CHANGES TO THE STATUTES & REGULATIONS FROM 2008 - 2016The official language for the statutes and regulations can befound on the Legislative Research Commission’s website atwww.lrc.ky.gov. Below is a summary of the changes since 2008.emergency power to address alleged escrow violations and canorder emergency hearings.KRS 324.141 Reciprocal licensing between states; Consentto service of process by nonresident applicantREGULATIONS EFFECTIVE ON 03/07/2008201 KAR 11:170 Private school and course approvalThis change clarified the Commission will no longer enter intoreciprocal agreements with other states for out-of-state licenseesto obtain a Kentucky license. NOTE: Although the heading ofthis statute still says “Reciprocal,” there are no longer anyreciprocal agreements. The Commission now utilizes licenserecognition. The out-of-state licensee’s foreign license will berecognized and the out-of-state licensee must complete theapplication forms, pass the state law portion of the real estateexam and fulfill a few other requirements. A more detailedexplanation can be found under the heading “RegulationsEffective on 12/4/09,” which explains 201 KAR 11:215.This regulation was amended to require all pre-license coursesto include a closed-book monitored final examination. Studentsmust obtain at least a 75% in order to pass the exam and onlyone retake is permitted (2 retakes are now allowed). Studentsmust also now complete, with a passing score, a project that isapplicable to the course content. The regulation also changesthe pre-license approval period to a two-year cycle and outlinesthe requirements for submitting materials to the Commission.201 KAR 11:210 Licensing, education & testing requirementsThis regulation now sets forth the requirements for educationdocuments submitted in a language other than English andprovides for an evaluation process for education completedoutside the United States to ensure candidates have fulfilled thehigh school/GED requirements outlined in KRS 324.040(3).KRS 324.160 Sanctions – Grounds for sanctionsThe language in this statute (subsection m) regardinginducements and rebates, which became unenforceable in 2005due to an agreement between the U.S. Department of Justice andthe Kentucky Real Estate Commission, has been removed.Although the language had been in the statutes, it has not beenenforced by the Commission since 2005.201 KAR 11:230 Continuing education requirementsThe regulation sets the penalty for non-compliance to 500.00and the previous final delinquency plan opportunity was deleted.The revision also clarified course/instructor approval processes.KRS 324.2812 Limitation of commission’s jurisdictionThis new law clarifies that the Commission does not regulatenor have jurisdiction over community management associations.201 KAR 11:240 Distance education requirementsThis is a new regulation that sets standards for all online prelicense and continuing education courses. All courses must becertified by ARELLO or IDECC for format and delivery and theKREC will review the content. The regulation outlines therequirements for instructors, course layout, and the providersubmission and reporting responsibilities. All such coursesrequire a final examination that the individual must pass.KRS 324.310 Delivery of sales associate’s license tocommission when association terminated; Placing license inescrow with commission; andKRS 324.312 Commission’s right for return of associate’slicense; Sanction for failure to returnChanges to these two statutes require principal brokers to returnlicenses to the Commission within five (5) days, when theprincipal broker receives a request from a licensee to end his orher affiliation agreement. If a principal broker does not returnthe license within five (5) days, he or she will be in violation ofKRS 324.160(4)(u). If the principal broker is out of town, anoffice representative can stamp the principal broker’s name onthe back of the license. If the principal broker cannot find thelicense, he or she can send a letter to the Commission.201 KAR 11:450 Broker management courseThis regulation was amended to clarify the course submissionprocess and to increase the number of questions on the finalexamination from 50 to 75 in accordance with 201 KAR 11:170.STATUTE EFFECTIVE ON 07/15/2008KRS 324.235 – KRS 324.238 Commercial LawThese new statutes became effective on July 15, 2008 andgovern how out-of-state licensees can practice commercial realestate brokerage in the state of Kentucky.REGULATION EFFECTIVE ON 10/02/09201 KAR 11:230 Continuing Education RequirementsSTATUTES EFFECTIVE ON 06/25/2009KRS 324.010 Definitions for chapter – application of chapterThe Commission will now accept approved courses in one (1) tosix (6) hour increments. Prior to this change, licensees wereonly allowed credit for courses in three (3) hour increments.This new law (subsection 11) created a new definition of a“designated manager,” which is a licensed sales associate orbroker who manages a main or branch office.REGULATIONS EFFECTIVE ON 12/4/09201 KAR 11:300 Use of facsimile and electronic-mailtransmissions, electronic storageKRS 324.111 Escrow account of broker; Interest; Audit;Contract deposit release; Separate property managementaccountsThis regulation was changed to explain the process for usingand responding to documents containing electronic signatures.201 KAR 11:450 Brokerage management courseThis change requires principal brokers to report to theCommission overdrafts of their escrow accounts that are notcorrected within 72 hours.The Commission now hasThis amended regulation puts a one-year limit on the completionof projects for passing the brokerage management course.1

This new regulation addresses license renewal – annualrequirements and change request procedures.201 KAR 11:121 Improper conductThis regulation was amended to eliminate duplicativeinformation about guaranteed sales plans.201 KAR 11:215requirementsLicenserecognition;REGULATION EFFECTIVE 11/1/13201 KAR 11:220 – Errors and omissions insurancerequirementsapplicationThis amended regulation clarifies that cost of investigation/defense is excluded from the limit of liability and annualaggregate.This is a new regulation which provides the details for applyingfor a license under the new license recognition law.REGULATION EFFECTIVE ON 2/5/10201 KAR 11:250 Listing and purchase contracts and otheragreements entered into by licensees; provisions required;seller-initiated re-listing request disclosure formREGULATIONS EFFECTIVE 10/31/14201 KAR 11:011 – Definitions for 201 KAR Chapter 11This regulation was amended to delete the definition of “Prize,”to reflect changes in law allowing rebates and inducements. Itwas also amended to delete the definitions of “Guaranteed salesplan” and “Required disclose.” That language was moved to 201KAR 11:121 where the requirements of a guaranteed sales planare listed.This regulation was amended to include two new sections(sections 6 & 7) setting out the requirements that a licensee mustmeet regarding negotiating a subsequent listing agreement withanother broker. These requirements include the use of a form,which can be found on the Commission’s website.201 KAR 11:105 Advertising listed property; advertisingpublic information about specific property; under whatconditions consent and authorization of owner or principalbroker is requiredSTATUTES EFFECTIVE 7/15/10KRS 324.090 Expiration of license – Fine for failure torenew on time – Expired statusThis statute changed the statutory March 31, 2010 renewal dateto a date that will be established in a regulation.This regulation was amended to clarify that a buyer’s agent mayadvertise his or her role in the sale after a closing has occurredand to require that his or her participation as a buyer’s agent isconspicuously stated.KRS 324.112 Broker to manage certain branch offices –Qualified sales associate may manage certain branch offices– Registration of branch offices – Filing of licenses –Temporary affiliation of one principal broker with another201 KAR 11:121 Improper conductThis regulation was amended to include the definition of“Guaranteed sales plan” and the advertising and requireddisclosure requirements for guaranteed sales plans. Thisregulation was amended to delete language dealing withlicensees acting in the dual capacity of a real estate licensee anda loan originator. This regulation was also amended to removelanguage prohibiting a Kentucky broker to assist an individualnot actively licensed in Kentucky in the practice of brokeringreal estate, which was deemed unconstitutional.This amendment allows a principal broker to maintain a branchoffice within 100 miles without a broker managing the office. Abranch office outside a 100-mile radius of the main office isrequired to have a managing broker. A sales associate with two(2) years experience in real estate, averaging at least twenty (20)hours per week for twenty (24) months prior, may manage abranch office inside a 100-mile radius of the main office.KRS 324.330 Notice of change of location, firm name,surname or associate – New licensePOST-LICENSE STATUTES EFFECTIVE ON 1/1/2016KRS 324.010 Definitions for chapter – Application ofchapterThis statute amends that licensees shall annually file theirtelephone numbers and email addresses with the Commission.This statute was amended to add the definition of post-licenseeducation.KRS 324.410 Purpose of fundThis statute was amended to state that the Commission has onehundred twenty (120) DAYS AFTER THE END OF EACHFISCAL YEAR TO MAKE THE Commission’s EducationResearch and Recovery Fund Statement public either throughthe Commission’s website or other public media.KRS 324.085 Continuing education requirements – Postlicensure education requirements -- Qualifications ofinstructors – Administrative regulationsThis statute was amended to require initial sales associateslicensed after the effective date to complete forty-eight (48)classroom or online hours of commission-approved post-licenseeducation.STATUTE EFFECTIVE ON 7/12/12KRS 324.410 Purposes of fundThis statute was amended to improve budget management andfinancial accountability of the Commission’s two budgetaccounts, including the Trust and Agency Account and theEducation, Research, and Recovery Fund.STATUTE EFFECTIVE 06/24/2015KRS 324.020 – Requirement of licensing – Application ofchapter to owner or builder-developer – Prohibition againstfee splitting – Exceptions – Supervision of sales associate –Authority to seek injunctive relief.REGULATION EFFECTIVE 7/12/12201 KAR 11:.225 – License renewal – annual requirementsand change request proceduresThis statute was amended to allow a broker to pay a licensedauctioneer for services rendered in cases where an auctioneer2

and real estate broker collaborate in the conduct of a sale of realestate at auction.process; and sets forth the requirements for approval of out-ofstate courses. The amendments provide a definition of“continuing education course” and changes one (1) hour of CEto be measured by length of instruction, rather than classattendance. It also removes language that is redundant on formsthat are required and now incorporated in the administrativeregulation by reference.REGULATIONS EFFECTIVE 12/4/2015201 KAR 11:170 Real estate school and pre-license courseapprovalThis administrative regulation sets forth the application andapproval process for real estate education schools and prelicense courses; provides the record maintenance requirements;sets the criteria for out-of-state course approval; authorizesinspections and monitoring by the Commission; sets grounds forrevocation of school approval; and prohibits attempts to copy orreconstruct the real estate licensing examination. Theamendments simplify the approval process for schools andcourse offerings; removes the requirement for third-party courseapproval, which will now be conducted by the Commission; andit provides a new process for reconsideration of theCommission’s intent to withdraw approval.201 KAR 11:232requirementsThis new administrative regulation sets forth the forty-eight (48)hour Post-license Education (PLE) requirements. It providesdefinitions for the key terms “Broker-affiliated TrainingProgram” and “Initial Sales Associate License,” and sets forththe approval requirements for PLE course providers, instructors,and curriculum. It also addresses the compliance and adelinquency remedy, record maintenance requirements, andincorporates by reference the required forms to be used.201 KAR 11:240 Distance education requirementsThis administrative regulation establishes the distance educationrequirements and criteria for approval of online and otherdistance education methods for pre-license, post-license, andcontinuing education courses. It sets forth the approval processfor distance education courses and sets the criteria for thedistance education course and instructor approval. TheAmendment deletes the requirement that these types of coursesbe certified by the Association of Real Estate License LawOfficials (ARELLO) or the International Distance EducationCertification Center (IDECC).201 KAR 11:195 Informal settlement proceduresThis new administrative regulation allows the Commission,after ordering a hearing, to resolve disciplinary proceedingswithout the necessity for a hearing, if all parties agree to settlethe matter by Agreed Order.educationandprovider201 KAR 11:235 Post-license education requirementsThis administrative regulation sets forth the procedures andguidelines for the approval of an instructor at an approved realestate school. This regulation was amended to maintainconsistency between the requirements for pre-license,continuing education, and post-license education instructorapproval. Forms have been revised to allow their use for allthree types of instructors.Licensing,educationThis new administrative regulation addresses ContinuingEducation (CE) Provider requirements, which were deleted from201 KAR 11:230. It sets forth the application requirements, CEcourse curriculum, and out-of-state course approval process. Itincorporates by reference the forms that are required to be used.201 KAR 11:175 Instructor approval procedures andguidelines201 KAR 11:210requirementsContinuingtestingThis administrative regulation establishes education standardsand licensure application requirements; provides for procedurefor translating and certifying diplomas and transcripts that are ina foreign language; and requires applicants for licensure toapply within 60 days of the real estate license examination. Theamendments changed the entities ability to provide thetranslation and equivalencies certifications to any serviceprovider with membership in the National Association ofCredential Evaluation Service and removed the requirement foran official transcript to be imprinted with the institution’s seal,signed by the registrar to be sent directly to the Commission bythe institution, in order to allow receipt by electronictransmission.201 KAR 11:460 Minimum rating requirements forinstructorsThis administrative regulation outlines the minimum ratingrequired of all instructors, the evaluation process, and addressesthe option for instructors who receive ratings below the requiredminimum. It incorporates by reference the forms required to beused.201 KAR 11:350 Seller’s Disclosure of property conditionsformThis amendment removed the Seller’s Disclosure of PropertyConditions Form in its entirety from the regulation. It is nowincorporated by reference. It also added a definition of “singlefamily residential real estate dwelling,” and three new questions.New questions include disclosing if the house is in a “specialflood hazard zone;” the name and contact information of theHomeowner Association if applicable; and whether there is amphetamine. The existing question regarding thecondition of the “roof” has now been changed to “roofcovering.” Lastly, formatting changes were made to include a“Not Applicable” (N/A) answer to make the form clearer.201 KAR 11:230 Continuing education requirementsThis administrative regulation establishes the continuingeducation (CE) requirements; sets the requirements for themandatory six (6) hours of continuing education (CE) and theannual deadlines for compliance; changes the timeline for whenCE must be completed; and provides that CE shall not berequired during the first two (2) calendar years from the date ofthe initial sales associate license. It also sets forth the noncompliance and delinquency remedies; informal settlement3

KENTUCKY REVISED STATUTESCHAPTER 324the employer a fixed salary governed by federal wage guidelinesthat is not affected by specific real estate transactions;(13)"Referral fee" means consideration of any kind paid or demandedfor the referral of a potential or actual buyer, seller, lessor, orlessee of real estate;(14) "Designated agency" means a form of agency relationship thatexists when a principal broker, in accordance with KRS 324.121,identifies different licensees in the same real estate brokerage firmto separately represent more than one (1) party in the same realestate transaction;(15) "Affiliation" means the relationship agreed upon between alicensee and a principal broker and reported to the commission,where the licensee places his license with the principal broker forsupervision of the licensee's real estate brokerage activity;(16) "Canceled" means the status of a license when a licensee fails torenew a license, writes the commission a check for fees that is nothonored, fails to re-affiliate with a principal broker, or fails tocomplete requirements for continuing or post-license education;(17) "Suspended" means the status of a license when disciplinaryaction has been ordered against a licensee that prohibits thebrokerage of real estate for a specific period of time;(18)"Revoked" means the status of a license when disciplinary actionhas been ordered that removes the licensee's legal authority tobroker real estate for a minimum of five (5) years; and(19)”Post-license education” means the forty-eight (48) hours ofcommission-approved education required within two (2) years ofreceiving or activating an initial sales associate license.324.010 Definitions for chapter—Application of chapterAs used in this chapter, unless the context requires otherwise:(1) "Real estate brokerage" means a single, multiple, or continuing actof dealing in time shares or options, selling or offering for sale,buying or offering to buy, negotiating the purchase, sale, orexchange of real estate, engaging in property management, leasingor offering to lease, renting or offering for rent, or referring oroffering to refer for the purpose of securing prospects, any realestate or the improvements thereon for others for a fee,compensation, or other valuable consideration;(2) "Commission" means the Kentucky Real Estate Commission;(3) "Net listing" means a listing agreement that provides for astipulated net price to the owner and the excess over the stipulatednet price to be received by the licensee as the fee compensation orother valuable consideration;(4) "Principal broker" means a person licensed as a broker under KRS324.046 who, in addition to performing acts of real estatebrokerage or transactions comprehended by that definition, is thesingle broker responsible for the operation of the company withwhich he or she is associated;(5) "Real estate" means real estate in its ordinary meaning andincludes timeshares, options, leaseholds, and other interests lessthan leaseholds;(6) "Sales associate" means any person licensed in accordance withKRS 324.046(2) that is affiliated with a Kentucky-licensedprincipal broker and who, when engaging in real estate brokerage,does so under the supervision of the principal broker;(7) "Approved real estate school" means:(a)A school that has been given a certificate of approval bythe Kentucky Commission on Proprietary Education orother regulatory bodies that exercise jurisdiction overaccreditation and approval and the Kentucky Real EstateCommission. The school shall also be currently in goodstanding with both the Kentucky Commission onProprietary Education or other regulatory bodies thatexercise jurisdiction over accreditation and approval andthe commission; or(b)A National Association of Realtors recognized programwhich has been reviewed by the Kentucky Real EstateCommission and deemed an approved real estate school;(8) "Accredited institution" means a college or university accreditedby appropriately recognized educational associations or charteredand licensed in Kentucky that grants credits toward a program foreither an associate,
