GENERAL SERVICES COMMITTEE MEETINGFebruary 19, 2019Present: Legislators Jerry King, Tom Osborne, Randy LaChausse and Andrea Moroughan.Also Chairman Larry Dolhof, Greg Kulzer, Richard Chartrand and John Lehman.Others Present: County Manager Ryan Piche, Co. Atty. Joan McNichol, HR Director ChrisBoulio, Department Heads Mary Jo Burkhard, Ward Dailey, Jenny Jones, Jackie Mahoney, PeteWood, Warren Shaw, Frank Pace, Eric Virkler, Matt O’Connor, Dispatch Supervisor CherylLaLonde, Jail Lt. Tim Thayer and reporters Nick Altmire and Julie AbbassCommittee Chairman Jerry King called the meeting at 2:08 p.m.Ward Dailey read his attached report. The County provides code enforcement for 20 of the 25 Towns andVillages within the County. Some of the municipalities have property maintenance codes that are morerestrictive than the State’s code. Ward stated that the State Uniform Code Enforcement includes propertymaintenance.An Inter-municipal Agreement (IMA) is proposed for the Village of Constableville for code enforcement.Their local law for property maintenance prohibits residential grass over 2 feet tall. By comparison theVillage of Copenhagen local law prohibits grass over 3 feet tall and includes many other restrictions, butthere is currently no enforcement.County Atty. Joan McNichol impressed the difficulty for staff to learn various distinctive codes forrespective municipalities, and Ward Dailey concurred. Chairman Dolhof recommends the Board requireadoption of the State Uniform Code as a prerequisite for the County to assume code enforcement forTowns or Villages.Municipalities located within a flood zone are mandated to adopt a Flood Damage Prevention law to beeligible for Federal funds in the event of a flood event.Ward explained that pursuant to State Law every municipality within New York is subject to the UniformFire Prevention and Building Code. However, municipalities may discretionally adopt local laws that aremore restrictive than the State’s code.IMA’s are proposed for the Villages of Constableville and Lyons Falls and the Town of Croghan for codeenforcement, as well as respective local zoning laws.Ryan Piche reminded that today’s preliminary discussion and consideration to set policy was to preparefor potential requests from local municipalities to have the County enforce their various local laws.There is no mandate for zoning laws, nor is there uniform law, but several municipalities have adoptedzoning laws unique to their locale.Ryan Piche informed that Lewis County is unique from other Counties where Towns and Villages enforceall of their own laws. To-date, all except five Towns have opted for Lewis County Code enforcement.Those five Towns administer local enforcement, while their taxpayers also contribute toward CountyEnforcement.In response to Legislator King, Ward will provide Ryan a copy of the 62-page NYS PropertyMaintenance Codes for distribution to the Committee.

GENERAL SERVICES COMMITTEE MEETINGFebruary 19, 2019Frank Pace, Planning Director reported garnering State grant funds with a required 40,000In-Kind services match, for updating the 2004 Agriculture Enhancement Plan.The County received approval notification of a 718,200 CDBG Housing RehabilitationProgram Grant that would be administered by Snow Belt Housing. Auditors of the last grantprogram expressed high regard and were very pleased with Snow Belt Housing’s administration.The County has finally received the 217,640 NYSDOT grant to purchase two buses and twobust stop shelters for the Transportation Bus System. One shelter will be placed at DSS and oneat the Hospital.A NYSEG representative will present an update to the Board of Legislators on 4/2/19 about thestatus of the natural gas franchise application process. After the County completes the currentState Environmental Quality Review Assessment (SEQRA) for the Highway garage and LewisJCC Education Center, anyone within the entire County will be eligible for natural gas withouthaving to complete a SEQRA. However, NYSEG will conduct and consider a cost benefitanalysis for each project application. Legislator Chartrand asked Frank to request the NYSEGrepresentative to speak to the Ross property application during his 4/2/19 presentation.Warren Shaw, Highway Superintendent, presented a survey map provided by Tom Kovach of theHighway Department location at the intersection of State Route 812 and the East Road. There isplenty of room for the new pumps. Mr. Kovach will continue his survey and add layers to themap to indicate sewage and utility lines. The cost for 2 dispenser pump replacements is 18,630, estimating a total project cost of 228,000. Warren relayed that a request forqualifications for engineering services has been issued, which are due by 2/28/19.The low bid for leasing a plow truck is 242,074.29 for a Mack Granite Truck with Viking plow.A 5-year annual lease with Key Bank financing is 52,439.74 with a 4.61% interest rate.Legislator Osborne made a motion to authorize Warren to order the truck, seconded byLegislator LaChausse and carried.Warren informed the State has approved rehabilitation of the Whetstone Gulf bridge and that hewill have the bridge engineered in preparation for that project.

GENERAL SERVICES COMMITTEE MEETINGFebruary 19, 2019Pete Wood, Solid Waste Director reviewed his prepared recycling report. Clear bags and singlestream recycling were implemented in 2016. Curbside recyclable collections substantiallyincreased. A box for textile items (reusable clothing) was implemented in 2018 with weeklypickup at the transfer station. Over 1,100 mattresses were collected from customers at a fee of 7.75 each and recycled to lessen landfill volumes. DANC finances the trucking costs torecycling destination. Jefferson and St. Lawrence are now considering implementing themattress collections.In spite of increased recycling volumes from 1,500 Tons in 2015 to 2,350 Tons in 2018, trashvolumes also continue to increase. Recycling revenues have declined, but DANC’s financialsupplements to our program of 5/Ton will increase to 15/Ton, because they want the recyclingprogram to succeed and continue to grow. Currently solid waste (trash) revenues are offsettingLewis County recycling deficits.The Solid Waste Enterprise Fund Balance has declined from 992,529 in 2015 to 814,100 at theclose of 2018. Pete proposed the rate increase imposed effective 7/1/2018 will continue tobolster the fund balance.The following dockets were reviewed and approved:Dockets:1. Resolution for budget appropriation in the Sheriff’s Department for Vehicle Repairs andLaw Enforcement items funds received though Sheriff Federal Money (T0 000874) in theamount of 195.65.2. Resolution for appropriation into the E911 accounts for additional PSAP grant funds inthe amount of 53,835.3. Resolution authorizing agreement with Aviat for the AviatCare Maintenance and SupportServices which includes access to Aviat Networks customer online technical support site,repair services and remote technical support described more fully in the AviatCareMaintenance and Support Services Agreement in an amount not to exceed 1,620.00 fora term of 2/1/2019 through 1/31/2020.4. Resolution authorizing agreement between the Sheriff’s Department and E.F. Johnson fora remote maintenance of the E911 radio system for the term of 2/1/2019 to 1/31/2020 inthe amount of 30,108.5. Resolution authorizing Memorandum of Understanding between the Lewis CountySheriff and the Lewis County General Hospital to provide for reimbursement to theHospital through the Sheriff’s Department for the costs of furnishing Jail Physicianmedical services, and to set forth the position duties and responsibilities and reportingrequirements of the LCGH’s medical staff providing such medical services as JailPhysician, together with such other relevant provisions to give effect to same. Term isone year with annual renewable options, and shall commence effective March 1, 2019and continue through February 28, 2020, with the LCGH to be compensated at a flatannual payment of 35,172.00, payable in monthly installments of 2,931.00 uponreceipt of monthly invoices from the LCGH, which shall include detail of time anddescription of services provided.

6. Resolution authorizing contract amendment with MICC-Fort Drum to modify thePerformance Work Statement (PWS) to reflect changes mandated by NYS for secureconfinement of pre-trial and post-trial soldiers. All other terms and conditions remain ineffect.7. Resolution for appropriation in the Office of the District Attorney of funds receivedthrough DA Proceeds from Arrest (T0 000871) to reimburse for 2019 DA WinterConference for Leanne Moser and Cindy Intschert in the amount of 783.51.8. Resolution to appropriate funds received through DA Federal Money (T0 000873) toreimburse for the District Attorney’s Winter Conference expense in the amount of 700.9. Resolution authorizing Mutual Aid Agreement between U.S. Army Garrison, Fort Drum,New York and Lewis County Office of Fire & Emergency Management Department tosecure for each the benefits of mutual aid in fire protection and hazardous materials. Tosecure for each the benefits of mutual aid in fire protection, the protection of life andproperty from fire, and firefighting to include emergency services, basic medical support,basic and advanced life support, hazardous material containment and confinement, andspecial rescue events involving vehicular and water mishaps and trench, building, andconfined space extrications for the term of 1/1/2019 through 12/31/2022.10. Resolution to authorize an Inter-municipal agreement between the County of Lewis andthe Village of Constableville for he Lewis County Codes Department to be designated asthe Village’s Enforcement Officer under its local law, to enforce the Villages Local LawNo. 2-2018 that establishes guidelines and standards for property maintenance and toregulate junk material storage in the Village of Constableville, New York for a term of1/1/2019 and shall expire on 12/31/2019 and shall automatically renew for additional oneyear terms unless either party notifies the other in writing of their intent to terminate theagreement.11. Resolution authorizing inter-municipal agreement with Town of Croghan to administerand enforce the Town Local Law No. 1 of the year 1985. This Local Law is Federallymandated for Flood Damage Prevention; Resolution authorizing inter-municipalagreement with Town of Croghan to administer and enforce the Town Local Law No. 1of the year 2006. This Local Law provides for Site Plan Review and Approval of all newcommercial and industrial uses, Manufactures home parks, Campgrounds and selecthome occupations; Resolution authorizing inter-municipal agreement with Town ofCroghan to administer and enforce the Towns Local Law No. 1 of the year 1986. ThisLocal Law provides for regulation and control of Manufactured Homes, Travel Trailers(R.V.) and the developments of sites for Manufactured Home and Travel Trailers.12. Local Law Introductory No. 1-2019 To Amend Local Law No. 2 of the Year 2007 alsoknown as the Unsafe Structures Law and Resolution to set Public Hearing on Intro LawNo. 1-2019 for March 5, 2019.13. Resolution authorizing agreements by and between the Lewis County HighwayDepartment, Lewis County Solid Waste Department, Lewis County Recreation, Forestry& Parks Department, and Building & Grounds Department with Lewis County GeneralHospital Occupational Medicine for the purpose of random employee drug and alcoholtesting for the term of 1/1/2019 and ending 12/31/2019 in the amount of 100.00 peremployee. Additional fees will apply for the “post-accident”; “reasonable suspicion”;and “follow-up drug and alcohol testing as well as onsite testing” as follows: DOT Drug

Screen - 71.00; Breath Alcohol Test - 22.00; Breath Alcohol Confirmation Test 22.00; and Onsite Testing - 40.00.14. Resolution to appropriate Capital Equipment funds into the Highway Departmentaccounts for the 2017 International 7600/Viking Plow annual lease payment in theamount of 47,979.46.15. Resolution authorizing agreement with Barnes Corners Sno-Pals Snowmobile Club toauthorize opening and/or confirm the opening of several County Roads for a one-dayATV event on April 20, 2019 and possible opening of several other roads, contingentupon weather conditions and snow levels, as determined by the Director of Recreation,Forestry & Parks in consultation with the Lewis County Superintendent of Highways, intheir discretion.16. Resolution to appropriate Mass Transportation Project Grant for the purchase of one newbus, a wheelchair accessible van and two (2) bus stop shelters in the amount of 217,640.17. Resolution authorizing agreement between the County of Lewis through PlanningDepartment and Brasco International, Inc. for the purchase of two (2) hip roof bus stopshelters for the transportation bus system in the amount of 19,350.18. Resolution to approve Grant Agreement between the County of Lewis and the New YorkState Housing Trust Fund Corporation, pursuant to which the County of Lewis shallreceive 718,200.00 in Community Development Block Grant funds to address housingneeds. To further authorize and approve Snowbelt Housing Company, Inc. to service asadministrator of these grant funds and hereby names Snowbelt as the County’s subrecipient of the Grant.19. Resolution acknowledging the Board’s affirmative commitment to fulfill up to 40,000.00 of eligible in-kind services from various Lewis County Departments andother local agencies in order to meet the State’s grant requirements under the County’sapplication to update its Agricultural Enhancement Plan for agriculture and farmlandprotection. The County is responsible for the 50% match, which would require aminimum of 10,000 cash match. The Planning Department will fulfill the cash matchrequirement utilizing 2018 and 2019 Community Development funds, and the remaining 40,000 will be fulfilled by in-kind services through various departments.20. Resolution authorizing Sub-Recipient Agreement with Lewis County IDA to administerCDBG Small Business Micro-Enterprise Revolving Loan Fund in the amount of 200,000.21. Resolution to contract with Alltech Integrations for monitoring the fire alarm system atthe Lewis-JCC Education Center from 2/1/2019 through 1/31/2020 in the amount of 479.40 ( 39.95/month).22. Resolution for budget transfer in the Buildings & grounds Account to reallocate funds forthe Trane contract payment in the amount of 10,000.0023. Resolution authorizing agreement between the County of Lewis and the LowvilleVolunteer Fire Department for the purpose of providing annual training for county staffand county buildings which will include semi-annual inspection of all fire systems,access points, and system entry maps to verify conditions and revise and/or update asnecessary; conduct active training exercises for various scenarios involving possibleemergencies; appoint a member to the safety committee and meet quarterly; andparticipate in annual meetings to review and update the Training and ServicesAgreement, in an amount of 2,000.00 for the term of 1/1/2019 through 12/31/2019.

The Committee also recommended the following actions be posed to the Board for approval:Legislator Osborne made a motion to authorize Sheriff Carpinelli to refill one (1) Part-timeCorrection Officer effective immediately, seconded by Legislator LaChausse and carried.Legislator Osborne made a motion to award bids for sand, gravel, crushed stone and concretebased on project location in accordance with the tabulation of all bids prepared by the HighwaySuperintendent and placed on file with the Clerk of the Board, for the period 4/1/2019 to3/31/2020. The motion was seconded by Legislator Moroughan and carried.Legislator King made a motion to authorize Highway Superintendent Warren Shaw to fill ten(10) Full-time temporary seasonal workers in either Grade 4 or Grade 15, pursuant to CivilService rules and regulations, effective April 1, 2019, seconded by Legislator Moroughan andcarried.Legislator LaChausse made a motion to authorize Recreation, Forestry and Parks Director JackieMahoney to hire temporary seasonal trail workers; one (1) crew leader, two (2) crew workers(Trails), one (1) laborer (Careers Here additional pay), and one (1) laborer (Reforestation),effective 3/1/19 or thereafter as she determines appropriate. The motion was seconded byLegislator Osborne and carried.Legislator Moroughan made a motion to authorize Planning Director Frank Pace to advertise aRequest for Proposals (“RFP”) for the Central Water Study effective immediately, seconded byLegislator Osborne and carried.In response to Legislator LaChausse, Eric Virkler stated that the PILOT policy for taxapportionment and terms for a solar project has been negotiated with the developer and has beenproposed to the Industrial Development Agency Board of Directors for approval.Legislator LaChausse reported that the Croghan solar project site has been approved, but theTown Board does not want to move forward until knowledgeable of the PILOT terms andamount. Mr. Virkler said that he would follow up with Croghan officials.In response to Legislator John Lehman, Eric Virkler stated awareness of minor environmentalissues at the Harrisville property involving some barrels of oil and has been in contact with theproperty owner who must take responsibility, but has not yet done so.Ryan Piche posed a work session with the full Board of Legislators to discuss the Bernier & CarrAssociates’ overall facility report and make determinations about future plans. Those presentdecided to meet on Wednesday, February 27, 2019 at 5 p.m. in the second floor conferenceroom.Legislator King made a motion to adjourn at 3:40 p.m., seconded by Legislator Osborne andcarried.Respectfully submitted,Terry Clark, Clerk of the Board
