A copy of this document should be kept in the unit at alltimes. The governing documents, as amended, are the finalauthority for all interpretations and applications as wellas Florida Statue 718. This handbook is not intended to cover all aspects ofthe governing documents nor all of the rules of theBoard of Directors. It is a handy reference guide to giveall residents a brief overview of Baywood Colony VillaAssociates guidelines.(revised 1/2018)

INTRODUCTIONThe purpose of this handbook is to make life in Baywood ColonyVillas a positive and beneficial experience for everyone. Living in acondominium association is much different from living in a privatehome that is not part of an associationOur Association’s Board of Directors is charged with the fiduciaryresponsibility to manage the affairs of the entire condominiumcommunity in the best interest of all owners.When an owner purchases a unit, the seller is required to providethe new owner with the governing documents of the Association.The documents have three parts: DECLARATION OF CONDOMINIUM ARTICLES OF INCORPORATION BY-LAWS (Including AMENDMENTS TO THE DOCUMENTSDATED 1998 AND 2014)

Architectural Request Form is available from property management and BaywoodColony website.Association Assessments(A)The monthly maintenance assessment provides for operational expenses such asinsurance, reserves, basic cable television service, streetlights, maintenance of common areas suchas walkways, driveways, trees, grassed areas and planted beds in the center of the grounds.Mowing, chemical treatment and mulching are included. Please be sure your assessment is paidpromptly to avoid collection charges.(O)The monthly maintenance assessment is due on or before the 1st of each month and shouldbe remitted to the property management company. For payment arrangements, includingautomated bank drafts, contact property manager.Association Vendor Employees(A)Vendor employees will be directed by the property manager or Board of Directors.(O)Vendor employees may not be sent on errands by an owner/resident or directed by anyoneother than the property manager or Board of Directors. Owners/residents may direct anycomments, requests or suggestions to the property manager.1

Bicycles, Skates and Skateboards(O)Not permitted on the sidewalks and driveways. Bicycles should not be stored in thecarport without prior written Board approval.Billiards Room(O)Children under 15 may only play pool with adult supervision. Additional rules are posted onthe wall of the billiards room.Board of DirectorsThe Board of Directors consists of members elected by the membership and is charged withmanaging BCVA. The Board sets policy and carries on the work of the organization throughappointed committees and with the assistance of a professional management firm. Directors servefor a period of two years. Any member of the Association may run for the Board. Elections areinitiated in the fall with approximately one half of the Directors up for election. The results areannounced at the annual meeting of the Association held in November. After the Board ofDirectors is elected, the Board then elects its officers: President, Vice-President, Secretary andTreasurer. The President and Vice-President must be Directors but the other officers need not be.Business(O)Each condominium unit shall be used exclusively as a single family residential dwelling andno business or trade is permitted.Cable Television(A)BCVA provides basic cable television.(O)Any additional services are at owner’s expense.Carports(O)Carports are for the use of passenger type automobiles. Pickup trucks, motorcycles, movingvans, boats, trailers, commercial and recreational vehicles and other heavy trucks are prohibitedfrom the carports. Shared circular driveways should remain open so that all vehicles may enter andexit easily. No furniture, bicycles or any items may be stored in carports or outside of units withoutprior written Board approval.Car Washing(O)Car washing should be limited as everyone shares equally in the cost of water.Circuit Breaker Boxes(O)Unit owner’s responsibility. Periodic checks are recommended.2

Clotheslines and Dryer Racks(O)Prohibited in lanais, common areas and carports. Materials must not be hung from doors,windows, fences or roofs.ClubhouseThe clubhouse is located at 5895 Tidewood Avenue on the corner of Tidewood and SherwoodAvenues. The phone number is 941-922-8830. Only local calls are permitted on this phone.(A)Maintenance and repair including the area around the pool. Wi-Fi is available. User nameand password are available on the bulletin board in the clubhouse.(O)Owners are provided with a key or FOB that opens all entry locks in the clubhouse exceptfor one deadbolt lock on the southwest corner of Sherwood. Please be sure to lock all doors whenyou leave.The clubhouse has a general hall, pool, saunas, billiard room, card room, library and women’s andmen’s locker rooms. Provided there is no scheduled event in the Clubhouse, the billiard table andcard tables are available on a first come basis.To reserve the clubhouse for personal event, members need to submit in advance the ClubhouseRequest Form to property management. Clubhouse Use Request Form is available from propertymanagement and Baywood Colony website. The pool may not be reserved for private use.Cleanup is the responsibility of the users. If proper cleanup is not done, owner will be charged aclean-up fee.Cooking is not permitted in the Clubhouse except for permitted events. Furniture, utensils andother equipment should not be removed from the clubhouse.If thermostats are adjusted, they should be returned to original setting.CommitteesExisting committees are Finance, Architectural, Documents, Grounds, Membership/Hospitality,Compliance, Operations, and Clubhouse. A current list of officers and the membership of eachcommittee can be found on the bulletin board in the clubhouse.Each year the Board President appoints committee chairpersons and members who serve for aperiod of one year. While BCVA does have professional management, our committees contribute agreat deal towards the operation of BCVA and help keep our monthly maintenance assessmentlower than it would be otherwise. If you would like to serve on a committee or help out in someway, please contact a member of the Board.Common Elements(O)Owners are liable for any and all damages, including damage caused by their tenants andguests, to the common elements.3

Community Information(A)Throughout the course of the year a variety of social events are held at the Clubhouse.Notice of these events is posted on the bulletin board and on the entry doors at the Clubhouse.Calendars and other notices are also hand delivered by our Social Committee.Contact Information(O)It is imperative that the management company or the Board be able to contact owners orgain admittance to a unit in the event of an emergency. Owner must supply the managementcompany with local emergency access information. In case of emergency the owner is responsiblefor any locksmith fees or damages incurred while obtaining access to the residence whenemergency information has not been provided. If emergency entry is necessary, it will be made byat least (2) two people.Courtyards(O)Owners in adjoining courtyards should be considerate of their neighbors.Decorative Ornaments(O)Prior written Board approval is necessary before displaying decorative ornaments incommon areas.DirectoryA resident directory is available upon request. Names, emails and phone numbers will be includedwhen a written waiver is submitted to the property manager.DocumentsThe BCVA documents consist of three parts:1. The Declaration of the Condominium.2. The Articles of Incorporation.3. By-Laws (Restated).Amendments are included in a complete set of the documents.(O)All applicable documents pertaining to BCVA should have been provided by the seller priorto closing. Additional copies are available from the property management and Sarasota CountyClerk’s office at an additional cost.Doors – Interior(O)All maintenance and replacement.Doors – Exterior(A)Scheduled painting of unaltered unit entry and laundry room doors (exterior side only).(O)Maintenance and repair are the responsibility of the owner. Owners are advised that doorand door color changes require prior written Board approval. Architectural Request Form isavailable from property management and Baywood Colony website.4

Doors – Screen(A)Scheduled painting of original screen door only.(O)Owners are advised that changes in screen doors require prior written Board approval.Architectural Request Form is available from the property management and Baywood Colonywebsite.Driveways(A)Maintenance, repair and replacement.(O)Parking must not impede neighbor’s access.Electric(O)All electric installations on the unit side of the meter (but not the meter itself) including allcircuit breakers, wiring, fixtures and equipment whether within or external to the unit. Also all airconditioning and heating equipment within or external to the unit.Emergencies(O)Fire, Police or medical emergency dial 911. Sarasota County Sheriff’s office contact is941-316-1201 for non-emergencies.For emergency water leaks immediately call a plumber. The responsibility for payment will bedecided upon when the cause and location have been determined. In order to reduce thepossibility of a disagreement regarding responsibility, we recommend using one of our preferredplumbers Cy Blue (Kenny) 941-504-4521 and Daniel’s Plumbing 941-926-7272). For non-emergencyplumbing matters please consult with property management or a member of the Board todetermine responsibility prior to engaging a plumber.To report problems with the grounds, rule infractions, needed repair to the common areas, etc.,please call the property manager. General Maintenance Request Form is available from theproperty manager and Baywood Colony website. You may contact a board member.Extended Absence(O)Take appropriate measures to avoid mold which can easily travel from one unit to another.Turn off water shut off valve. Prepare unit to prevent storm damage. All movable items should bestored securely inside of unit. Ideally, toilets should be flushed twice monthly to keep drains open.Exterior Changes(O)Exterior changes of BCV’s are prohibited without prior written Board approval. Anyproposed changes must first be presented to the Architectural committee. This includes but is notlimited to lanai enclosures, roofs, gutters, pavers, exterior lighting, wall plaques and storm shutters.Architectural Request Form available from property management and Baywood Colony website.5

Family(O)Family is defined as parents, children, grandchildren or siblings of the owner or spouse.When the owner is not present, all other relatives or occupants are considered guests or tenantsand are deemed to be a lease. Family Guest Notification Form must be submitted to propertymanagement. Family Guest Notification Form available from property management or BaywoodColony website.Fences(A)BCVA is responsible for the maintenance, repair and replacement of the 1st two sections ofthe privacy fence between units as well as the fencing located in the carport area.(O)Responsible for the maintenance, repair and replacement of the privacy fence beyond thest1 two sections. All fence or gate installations or changes require prior written Board approval. Allfence requests must be submitted to the Architecture Committee. “Shadow box” style is required.Any installation without prior written Board approval is subject to removal at owner’s expense.Architecture Request Form is available from property management and Baywood Colony website.Forms(O)Owner is responsible for submission of all required forms prior to any request. Owner issubject to penalties without prior written approval from the board or committee chairs. All formsare available from property management or Baywood Colony website.Guests(O)Guests may stay up to 30 days when the owner is in occupancy. Beyond 30 days, a “Guest”is considered a permanent occupant and subject to associations lease application process. Guestsare expected to follow the rules of the Association. Owners are responsible for any violations,damage or destruction, including damage caused by their tenants or guests, to the common areas,lawns or any other common interests.Gutters and Downspouts(O)Cleaning, maintenance, repair and replacement is the responsibility of the owner.Installation or replacement requires prior written Board approval. Architectural Request Form isavailable from property management and Baywood Colony website.Hazardous Materials(O)No flammable, combustible fluids, chemicals or substances may be kept in any unit orstorage area, except as may be required for household use. Oxygen must be stored in a safemanner according to federal guidelines.Holiday Decorations(O)The Board recommends reasonable holiday decorations should be removed no more thantwo weeks following a holiday.6

Insurance(A)The Association carries flood/hurricane and risk insurance on every villa and carport. Thereare deductibles. Additional details are available from Atlas Insurance Company at 941-366-8424.(O)Any insurance for the interior of the unit. An HO6 policy is required. Owners are advised toconsult their insurance broker or Atlas Insurance Company as to any additional coverage needed.Interior Changes(O)Interior structural changes, such as removing a kitchen wall to open the space, must not bemade without prior written Board approval. Architectural Request Form available from propertymanagement and Baywood Colony website.Internet Access(A)Provided in the clubhouse. User name and password can be found on the bulletin board inthe clubhouse.(O)Internet service within a unit.Lanais and Porches(A)Unmodified lanais only, maintenance, repairs and painting of the exterior coatings andstucco. Exceptions are noted in the documents(O)All other maintenance and repair. No change to a lanai structure may be made withoutprior written approval of the Board. Lanai window coverings and film should be kept in goodrepair. Architectural Request Form available from property management and Baywood Colonywebsite.Landscaping(A)All landscaping maintenance required on common grounds.(O)Although common ground, owner is responsible for all landscaping within 3’ of the unit.Plants and shrubs must be kept neat and properly maintained, even when an owner or tenants arenot on site. Plants must not be higher than the lower portion of the sloping roof and overhangs.Plants should be set approximately 12” or more from the villa to facilitate painting and othermaintenance. Only hand watering is allowed. No plantings may be added without prior writtenBoard approval. All plantings on the common ground become the property of the Association andbecome subject to Association guidelines. See Addendum A Guidelines and Unit OwnerResponsibility for All Plantings, page 17 for complete guidelines.Laundry Room(A)Exterior stucco and paint(O)All other maintenance and repair7

Lawn waste(O)Items such as weeds, trimmings and clippings are “mulch items”. They can be tied inbundles or placed in lawn trash bags and placed near your regular trash for pickup on Wednesday.Alternately, our lawn contractors will take such items as they “clean up” after the regularscheduled service.Leasing of Units(O)You may lease your unit subject to the approval of the lessee by the Board. There is aprocessing fee of 50.00. No tenant may occupy a unit until receiving prior written Boardapproval following submission of a complete application, a copy of the lease, all fees and aninterview. Returning seasonal renters must resubmit an application, copy of new lease and fees.In no event will a unit be approved for a lease of less than 30 days nor more than once in a 12month period. Failure to submit a properly completed application prior to occupancy will resultin a 250 late processing fee.Owners with annual leases must submit a lease application annually as the lease is renewed. Acopy of the lease must accompany any renewal. Fees will be waived for an ongoing renewal.Our documents provide that extended family use may count as a lease. In this instance a formparticular to family must be submitted to the property management prior to guest’s arrival. Pleasenote, “ occupancy of a unit by a person or persons in the absence of the owner, except forparents, children, grandchildren or siblings of the owner or spouse, shall be deemed a lease andmust be approved by the Association.” The Association must be notified when an immediate familymember will be occupying the unit in the absence of the owner/tenant. If a unit is leased, theowner transfers their rights to use of the facilities to the lessee for the duration of the lease. TheApproval for Lease is available from property management or Baywood Colony website.Library(O)The library is for the use of all residents. We ask that you abide by the rules for borrowingand returning books as posted near the desk in the library. Book donations are welcome. Pleaseleave them on the desk.Lighting(O)All electric lighting installations within or external to the unit. External fixtures should keepthe black wrought iron scrolling.8

Locks and Keys(A)Keys or FOB for the clubhouse and pool will be provided to owners.(O)Responsible for repair and replacement of hardware for their doors. Unit owners mustprovide local emergency access information to the property manager. In case of emergency theowner is responsible for any locksmith fees or damages incurred while obtaining access to theresidence when emergency information has not been provided. If emergency entry is necessary, itwill be made by at least (2) two people.Mailboxes(O)Changes require prior written Board approval. Architectural Request Form available fromproperty management and Baywood Colony website.Meetings(A)Regular meetings of the Board are held on the third Wednesday of each month at 3 PM inthe Clubhouse except during the summer or as otherwise published at least 48 hours in advance.Agendas for the meetings are posted on the Clubhouse bulletin board.The annual meeting of the Association is normally held in the Clubhouse the 3rd Wednesday inNovember. Notice of the meeting is mailed to all owners and a copy is posted on the bulletinboard.Minutes of each Board meeting are posted on the Clubhouse bulletin board.(O)All meetings are open to members of the Association.Motorcycles(O)Prohibited on BCV’s property.Moving Vans(O)Moving vans and other similar large vehicles are prohibited from the carports. Movingvans are permitted on BWC property during active loading and unloading.Newsletter(A)The “Baywood Bits” is published and distributed periodically. Copies can be sent to nonresident owners if requested. Please call the property manager to make arrangements.Noise(O)No unit owner should permit any loud disturbing noises in the residence or on the commonareas by themselves, tenants, family, contractors, agents, guests or pets. No conduct is permittedthat will interfere with the rights, comforts or conveniences of another unit owner/resident.9

Apermanent resident is defined as someone in occupancy for more than 31 days.Overhangs(A) Clean and paint the outer surfaces of the coverings on overhangs and sloping roofs.(O) Maintenance, repair, and replacement of overhangs, sloping roofs and roofing surfacesOwner/Tenant Absence(O)For security purposes, notification of BCVA is required when an immediate family memberwill be occupying the unit in the absence of the owner/tenant (See “Family”). Family GuestNotification Form provided by property management and Baywood Colony website.Painting(A)Exterior of the units, laundry rooms and carport pillars and arches.(O)Interior of units and laundry rooms.Parking(O)Conventional passenger automobiles with current license tags may be parked in anyparking area. Boats, trailers, motorcycles, pickup trucks, commercial and recreational vehicles,campers and motor homes are prohibited from parking in any area. Boats, trailers, trucks,commercial and recreational vehicles may be temporarily parked in parking area when activelyloading and unloading, but not for more than 24 hours. (see page 16-17, #14 of By-Laws forcomplete description of Parking)No parking is permitted on the lawns or common grounds at any time other than service vehiclesand then only if necessary to service unit within the complex.No vehicle which cannot operate on its own power shall remain within the condominium propertyfor more than 24 hours and no repair of vehicles shall be made within Baywood property.Pest Control(A)Common areas(O)All unit pest control treatments.10

Pets(O)One dog and/or one cat is permitted per unit. No pet shall weigh in excess of 25 pounds. Alldogs and cats shall be promptly registered with the Board and shall be otherwise registered andinoculated as per law. Unaccompanied pets are not permitted on the common areas. Owners areresponsible for picking up any and all excrement in a timely manner. Sarasota County requires allpets to be leashed. Any pet causing, creating, or contributing to a nuisance, unreasonabledisturbance, annoyance or noise shall be permanently removed from the Condominium upon 10days written notice from the Board. Animal Registration Form available from propertymanagement or Baywood Colony website.Plumbing(A)All water lines up to and including the exterior shut-off valve.(O)All water lines and fixtures on the unit side of the exterior shut-off valve. Due to shared andaging drains, you must contact a Board member or the property manager when calling a plumberfor a blockage. In an emergency, we recommend calling one of our preferred vendors, Cy Blu(Kenny, 941-504-4521) and Daniel’s Plumbing (941-926-7272). Detailed description of work donemust accompany all bills submitted for reimbursement.Pickup Trucks(O)Prohibited on BCV’s property.Problems(O)To report problems with the grounds, rule infractions, needed repair to the common areas,etc., please call the property manager or Board member. Recycling(O)Trash and Recycling is picked up on Wednesday. If you put your trash out the night before,please be sure to use tightly secured lids to avoid any mess caused by animals. For currenttrash/recycling information, call 941-378-6060.Blue Bin – Plastic, aluminum foil and cans.Red Bin – Cardboard, paper and newspapers.Items such as weeds, trimmings and clippings are “mulch items”. They can be tied in bundles orplaced in lawn trash bags and placed near your regular trash. Alternately, our lawn contractors willtake such items as they “clean up” after the regular scheduled service.Repairs(O)Repairs to the exterior of units and interior structural repairs require prior written Boardapproval. Architectural Request Form and General Maintenance Request Form are available fromproperty management and Baywood Colony website.Roofs(O)Roof maintenance, repair and replacement are the responsibility of the individual unitowner. Roof replacement requires notification to the Board or property manager, using a licensedcontractor, securing a building permit and meeting all building and insurance codes.Sale of Unit(A)Within thirty (30) days after receipt of notice and holding of a personal interview, theAssociation must either approve or disapprove the proposed transaction. BCVA has one hundredand twenty (120) days to void a sale closed without proper notification from the seller.(O)Notice of Intent to Sell Form must be submitted to property manager prior to listing of theproperty.Application for Approval of Sale Form must be submitted to property manager a minimum oftwenty (20) days prior to schedule closing. Prospective buyers must be interviewed and Boardapproved for purchase prior to closing. Intent to Sell Form and Approval of Sale Form is availablefrom property management and Baywood Colony website.Satellite Dishes(O)No TV antennas or satellite dishes permitted without prior written Board approval.Saunas(O)Carefully read the operating instructions mounted on the sauna door before use. The saunais not a steam bath. Please splash water on the rocks sparingly. Too much water will damage theunit. Children under 15 are not permitted in the sauna.12

Shutters(A)Ornamental shutters are maintained and painted by the Association.(O)Hurricane shutters are the responsibility of the unit owner. Installation must meet allFederal and State guidelines and requires prior written Board approval. Architectural RequestForm available from property management and Baywood Colony website.Sewers and Drains(A)Mainline drain up to and including the sewer clean-out. With shared drains Associationresponsibility differs. See documents for further clarification.(O)All sewer lines on the unit side of the sewer clean-out. All unoccupied units should beinspected periodically and toilets flushed regularly to keep drains open.Signs(O)Signs are not permitted on BCV’s property.Sloping Roof(A) Clean and paint the outer surfaces of the coverings on overhangs and sloping roofs.(O) Maintenance, repair, and replacement of overhangs, sloping roofs and roofing surfacesSocial Activities(A)The Social Committee provides a wide and varied calendar of activities. Informationregarding events and ongoing activities are posted on the Clubhouse bulletin board and deliveredto units.(O)Owners/residents are welcome to join in on all activities.Solicitations(O)Solicitations of any kind are not permitted in BCV’s.Specific owner responsibilities(O)Utility room, porches, stoops or entrance way and its deck, projections such as windowsills, with the exception of exterior surfaces of stucco and paint.Exterior doors (except for painting of outer surface), windows, screens, plastic or glass surfaces,lanai enclosures and hurricane shutters.The roof and roof surface, gravel stops, overhangs, sloping roofs, eaves, gutters, and downspoutswith the exception of the outer surface of coverings on overhangs and sloping roofs.The carport including roof, roof supports, eaves, gutters, downspouts, masonry supports andconcrete deck.13
