DEMURRAGEThis sub-rule sets out the charge for the use of land assessed on the container for remaining insidethe marine terminal after the expiration of the free time until the container is delivered to the lawfulreceiver of the goods or its representatives (demurrage charges), unless the carrier has agreed todifferent terms, in writing, which may be more favorable to the merchant, in which case such termsshall apply.A.1 IMPORT CONTAINERSThe merchant is liable for demurrage charges assessed on the import containers, which will becharged only once to the cargo interest by either the marine terminal operator or the carrier. In theevent the carrier charges the merchant, the demurrage charges will be calculated as set forth below.In the event the marine terminal operator charges the merchant, the demurrage charges will becalculated as set forth below or as set forth in the marine terminal operator’s public tariff. D. PER DIEMThis sub-rule sets out the charges assessed by the carrier, after the expiration of the free time, forthe use of the Carrier's container (full or empty) outside of the marine terminal, rail road orcontainer yard facilities until it is returned to the carrier's custody at the carriers designated place ofreturn (per diem charges), unless the carrier has agreed to different terms, in writing, which may bemore favorable to the merchant, in which case such terms shall apply. The per diem charges are forthe merchant account, except that the carrier will invoice merchant truckers providing they areholders of a legitimate executed interchange agreement with the carrier. Special conditions unless otherwise provided in this rule:Where the carrier has agreed to a free time (extended free time) that is longer than the applicablestandard free time set out in this rule (standard free time) without specifying the applicabledemurrage charges and/or storage charges and/or detention charges and/or combined detentioncharges (as applicable) after the extended free time, the merchant shall start paying the charge asset out in this rule for each day after the extended free time has expired, until the day the containerhas been delivered to the lawful receiver of the goods or its representative(s) and/or returned to thecarrier's custody at the carrier's designated place of return(as applicable).
