It is illegal to dispose offish carcasses or cleanings on shorelines. GENERAL LICENSINGNo license may be refunded ortransferred to another person afterbeing issued. A fishing license isneeded to take fish, turtles, bullfrogsor bait. A hoop net/trap or setlinelicense, in addition to a validresident fishing license, is requiredwhen using these methods. SeeHoop Net and Setline Licenses in theResident License Section.AGENT FEEThe maximum fee for each fishinglicense sold or replaced by a licenseagent or online is 4.BUYING LICENSESResident and nonresident fishinglicenses may be purchased in SouthDakota at many retail stores, baitshops and a few County Treasureroffices. When purchasing licensesover the counter you must have yourstate-issued ID with you.Licenses may be purchased andprinted from home. To purchaselicenses online, visit gfp.sd.gov.See Resident Hoop Net and SetlineLicenses in the Resident Licensingsection for details about purchasingthese licenses.CARRYING/EXHIBITING LICENSESA licensee shall exhibit thelicensee’s license or licenseauthorization issued by theDepartment of Game, Fishand Parks upon request by aconservation officer or other lawenforcement officer. A licensee whois 16 years of age or older whoholds the license authorization, shallexhibit and provide for inspectiona driver’s license, a state-issuedidentification card or anotherform of valid identification for thepurpose of verifying the identity ofthe licensee.Persons hunting, fishing, trappingor engaging in any recreationalactivity on private land shall uponrequest exhibit their license tohunt, fish or trap. If unlicensed orengaged in another recreationalactivity, that person shall providetheir first and last name, town/cityand state/province of residenceas shown on their driver’s license,state-issued identification card orother form of valid identification toany person with legal authority tocontrol access to the private landwhere the hunting, fishing, trappingor other recreational activity isoccurring.DELINQUENT CHILD SUPPORTSouth Dakota law prohibitsthe issuance or renewal of anyhunting or fishing license if anindividual owes 1,000 or more inpast-due child support, unless theindividual enters into a repaymentagreement with the Departmentof Social Services for paymentof the delinquent child support.There is a requirement to enterinto a repayment agreement withthe Department of Social Serviceseven if the individual is presentlymaking child support payments, orif child support is being withheldfrom wages or income. In addition,licenses may be reprinted at homeby the licensee at any time.REVOKED LICENSESIf a person is convicted ofknowingly trespassing or violatinga fishing law punishable as a Class1 misdemeanor, or substantiallyexceeding daily or possession limits,or violating any rule pertaining tofishing or possessing fish without alicense or during a closed season,the person’s fishing privileges willbe revoked for one or more yearsand the person is prohibited frompurchasing or applying for anotherfishing license during the period ofrevocation.Those whose privileges arerevoked in South Dakota may besubject to revocation or suspension inother states, including the home stateof non-residents. Any person whosefishing privileges are currentlyrevoked or suspended in any stateor country may not apply for orbuy a license or exercise the sameprivilege in South Dakota during theperiod of revocation or suspension.No person who has an unpaidand unsatisfied judgment issuedfor wildlife civil damages may8 2021 South Dakota Fishing Handbookpurchase, attempt to purchase orpossess any South Dakota hunting,fishing or trapping license.SOCIAL SECURITY NUMBERAll U.S. residents are requiredby federal and state law (SDCL25-7A-56.2) to provide their SocialSecurity Number when purchasingand applying for a license, evenwhen purchased online. SouthDakota continues to maintain thehighest level of online securitystandards through the PaymentCard Industry (PCI) to maintaincustomer safety when processingonline transactions.TRIBAL WATERSNon-tribal members fishinginland waters that overlay Indiantrust property need a tribal fishinglicense. Non-tribal members fishingon the Missouri River and itsimpoundments need only the statelicense. However, anglers fishing theMissouri River from tribal lands mayneed to purchase a tribal fishinglicense or access permit from thetribe to fish from shore.

A domicile isa person’s established, fixed,and permanent home to whichthe person, whenever absent,has the present intention ofreturning.» Make no claim of residencyin any other state or foreigncountry for any purpose.» Claim no resident hunting,fishing, or trapping privilegesin any other state or foreigncountry.» Have a valid South Dakotadriver’s license and motorvehicles registered in SouthDakota prior to application/purchase.EXCEPTIONS: The following personsare deemed to be residents of thisstate as long as they continue tomeet any of the conditions set forthbelow:» Any person who previouslyhad a domicile in this statewho is absent due to businessof the United States or of thisstate, or is serving in the armedforces of the United States orthe spouse of an active dutymilitary person;» Any person who previouslyhad a domicile in this state whois absent due to the person’sregular attendance at a posthigh school institution as afull-time student or due to theperson’s regular attendance ina medical or dental residencyprogram;» Any person in the activemilitary of the United Statesor that person’s spouse who iscontinuously stationed in thisstate;» Any person who is a patientin any war veterans’ hospitalwithin this state;gfp.sd.gov 605.223.7660 9

RESIDENT LICENSING» Any person who is anemployee of the veterans’administration or any veterans’hospital in this state;» Any person residing onrestricted military reservationsin this state;» Any person attending regularlya post-high school institutionin this state as a full-timestudent for 30 days or moreimmediately preceding theapplication;» Any foreign exchangestudent over 16 years of ageattending a public or privatehigh school who has resided inthe state for 30 days or morepreceding the application;» Any foreign exchange studentwho is between the agesof 12-16 years who hascompleted the GFP’s courseof instruction in the safehandling of firearms and hasbeen issued a certificate ofcompetency upon completion ofinstruction and who has residedin the state for 30 days ormore preceding application fora license;» Any person who is a minordependent of a resident of thisstate; and» For the purpose of acquiringresident small game andfishing licenses, any personwho does not reside in SouthDakota but who is a memberof the South Dakota NationalGuard or of any other unit ofa reserve component of thearmed forces of the UnitedStates that is located in SouthDakota.TERMINATION OF RESIDENCYA person (other than a personwho fits into one of the aboveEXCEPTIONS) is deemed to haveterminated their South Dakotaresident hunting, fishing, andtrapping status if the person doesany of the following:» Applies for, purchases, oraccepts a resident hunting,fishing, or trapping licenseissued by another state orforeign country;» Registers to vote in anotherstate or foreign country;» Accepts a driver’s licenseissued by another state orforeign country; or» Moves to any other state orforeign country and makes itthe person’s domicile or makesany claim of residency for anypurpose in the other state orforeign country.However, a person who haslawfully acquired a resident hunting,fishing, or trapping license and wholeaves the state after acquiringthe license to take up residencyelsewhere may continue to exerciseall the privileges granted by thelicense until the license expires if theperson’s respective privileges arenot revoked or suspended.MILITARY GENERAL FISHING ANDHUNTING LICENSEAny resident who is on activeduty in the armed forces of theUnited States and who is stationedat a location outside the statemay fish and hunt small gamewithout payment of a fee or theapplicable hunting and fishing10 2021 South Dakota Fishing Handbook

RESIDENT LICENSINGlicense authorizing the activity.While engaged in the permittedactivity, the resident shall possessand display appropriate militaryorders indicating the resident is onactive duty stationed outside ofSouth Dakota and a valid militaryidentification card. This section doesnot apply to any person who isserving on active duty for trainingas a member of the armed forcesreserve or National Guard.PROOF OF RESIDENCYTo buy a license, a resident age16 or older needs a valid SouthDakota driver’s license or a stateissued and expiration-dated SouthDakota ID card. Either can beobtained at a state driver’s licenseoffice.DISABILITY LICENSEThe following residents mayapply to the GFP License Office toreceive a 10 Disability Card that isequivalent to the Fishing License andSmall Game License and is valid forfour years:» Persons who are paraplegicsor otherwise permanentlyphysically unable to walk;» Persons blind or visuallyimpaired;» A person who has adevelopmental disability(fishing only), contact theGFP License Office at605.223.7660, or visit gfp.sd.govResident veterans can qualify by oneof four ways:1. If they receive a veteransallotment for a forty percent ormore disability which is deemeda service-connected injury.2. If they have received theDepartment of Veterans Affairs“K” Award.3. If they have served on activeduty in the armed forces of theUnited States or have served asa member of the armed forcesreserve or National Guard, andthe resident is forty percent ormore disabled for the purposesof receiving Social Securitybenefits4. If they were a Prisoner of War.A person must apply on formsprovided by GFP, and provide proofof South Dakota residency withthe application. Information andapplications are available from:GFP License Office; 20641 SD Hwy1806; Ft. Pierre SD 57532; or call605.223.7660.HABITAT STAMPA person eighteen years of age orolder shall purchase a habitat stampwhen applying for or purchasing ahunting or fishing license. The fee forthe habitat stamp shall be 10 forresidents. A person is not required topurchase more than one habitat stampin a license year. Any person requiredto possess a hunting or fishing licensemay not fish and hunt, or trap withoutpurchasing a habitat stamp. Purchaseof the habitat stamp is not requiredfor the 1-Day Resident Small Gamelicense, the 1-Day Resident FishingLicense, any youth hunting license,any landowner hunting license, or anyreduced fee disabled license.ANNUAL FISHING LICENSEAllows residents age 19-64to fish throughout the licensegfp.sd.gov 605.223.7660 11

RESIDENT LICENSINGperiod. Residents age 16-18 arerequired to purchase the JuniorCombination License and residentsage 65 or older must purchasethe Senior Fishing License orSenior Combination License to fishthroughout the license period.COMBINATION LICENSEResidents age 19-64 maypurchase this license which combinesfishing and small game huntingprivileges.JUNIOR COMBINATIONResidents age 16-18 are requiredto purchase the Junior CombinationLicense, which grants the sameprivileges as a combination ofthe Annual Fishing License andSmall Game License. The JuniorCombination License is valid throughthe end of the license period even ifthe licensee turns 19.SENIOR ANNUAL FISHING LICENSEAllows residents age 65 or olderto fish throughout the license period.SENIOR COMBINATION LICENSEResidents age 65 or older maypurchase this license which combinesfishing and small game huntingprivileges.YOUTHResidents under age 16 do notneed a license to fish and can taketheir own limits. For youth whopossess a Youth Small Game Licenseand turn 16 before the end ofthe license period, this license willserve as a fishing license for theremainder of that license period.ONE-DAY FISHING LICENSEThe license begins at 12:01 a.m.and expires at midnight for thespecified date on the license. Licenseholders are allowed one daily limitof fish.LAND OCCUPANTSLand occupants and immediatefamily members (spouse andchildren residing at home or childrenresiding on land owned or leasedby the qualifying land occupant)who are residents of South Dakotado not need a fishing license to fishin waters inundating private landowned or leased by the qualifyingresident. Notwithstanding any otherprovisions of law, a resident is notin violation of any season, daily, orpossession limit established for thespecies of fish in a man-made waterbody on land owned by the residentprovided the resident owns the bedof the water body in its entirety,and the fish taken remain on theresident’s land, unless said body ofwater has been stocked or managedby the Department of Game, Fishand Parks within the past five years.HOOP NET, TRAP AND SETLINELICENSESOnly South Dakota residents witha valid fishing license may purchaseHoop Net ( 10 each), Trap ( 10each) and Setline ( 5 each) licenses.Applications are available online atgfp.sd.gov.12 2021 South Dakota Fishing Handbook

The combined harvest ofall family members covered by thislicense may not exceed one daily limitand one possession limit.TEMPORARY FISHING LICENSESThe 1-Day Fishing License begins at12:01 a.m. and ends at midnight forthe date stated on the license.The license holder is allowed onedaily limit of fish. The 3-Day FishingLicense begins at 12:01 a.m. for thedate stated on the license and ends atmidnight on the third day. The licenseholder is allowed one daily limit offish for each day the license is valid,but may not exceed the possessionlimit as determined by species.HABITAT STAMPA person eighteen years of age orolder shall purchase a habitat stampwhen applying for or purchasing ahunting or fishing license. The fee forthe habitat stamp shall be 25 fornonresidents. A person is not requiredto purchase more than one habitatstamp within a license year. Any personrequired to possess a hunting or fishinglicense may not fish and hunt, or trapwithout a habitat stamp. Purchase ofthe habitat stamp is not required forthe 1-Day Fishing License, any youthlicense, any private shooting preservelicense, or landowner hunting license.NONRESIDENT YOUTHNonresidents under age 16 do notneed a fishing license if one of theirparents or a guardian has a validSouth Dakota fishing license, and theyouth’s fish are included in the dailyand possession limit of the parent orguardian. Nonresident youth underage 16 who wish to take their ownlimit of fish or are not with a licensedparent or guardian must purchasea nonresident youth license. When itcomes to fishing, the department takesthe position that a “guardian” of anonresident youth under the age of16 is any person 18 years of age orolder who is in the immediate physicalpresence of and exercising control ofthe nonresident youth at the timeand place where the fishing activity isgfp.sd.gov 605.223.7660 13

NONRESIDENT LICENSINGtaking place. The youth license is validthrough the end of the license period,even if the licensee turns 16.BORDER WATERSIndividuals fishing on waters that border South Dakota must enter the waterand return to shore from the state in which they are licensed and only fish inthe waters of the state in which they are licensed. Anglers may not exceedthe daily or possession limits established for border waters even if theypossess licenses from both adjoining states.Exceptions are:Minnesota - Anglers licensed inSouth Dakota or Minnesota mayfish the MN/SD border waters.Residents of states other than SouthDakota or Minnesota may fishthe MN/SD border waters if inpossession of a valid nonresidentfishing license issued by either stateor if lawfully authorized to fish byeither state. Anglers must complywith the laws and rules of the statein which they are licensed. Anglersmay launch and/or fish from eithershore and must transport theircatch to the state in which they arelicensed by the most direct route.South Dakota licensed anglerstransporting their fish from theMinnesota side must return to SouthDakota by the most direct route.Nebraska - Any person possessing avalid fishing license or permit issuedby South Dakota or Nebraska,or who is legally exempted fromlicense or permit requirements, mayfish from a boat or the shore withany legal method in the flowingportions of the Missouri River,including backwaters, sloughs, andchutes that connect to the MissouriRiver proper within the boundary ofSouth Dakota adjacent to Nebraska.These anglers may also fish with anylegal method in the South Dakotaportion of any oxbow lake thatcontains a common boundary withNebraska. From Gavins Point Dam to0.6 miles downstream, a nonresidentNebraska fishing permit is requiredfor anyone who is not a resident ofNebraska or South Dakota whenfishing from boat or either bank.Anglers fishing in the South DakotaNebraska border waters shall followthe laws and regulations of thestate in which they are licensed orthe state in which they are fishing,whichever are more restrictive.Iowa - Any licensed angler mayfish from boat or either bank in theSouth Dakota-Iowa border watersof the Big Sioux River if the anglercomplies with the laws of the state inwhich they are licensed or the statein which they are fishing, whicheverare more restrictive.North Dakota - Persons fishing onthe Missouri River near the SouthDakota-North Dakota border linemust conform to all the laws of thestate in which they are located oractively fishing. DINGELL - JOHNSON FUNDING ALLOCATIONThe Dingell-Johnson Sport Fish Restoration Act authorizes the United StatesSecretary of the Interior to cooperate with state fish and game departments,on sport fish restoration projects. States must meet federal standards for theconservation of fish and wildlife, which prohibits the diversion of license feespaid by anglers for any purpose other than the administration of the state’sfish and wildlife department. Funds are collected through excise taxes onfishing equipment, tackle, electric outboard boat motors, sonar devices andmotorboat and small engine fuel taxes. States must provide a 25 percentmatch to requested funds. The Dingell-Johnson funding allocation to SouthDakota in 2020 totaled 4,741,945. STATEWIDE HARVEST AND LENGTH LIMITSWalleye minimum length limitshave been used in South Dakotafisheries management for more than25 years. Minimum length limits aredesigned to protect small fish fromharvest and increase average fishsize.
