TEXAS STATE BOARD OF PHARMACYDISCIPLINARY ACTIONSSeptember - November 2015After the Board obtains evidence of alleged violations, a licensee is sent a preliminary notice letter of the Board’s intent to institutedisciplinary action.The licensee then has an opportunity to show compliance with the law in an informal conference with the Board staff (Executive Director/Secretary, Board Legal Counsel, and other staff at the discretion of the Executive Director and Board Legal Counsel). If the licenseecannot show compliance with the law and desires to dispose of any pending allegations, the licensee may consent to the entry of an“Agreed Board Order.” The licensee must agree to the terms of the order and the order must be approved by the Board.It should be noted that while there is agreement on the part of the licensee to the entry of an “Agreed Board Order,” there is neitheradmission nor denial of guilt with respect to any matters that have come to the attention of the Board.If a licensee, or the Board does not agree to terms of the “Agreed Board Order” or if the licensee does not wish an informal conference, adisciplinary hearing is scheduled before an Administrative Law Judge from the Office of Administrative Hearings. The Administrative LawJudge, after hearing all evidence in the matter will make a recommendation to the Board for action to be taken. HIPDBThe Health Insurance Portability andAccountability Act of 1996 establishedthe Healthcare Integrity and ProtectionData Bank (HIPDB), a nationalhealthcare fraud and abuse datacollection program. In order to implementHIPDB, the U. S. Department of Healthand Human Services adopted rulesthat require all state health licensingagencies to report disciplinary actionsimposed on its licensees.TheTexas State Board of Pharmacy(TSBP) is required to submit reportsto HIPDB regarding all disciplinaryactions taken against pharmacists,pharmacies, pharmacist-interns, andpharmacy technicians. After HIPDBreceives a report from TSBP, HIPDBwill send a copy of the report to thelicensee.
