HARTIGAN, the Attorney General of1Illinois, and the Illinois Department of Nuclear Safety and asks'leave of the-Board to submit the following contention: Neither the Kerr-McGee model nor the NRC Staff modeladequately establishes that the proposed disposal cell willsatisfy 10 CFR Part 40, Appendix A.Kerr-McGee used a two dimen- sional, horizontal site specific model while the NRC Staff used athree dimensional non-site specific model. In order to accurate-ly model the vertical movement of' chemical and/or radiologicalconstituents through the disposal cell, the parties should haveused a three dimensional, site specific model.Neither the NRCStaff model nor the Kerr-McGee model provides results upon whichit can be concluded that groundwater in the Silurian Dolomite aquifer will be protected.Illinois submits that it has met the balancing testunder 10 CFR 2. 714 (a) (1) as required by 10 CFR 2.714(3):i)Good cause, if any, for failure to fileon time:8912270174 091213PDRCADOCK0400g1--13 9. - , . . .-.*-sD9-W

''-.*The-deficiencies in the use of a two dimensional modeli. . .were first discussed in Dr. Warner's testimony presented to theBoard on December 6,1989 and addressed by the deponents duringthe' deposition which took place on December 15, 6 and 7,ii)1989;The availability of other means wherebythe petitioner's interest will beprotected.The modeling is the most critical aspect of Kerr-McGeeand the NRC Staff's ability to forecast the effects ofgroundwater contamination.If the models do not accuratelyportray the movement of dissolved solutes through the variousstrata, then the validity of choosing West Chicago as the disposal site must be called into question.Therefore, there is noother way of protecting petitioner's interest other than allowing Contention 10.iii)The extent to which the petitioner's participation may reasonably be expected toassist in developing a sound record. l;The participation of Illinois has in part brought someconcerns pertaining to the possibility of groundwater contamination under the West Chicago site to the Board's attention.)iv)The extent to which the petitioner'sinterest will be represented by existingparties.It is the position of Illinois that neither Kerr-McGee.nor the NRC Staff have adequately addressed the deficiencies ofthe models they have employed during the course of theseproceedings.-2-
