Redistricting InformationONLINE CANDIDATE FILING PORTALA custom online Candidate Filing feature on the Registrar of Voters’ website will be availableon January 3, 2022, at ocvote.gov for candidates wishing to obtain Signatures In-Lieu ofFiling Fee Petitions and on February 14, 2022, for all other candidates. This portal allowscandidates to start the Candidate Filing process and download many of the requireddocuments, prior to filing the documents at the Registrar of Voters’ office.This service will benefit you, the candidate. Candidate Filing cannot be entirelycompleted online due to State law, but it should make your filing process simpler andeasier to understand. Benefits to the candidate include: Signature-in-Lieu of Filing Fee Petitions and Nomination Papers may be downloadedand circulated prior to candidates filing these documents at the Registrar of Voters’office; The Filing Fee and Candidate’s Statement of Qualifications Fee may be paid onlineby credit card; Draft Candidates’ Statements of Qualifications may be electronically submitted,allowing Registrar of Voters’ staff to format the statements prior to the candidatescoming to the office to sign the final documents. Formatting statements is timeconsuming; by submitting their statements online, candidates will reduce their timespent at the Registrar of Voters’ office; and The Ballot Designation Worksheet, Code of Fair Campaign Practices form, andCampaign Finance Reporting forms may be downloaded prior to candidates filingthem at the Registrar of Voters’ office.CANDIDATE FILING APPOINTMENTSSave time by scheduling an appointment online at ocvote.gov/appointments to complete thecandidate filing process. Appointments are available in the morning and evening, startingFebruary 14, 2022.SUPPLEMENTAL SIGNATURES-IN-LIEU CHANGEAB 469 changed the dates of the Signatures-In-Lieu of filing period and ended the ability ofa candidate to submit supplemental petitions to cover any deficiency. This change allowsthe candidate to only submit a pro rata portion of the filing fee.3

CHARACTER-BASED NAME FORMIf a candidate that has a character-based name by birth, that can be verified by birthcertificate or other valid identification, the candidate may use that name on the ballot insteadof a phonetic transliteration. A candidate who does not have a character-based name bybirth, but who identifies by a particular character-based name and can demonstrate to thelocal elections official that the candidate has been known and identified within the publicsphere by that name over the past two years, may use that name instead of a phonetictransliteration. This only applies to character-based languages, including, but not limited to,Chinese and Korean.§ 13211.7ELECTRONIC CANDIDATE’S STATEMENTSIn addition to the statement prepared pursuant to §13307(a), if the elections official who isconducting the election permits electronic distribution of a candidate’s statement, thegoverning body of a local agency may permit each candidate for nonpartisan elective officein the local agency to prepare a candidate's statement for the purpose of electronicdistribution pursuant to this subdivision.§ 13307(c)(1)A statement prepared pursuant to §13307(c), shall be posted on the Internet Web site of theelections official, and may be included in a voter’s guide that is electronically distributed bythe elections official pursuant to Section 13300.7, but shall not be included in a voter’s guidethat is printed and mailed to voters pursuant to §13307(b).United States Senator Special Primary Vacancy ElectionThe Governor shall issue a writ of election for a statewide general election to fill a vacancyin the United States Senate. The special vacancy election will be consolidated with theregularly scheduled statewide primary election to be held on June 7, 2022, and the regularlyscheduled statewide general election to be held on November 8, 2022. § 10720(b). Thisspecial vacancy election is for the remainder of the unexpired term in the United StatesSenate, which ends on January 3, 2023.PROPOSITION 14:The Top Two Candidates Open Primary ActPassed by the Voters in June of 2010This proposition provides for a “voter-nominated Primary Election” for each state electiveoffice and congressional office in California. A voter may vote at the Primary Election for anycandidate for congressional or state elective office without regard to the political partypreference (formerly known as “party affiliation”) disclosed by either the candidate or thevoter.The top two candidates receiving the two highest vote totals for each office at a PrimaryElection, regardless of party preference, would then compete for the office at the ensuingGeneral Election.Voter-Nominated Offices:For the June 7, 2022 Statewide Direct Primary Election, voter-nominated offices are:Member of the United States Senate, Representative in Congress, State ConstitutionalOfficers -- Governor, Lieutenant Governor, Secretary of State, Controller, StateTreasurer, Attorney General, Insurance Commissioner, and Member of the StateBoard of Equalization-District 4 -- Member of the State Senate, and Member of theState Assembly.4

Under the California Constitution, political parties are not entitled to formally nominatecandidates for voter-nominated offices at the Primary Election, and a candidatenominated for a voter-nominated office at the Primary Election is not the official nominee ofany party for the office in question at the ensuing General Election.All voters, regardless of the party preference listed on their registration affidavit or theirrefusal to disclose a party preference, may vote for any candidate for a voter-nominatedoffice, provided they meet the other qualifications required to vote for that office.The top two vote-getters at the Primary Election advance to the General Election forthe voter-nominated office, and both candidates may have specified the same partypreference designation. No party is entitled to have a candidate with its party preferencedesignation participate in the General Election unless such candidate is one of the twohighest vote-getters at the Primary Election.A candidate for nomination or election to a voter-nominated office shall, however, designatehis or her party preference, or lack of party preference, and have that designation reflectedon the Primary and General Elections’ ballots, but the party designation so indicated isselected solely by the candidate and is shown for the information of the voter only. Itdoes not constitute or imply an endorsement of the candidate by the party designated, andno candidate nominated by the qualified voters for any voter-nominated office shall bedeemed to be the officially nominated candidate of any political party. The parties may havea list of candidates for voter-nominated offices, who have received the official endorsementof the party, printed in the Voter Information Guide.A candidate for “voter-nominated” office must provide his/her party preference history forthe preceding 10 years when he/she files his/her Declaration of Candidacy. Voters mayobtain this party preference history on the Secretary of State’s and Registrar of Voters’websites.A voter may vote for a qualified write-in candidate for a “voter-nominated” contest in theStatewide Direct Primary Election. A voter may not write-in a person’s name for a voternominated office at the General Election.Nonpartisan Offices:For the June 7, 2022 Statewide Direct Primary Election, nonpartisan offices are: StateSuperintendent of Public Instruction, Member of the Orange County Board ofSupervisors, Member of the Orange County Board of Education, Judge of theSuperior Court, and County Officers – Assessor, Auditor-Controller, Clerk-Recorder,District Attorney-Public Administrator, Sheriff-Coroner, County Superintendent ofSchools, and County Treasurer-Tax Collector.Under the California Constitution, political parties are not entitled to nominate candidates fornonpartisan offices at the Primary Election, and a candidate nominated for a nonpartisanoffice at the Primary Election is not the official nominee of any party for the office in questionat the ensuing General Election.A candidate for nomination or election to a nonpartisan office may NOT designate his or herparty preference, or lack of party preference, on the Primary and the General Elections’ballots. If the nonpartisan contest goes to a run-off in the General Election, the top two votegetters at the Primary Election advance to the General Election. Proposition 14 does notchange how candidates for nonpartisan offices are nominated/elected.5

REDISTRICTING INFORMATIONRedistricting Explained:In order to have an updated count of the country's population, the U.S. Constitution requiresa federal census every ten years. California uses that census data to redraw theCongressional, State Senate, State Assembly, and State Board of Equalization districtsbased on population changes. The independent California Citizens RedistrictingCommission (CCRC) uses the new census data to redraw the Congressional, State Senate,State Assembly, and State Board of Equalization district boundaries. CCRC will certify finaldistrict maps and deliver them to the Secretary of State no later than December 27, 2021.The Secretary of State will provide the new CCRC maps to the California State Legislatureand to California's 58 counties who will redraw precincts within the new district boundariesand assign voters to the updated precincts. In Orange County, the Board of Supervisors isresponsible for drawing supervisorial districts.Delays in Boundaries Due to COVID:Redistricting is completed using U.S. Census data, which would normally be released onMarch 31, 2021. Due to the COVID-19 pandemic, the release of the U.S. Census data wasdelayed for six months until September of 2021. This resulted in a delay in the adoption ofdistrict boundaries for all districts, including Congressional, State Senate, State Assembly,State Board of Equalization, and County Board of Supervisors. The Orange CountyRegistrar of Voters has taken every action possible to minimize the impact of this delay forits candidates.What Redistricting Means to Candidates:The district numbers and boundaries for the offices of Congress, State Assembly, StateSenate, State Board of Equalization, and County Board of Supervisors have changed.Voters will be voting for candidates running for office using the new district boundaries aspart of California's June 7, 2022, Statewide Direct Primary Election. For this candidate filingperiod, if the office has residency requirements for candidates or voters, the candidate orvoter must reside in the new district boundaries. Orange County has tools for candidatesand voters to be able to verify the districts in which they reside including an online districtverification tool, electronic maps, and printed maps available for purchase.Information on ordering electronic or printed maps is located in the back of this Handbook.Online District Verification Tool:The online district verification tool is available at ocvote.gov/findmydistrict. Using an addressor the interactive map, you can verify the districts in which a candidate or voter resides.6

For the June 7, 2022 Statewide DirectPrimary Election, voter-nominated offices are: Member of theUnited States Senate, Representative in Congress, StateConstitutional Officers, Member of the State Senate, and Memberof the State Assembly.§§ 8002.5(c), 8068For nonpartisan offices, signers shall be registered voters in the districtin which the candidate is to be voted on. Signers do not need to beaffiliated with the same party as the candidate or have disclosed apreference for any party on their registration affidavits. For theJune 7, 2022 Statewide Direct Primary Election, nonpartisanoffices are: State Superintendent of Public Instruction, CountyMember of the Board of Supervisors, Judge of the Superior Court,County Member of the Board of Education, and County offices –Assessor, Auditor-Controller, Clerk-Recorder, District AttorneyPublic Administrator, Sheriff-Coroner, County Superintendent ofSchools, and County Treasurer-Tax Collector.For voter-nominated offices, a candidate shall indicate his or her partypreference, or lack of party preference, as disclosed upon thecandidate’s most recent registration affidavit, upon his or herDeclaration of Candidacy. A candidate’s party preference, or lack ofparty preference, shall appear on the Primary and General Elections’ballots in conjunction with his/her name. The candidate’s designatedparty preference on the ballot shall not be changed between thePrimary and General Elections.§§ 8002.5, 13105A candidate designating a party preference for a voter-nominated officeshall not be deemed to be the official nominee of the party designatedas preferred by the candidate. The party preference is shown for theinformation of the voters only.§ 8002.5February 14, 2022throughMarch 11, 2022(E-113 – 88)CANDIDATE PARTY PREFERENCE HISTORY: Under theTop Two Candidates Open Primary Act (Proposition 14) which wasapproved by California voters in June of 2010, the Secretary ofState is required to provide the political party preference history forthe preceding 10 years for voter-nominated office candidates.
