service arrangement in which the regulations, rates and charges aredeveloped based on the specific circumstances of the case.Installation - The connection of a circuit, dedicated access line, or port for a new service, a change ofservice, or an additional service.Installation Charge - A non-recurring charge made at the time of installation of communications servicewhich may apply in place of or in addition to service charges and other applicable charges for service orequipment.Interruption - A condition whereby the service or portion of service is inoperative, beginning at the time ofnotice by the Customer to Company that such service is inoperative, and ending at the time of restoration.LATA - A Local Access and Transport Area established pursuant to the Modification of Final Judgmententered by the United States District Court for the District of Columbia in Civil Action No. 82-0192; or anyother geographic area designated as a LATA in the National Exchange Carrier Association, Inc. TariffF.C.C. No. 4.Network - Refers to the Company's facilities, equipment, and services provided under this Tariff.Nonrecurring Charge - A one-time charge associated with a specific item of equipment or service. Tariff No. 3Original Page 1-3COMPETITIVE ACCESS PROVIDER SERVICE1.DEFINITIONS (Cont'd)Service Commencement Date - The first date on which the Company notifies the Customer that therequested service or facility is available for use, unless extended by the Customer's refusal to accept servicewhich does not conform to standards set forth in the Service Order or this tariff, in which case the ServiceCommencement Date is the date of the Customer's acceptance. The Company and the Customer maymutually agree on a substitute Service Commencement Date. If the Company does not have an executedService Order from a Customer, the Service Commencement Date will be the first date on which the serviceor facility was used by a Customer.Service Order - The written request for dedicated services executed by the Customer and the Company inthe format devised by the Company. The signing of a Service Order by the Customer and acceptance by theCompany initiates the respective obligations of the parties as set forth therein and pursuant to this tariff, butthe duration of the service is calculated from the Service Commencement Date. Tariff No. 3Original Page 2-1COMPETITIVE ACCESS PROVIDER SERVICE2.REGULATIONS2.1Undertaking of the Company2.1.1The Company undertakes to furnish dedicated point to point access in accordance withthe terms and conditions set forth in this Tariff.2.1.2The Company installs, operates, and maintains the communications services providedunder this Tariff in accordance with the terms and conditions set forth under this Tariff.When authorized by the Customer, Company may at its option act as the Customer's agentfor ordering access connection facilities provided by other carriers or entities, as requiredin the Commission's rules and orders, to allow connection of a Customer's location to theCompany network.2.1.3The obligation of the Company to furnish service is conditioned upon its ability to secureand retain suitable facilities and is subject to the provisions of this Tariff. The Companyreserves the right to limit or to allocate the use of existing facilities or additional facilitiesoffered by the Company, when necessary, because of a lack of facilities or due to anyother cause beyond the Company's control.2.1.4Customers and users may use services and facilities provided under this Tariff to obtainaccess to services offered by other service providers. Theminimum service period for services offered in this Tariff is twelve (12) months. For thepurpose of computing charges in this Tariff, a month is considered to have 30 days. Allservices for periods longer than one (1) year will be provided on an individual case basis.2.2.2Service OrdersCustomers may be required to enter into written Service Orders which shall contain orreference a specific description of the service ordered, the rates to be charged, theduration of the services, and the terms and conditions in this Tariff. Customers will alsobe required to execute any other documents as may be reasonably requested by theCompany.2.2.3Expiration of Service OrderAt the expiration of the initial term specified in each Service Order, or in any extensionthereof, service shall continue on a month-to-month basis at the then current rates unlessterminated by either party upon 30 days' written notice. Any termination shall not relievethe Customer of its obligation to pay any charges incurred under the service order and thisTariff prior to termination. At the Customer's request, installationand/or maintenance may be performed outside the Company's regular business hours or inhazardous locations. In such cases, charges based on cost of the actual labor, material, orother costs incurred by or charged to the Company will apply. If installation is startedduring regular business hours, but at the Customer's request, extends beyond regularbusiness hours into time periods including, but not limited to, weekends, holidays, and/ornight hours, additional charges may apply.2.2.6Inspection and Testing(A)The Company may, upon reasonable notice, make such tests and inspections asmay be necessary to determine that the requirements of this Tariff are beingcomplied with in the installation, operation or maintenance of Customer orCompany equipment. The Company may interrupt the service at any time,without liability to Company, because of Customer's departure from any of theTariff requirements.(B)If the protective requirements for Customer-provided equipment are not beingcomplied with, the Company may take such action as it deems necessary toprotect its facilities, equipment, and personnel. The Company will notify theCustomer promptly if there is any need for further corrective action. Within ten(10) days of receiving this notice, the Customer must take this corrective actionand notify the Company of the action taken. Such activities may include,but are not limited to, equipment or facilities additions, removals or rearrangements androutine preventative maintenance.2.2.8Ownership of FacilitiesTitle to all facilities provided in accordance with this Tariff remains in the Company, itsagents or contractors. The Customer shall not have, nor shall it assert any right, title orinterest in, any facilities and equipment provided by the Company hereunder.
