The manual willprovide guidelines for the training of new investigators, a reference forexperienced investigators, and to document required standards within theUnit.1.1.2 DISTRIBUTIONThe Homicide Unit Manual shall be available for online viewing on theSheriff's Intranet site.1.1.3 REVISIONS TO THE MANUALThe Homicide Unit Lieutenant shall maintain the “MASTER COPY” of theHomicide Unit Manual. It will be the Homicide Unit Lieutenant’sresponsibility to annually review the Homicide Unit Manual and make thenecessary revisions as outlined in Department P&P section 1.2.1.2.0 NUMBERINGSYSTEMS OF THEHOMICIDE MANUAL1.2.1 PURPOSEThe Homicide Unit Manual is numerically indexed to maintain consistencyand ease of reference, and to facilitate future changes.1.2.2 POLICYThe numbering system shall consist of a decimal system with categorydesignators and major subject designators within each category.SECTION 1 - Introduction

They are not allinclusive and are intended as a general guideline only and outline only thegeneral job description.1.4.3 LIEUTENANT - HOMICIDE UNITREPORTS TO:Captain, Major Crimes DivisionLaw Enforcement Investigations CommandSUPERVISES:Sergeants of Homicide Unit and Admin IIRESPONSIBILTYAND AUTHORITY: Within the approved limits as set forth by the Policiesand Procedures of the Department, the lieutenant ofthe Homicide Unit is responsible for the effective andefficient performance of the Homicide Unit. Thelieutenant has the authority to fulfill those duties asset forth below.DELEGATION:SPECIFICDUTIES:SECTION 1 - IntroductionThe lieutenant may delegate to employees underhis/her command appropriate portions of his/herduties, together with proportionate authority for theirfulfillment, but he/she may not delegate or relinquishthe overall responsibility for final results nor relinquishany portion of his/her accountability.A.Review crime reports and follow-upinvestigations of all reported crimes that arehandled within the Homicide Unit.B.Within budget constraints, ensure that thepersonnel of the Homicide Unit are properlytrained, issued proper equipment and areprovided adequate facilities.C.Maintain liaison with other law enforcementagencies, and as required, arrange forexchange of information on cases and relatedlaw enforcement problems.

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)SECTION 1 - IntroductionD.Maintain liaison with the news media andensure the flow of newsworthy information,without compromising investigations.E.Disseminate departmental information,including policies and procedures, specialorders and training information to personnel asrequired.F.Facilitate the investigation of major crimescenes by coordinating the work of homicideteams and by interfacing between the Unit andother commands within the department whenrequired.G.As required, conduct reviews of theperformance of assigned subordinates andappraise the effectiveness of all personnelsupervised.H.Review annual budget requests from first linesupervisors and assist in the preparation ofthese requests for submission during theannual budgetary process.I.Keep the Major Crimes Division captaininformed of case progress and of unusualoccurrences.J.Review and conduct proper investigation ofcitizen complaints made about Homicide Unitpersonnel.K.Ensure that assigned equipment and vehiclesare properly utilized and maintained.L.When designated, assume command of MajorCrimes Division in the absence of the captain.M.Manage Special Funds pursuant toDepartment Policy and Procedures.

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)1.4.4 SERGEANT – HOMICIDE UNITREPORTS TO:Lieutenant, Homicide UnitSUPERVISES:Detectives assigned to the team; and other personnelassigned.RESPONSIBILTYAND AUTHORITY: Within the limits of approved policies and procedures,the sergeant, Homicide Unit, is responsible for theefficient and effective operation of his team in theinvestigation of all cases assigned. He/she hasauthority to fulfill the duties set forth below.DELEGATION:SPECIFICDUTIES:SECTION 1 - IntroductionThe sergeant may delegate to detectives underhis/her supervision appropriate portions of his/herduties together with proportionate authority for theirfulfillment, but he/she may not delegate or relinquishhis/her overall responsibility for results nor any portionof his/her accountability.A.On team responses, assigns his/her team’sdetectives to various aspects of a crimeinvestigation with suggestions for properinvestigative technique.B.Personally accompany detectives to crimescenes of all suspected homicides, officerinvolved shootings and other crimes of a moreserious nature, such as kidnappings, etc.C.At a serious or important crime scene, thesergeant should interface between homicideinvestigators and other departmental units.D.Determine when a case is newsworthy andafter conferring with team members, determinewhat evidence and facts should be revealed tothe news media. This information will bereleased by the Homicide Lieutenant or by theteam sergeant as assigned.E.Personally accompanies investigator(s) duringD.A. issuance conference for all criminal

Maintain liaison with the D.A.’soffice during the subsequent legal proceedings.F.Maintain liaison with the D.A. during all othermatters under litigation or mutual concern.G.Maintain an individual file of all cases assignedto his/her team for reviewing workaccomplished by each detective and keepingup to date on the status of each case.H.Coordinate with the other sergeants and thedetectives annual vacations and periods ofcompensatory time off; approve and coordinateall overtime worked.I.Periodically appraise, rate and counseldetectives regarding their performance andassigned responsibilities, and at various timesreview with them the status of their open casesand the disposition of property and evidencebeing held.J.Review all prison releases and changes ofcharge initiated by detectives.K.Periodically inspect detective’s vehicles forproperly assigned equipment.L.Report to the Homicide lieutenant daily allunusual crimes responded to and any unusualincidents affecting the sergeant’s team.M.Prepare and justify annual budget request forthe team as assigned by the lieutenant.1.4.5 DETECTIVE – HOMICIDE UNITREPORTS TO:Sergeant, Homicide UnitRESPONSIBILTYAND AUTHORITY: Within the limits of approved policies and procedures,the detective is responsible for the efficient andeffective investigation of all assigned cases. Thedetective has the authority to fulfill the duties set forthbelow.SECTION 1 - Introduction

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)SPECIFICDUTIES:SECTION 1 - IntroductionA.The detective assigned to this Unit shallendeavor to familiarize himself/herself with allpoint bulletins and teletypes regarding crimesof violence disseminated throughout theHomicide Unit. The detective shall also make ita point to keep informed regarding the basicfacts of all criminal cases assigned to this Unit.B.The detective will keep the sergeant in chargeof the detective’s team verbally informed of thestatus of all current investigations.C.A rotation schedule with which the detectivesshall be familiar is maintained within theHomicide Unit. The rotation schedule will firstbe used to callout detectives; however, alldetectives assigned to the Homicide Unit aresubject to call back at any time based oninvestigative expertise, Mobile Field Forceresponse and for rapid redeployment to anemergency disaster or critical incident wheretime is of the essence. This directive ispursuant to Departmental Policy andProcedure 5.8 and as noted on the SO-02 formsigned by the detective. The detective isresponsible for notifying his/her supervisorwhen unavailable for call-out when on-callstatus is assigned.D.A detective given any regular or overtimeassignment, or call to duty by any authorizedperson of this department will notify his/hersergeant if the assignment pertains to aninvestigation of death, kidnapping, any crimewhere an injured person is in critical condition,or an officer involved shooting.E.A detective shall make complete notes on allphases of his/her investigations, payingparticular attention to detailed accuracy.Complete and comprehensive reports shall bemade from these notes as outlined bydepartment policy and procedure.

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)F.When a detective is first assigned a case toinvestigate, they shall ensure that any radiobroadcast and teletype has been sent orcanceled as soon as possible.G.The Homicide detective shall ensure thatpersonnel from the Sheriff’s Crime Lab obtainall indicated evidence, and that they collect andprocess all photographs and conduct lab testsrequested.H.The Homicide detective shall obtain criminalcomplaints against all persons arrested inconnection with the case being investigated, orrelease said person as soon as possible. APrisoner’s Release or Change of Charge Formwill be made and approved immediately afterdetermining that no complaint will be issued, ora charge is necessary.I.The Homicide detective shall assumeresponsibility for the final disposition of allproperty and evidence seized which pertains tohis assigned cases.1.4.6 ADMINISTRATIVE SECRETARY II – HOMICIDE UNITREPORTS TO:Lieutenant, Homicide UnitRESPONSIBILTYAND AUTHORITY: The Administrative Secretary II in the Homicide Unit isresponsible for the efficient and timely completion ofall routine secretarial duties as outlined below.SPECIFICDUTIES:A.Transcribe recorded interviews and dictation.SECTION 1 - IntroductionB.Type correspondence, memoranda, reports,and statistical data.C.Set-up and maintain office files.

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)SECTION 1 - IntroductionD.Monitor the status and expedite the completionof clerical assignments (e.g., transcribing oftapes/digital recordings and detective reports).E.Sort, screen and route incoming mail.F.Provide general information to office telephonecallers and/or refer them to appropriate party.G.Proofread information for conformance withstandard typing layouts, identify typographicalerrors, correct spelling, grammar, punctuation,capitalization and work usage.H.Prepare payroll records and all financialreports.I.Prepare Departmental Requisitions andmaintain office supplies.J.Enter case information into the Violent CriminalApprehension Program (ViCAP) database.

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)2.0 HOMICIDE UNITMANUAL –ADMINISTRATIVEPROCEDURES2.1.0 CASE ASSIGNMENT2.1.1PURPOSETo specify those cases to be managed by the Sheriff’s HomicideUnit.2.1.2CASE ASSIGNMENT PROCEDUREFor Homicide Unit case responsibility refer to Department P&PSection 6.61.2.2.0 TEAMCONFIGURATION2.2.1PURPOSETo establish a standard configuration of a Homicide Team. This isnot to preclude any changes needed as a result of manpowershortages, case overload or to realign teams at the discretion of theHomicide Unit Lieutenant.2.2.2HOMICIDE TEAMA.A Homicide Team will consist of three Homicide Detectivesunder the specific supervision and direction of a HomicideSergeant.B.There will be five teams assigned to the Homicide Unit.C.A Homicide Team is under the general supervision of anyHomicide Sergeant in the absence of the team’s regularsergeant.SECTION 2 – Administrative Procedures

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)D.All Homicide Teams are under the specific supervision anddirection of the Homicide Unit Lieutenant.2.3.0 ON CALL/CALLOUTPROCEDURES2.3.1PURPOSETo set a standard on-call procedure for the Homicide Unit and ageneral guideline for callout procedures.2.3.2ON-CALL HOURSIn the five Homicide Team configuration, one team shall bedesignated as “First Call” a second team as “Second Call." On arotational basis, Homicide Teams one through four will eachcomplete two weeks of on call status followed by two weeks of standby status. The Teams will begin their on-call status at 0700 hourseach Tuesday. The fifth team will be the Cold Case Team andgenerally will not be subject to routine call outs as a team.STAND BYStand by indicates the teams are not responsible for routine callouts.However, they are subject to being called out as noted in thismanual in section 1.4.5 (c).2.4.0 EMERGENCYFAN-OUT2.4.1PURPOSETo establish a procedure in the event of serious civil disorder ormajor crisis which would require the availability of all personnel, theHomicide Unit will proceed as follows:2.4.2The Sheriff’s Communications Center or Investigations Commanderwill contact the Captain of the Major Crimes Division and notifyhim/her of the specific need for personnel deployment. The Captainwill contact the Homicide Lieutenant or team sergeants to assignpersonnel as directed.SECTION 2 – Administrative Procedures

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)2.5.0 ASSIGNEDEQUIPMENT2.5.1PURPOSETo identify the type of equipment assigned and the responsibility forcare and maintenance of the equipment.2.5.2DETECTIVE EQUIPMENTEach detective has access to various items of equipment which arenecessary to accomplish the investigative mission.Detectives are required to:2.5.31.Maintain all assigned equipment in a clean, neat and proper workingcondition.2.Ensure all assigned equipment is stored properly and in such amanner as to provide the item with maximum protection at all times.3.Periodically check stored equipment to assure that the item is cleanand functions properly.4.Immediately report to their team sergeant any loss, damage(accidental or otherwise) or malfunction of any equipment.5.Assure that all items of equipment are kept readily available forutilization in the event of a call-out.6.Submit when requested, any item of equipment for inspection.DETECTIVE VEHICLESEach detective has been assigned a vehicle. These vehicles are notthe property of the Sheriff’s Department and are provided by CountyGeneral Services, Fleet Operations.Detectives are required to:A. Maintain their respective vehicle in a neat, clean, and properworking condition at all times.SECTION 2 – Administrative Procedures

Assure that assigned vehicles and accessories are maintained inan authorized configuration.D. Maintain their respective vehicles in a ready condition, so thatwhen called to a crime scene, all necessary equipment/suppliesare readily available.E. Assure that all proper/necessary investigative equipment storedwithin the vehicle is stored in such a container or in such amanner that will provide it maximum protection/cleanliness.EVIDENCE SHALL NOT BE STORED IN THE VEHICLES.F. Immediately report any damage (accidental or otherwise) to theTeam Sergeant, or in his absence, the Homicide Unit Lieutenant,so determination can be made as to proper disposition.G. Operate their respective vehicle in a safe and lawful manner atall times.2.6.0 RECORDSMANAGEMENT2.6.1PURPOSEThe Homicide Detective for standardization of keeping files on activecases, closed cases, and for cases kept on file at the Homicide Unitwill do the following:2.6.2INDIVIDUAL HOMICIDE DETECTIVEA. NEW CASES – When a case is assigned to a homicidedetective, a new case file folder will be created in the X: drive.NetRMS is the official record keeping system. At the conclusionof a case, all official reports will be attached to the officialNetRMS case. Not all contents of the case file will be transferredto NetRMS. The following information should be kept in the casefile:SECTION 2 – Administrative Procedures

Original notes taken by the Homicide Detective until finalreports are completed.3. Photographs (excluding originals).4. Lab Reports and sketches5. Telephone Messages6. Audio/Video recordings made of case (suspect/witness/etc.)7. Any other information relative to the case (news media, etc.)B. OPEN CASES – As there is no statute of limitation on murdercases, therefore, the murder file will be kept indefinitely until it isresolved. Cases should remain open until they are eitherresolved or “SUSPENDED.” After the statute of limitations isachieved on an open case, the file should be purged and allevidence in the case disposed in the manner prescribed by law.C. CLOSED CASES – Cases should be resolved as soon aspossible. Criminal case files will be kept until after the matter isadjudicated in court. Once the court action is completed, thecase file should be maintained until sentencing. Closed murderinvestigations are kept in the form of a digital “Case File” andtransferred to the closed cases folder in the X drive. All noncriminal cases should be closed as soon as possible. Once anon-criminal case is closed there is no reason to keep the closedcase for more than 90 days, primarily as a reminder to dispose ofany evidence (if applicable).2.6.3OFFICE FILESThe detective will periodically check their files for purging and toexamine cases that could possibly be worked again as newinformation is received.2.6.4SECURITY OF CASE FILESInformation collected, analyzed, filed, or produced by the HomicideUnit remains the property of the San Diego County Sheriff’sDepartment and can only be disseminated without the expressapproval of the Homicide Unit Lieutenant.Homicide Unit case files will not be taken home or removed from theSECTION 2 – Administrative Procedures

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)office without prior supervisory approval.Personnel assigned to the Homicide Unit will not share or discussinvestigations with anyone who does not have both a right and needto know.2.7.0 INVESTIGATIVETRAVEL PROCEDURES2.7.1PURPOSEHomicide Detectives are called upon to work extended overtimehours, on their days off and are required to travel. Transportation,lodging, meals and other expenses must be planned. Theseguidelines will be followed in strict compliance with the County’sAdministrative Code.2.7.2OUT-OF-COUNTY TRAVELA.On determining out-of-county/state/country travel is necessary, thedetective(s) should begin a Homicide OUT OF COUNTY TRAVELworksheet. The following information needs to be completed:a.b.c.d.e.f.Name(s) of detective(s)Travel destinationCase NumberApproximate length of time away (count by night)Mode of transportation (specify if rental car is needed.)Number of meals for each person traveling (breakfast, lunch,dinner.)g. Lodging (Note if high cost area.)B.Upon completion, the Major Crimes Division Captain must approvethe OUT OF COUNTY TRAVEL worksheet and submit through theproper chain of command to the Law Enforcement InvestigationsCommander.C.Notify Financial Services of information on mode of transportation(only if air travel and rental car is necessary), total number ofpersons traveling, projected number of meals, length of absence(counted by nights) and destination.SECTION 2 – Administrative Procedures

San Diego County Sheriff’s DepartmentHomicide Unit Manual of Policy and Procedures (October 2021)D.Financial Services will compute the amount of money needed andwill advance the money for the Detectives using the informationfurnished by the Detectives as a guideline.E.In the event Financial Services cannot advance the needed money,the Homicide Unit Lieutenant may advance money for expensesfrom the Unit’s Special Investigative Fund. (For details of the SpecialFund, refer to Policy & Procedures Section 3.30.)F.Under normal circumstances, on return from travel, the detective(s)will contact Financial Services as soon as practical, but within 10business days. The detective(s) will need hotel/motel receipt (ifapplicable), rental car receipt (if applicable), a completed Patrol &Investigative Expense Claim enumerating the total number of mealsconsumed, and receipts for any other reimbursable monies spent(parking fees, baggage, transfer, etc.).G.In the event the travel is within driving distance, the mode oftransportation will be county-issued vehicle. This will be determinedby the Homicide Unit Lieutenant with input from the travelingdetective(s).H.The original Homicide OUT-OF-COUNTY TRAVEL SHEET shouldbe forwarded to Financial Services and a copy placed in the casefile.2.7.3IN COUNTY TRAVEL/EXTENDED HOURSA.In the event the detective(s) must work beyond their normalworkday, the detective(s) will be compensated pursuant to thecurrent salary agreement with the County.If an employee works four (4) hours or more beyond his/her normal regularscheduled shift without a minimum of 24 hours advance notice, that employeeshall be entitled to reimbursement for a meal per the current GSA reimbursementrates.If an employee is required to remain at a crime scene or designated post for six(6) or more consecutive hours, the employee will be provided, at the Department’sdiscretion, a meal or will be entitled to reimbursement for a meal per the currentGSA reimbursement rates.For reimbursement of the money expended for meals, the funds will be paid frompetty cash.SECTION 2 – Administrative Procedures

Anaccounting of all cases assigned to the Homicide Unit will be kept bythe Homicide Crime and Intelligence Analyst and forwarded to theHomicide Unit Lieutenant on a weekly basis.2.9.0 MEDIA RELATIONS2.9.1PURPOSEThis policy has as its purpose the establishment of the publiccommunications goals as they pertain to the Sheriff’s Homicide Unit,setting guidelines for the dissemination of information to the publicthrough the various news media, fixing responsibility for the releaseof information and prescribing conditions where information cannotor will not be released.2.9.2CRIMINAL CASESA.Press releases should be made on criminal cases where theHomicide Unit responds and assumes the investigation in the field,unless doing so would compromise the investigation.B.It will be the responsibility of the Homicide Unit Lieutenant to ensureproper and effective press releases are made in a timely manner.News releases will be approved, via the chain of command, beforebeing released.C.In those instances where the Lieutenant does not respond to thescene, it will be the responsibility of the sergeant assigned to thecase to provide information to the Homicide Unit Lieutenant so theycan make the press release(s).SECTION 2 – Administrative Procedures

In large scale incidents, Public Affairs may beappointed as the primary point of contact for the media, withapproval from the Major Crimes Captain.2.9.3E.In murder investigations and questionable death investigations, it isdesirous to have only one spokesperson for the media contacts. Itshould be the responsibility of the assigned Homicide UnitLieutenant to act as spokesperson. In those instances where theUnit Lieutenant will be absent or unavailable for an extended periodof time, media contacts should be then referred to the HomicideTeam Sergeant.F.The lieutenant, team sergeant, and lead detective will ensurespecific facts and details of the scene (hold back information) arenot released to the media or public to protect the confidentially of theinvestigation.NON-CRIMINAL DEATH CASESThese types of cases (natural deaths, suicides, accidental deaths,etc.) are the investigative responsibility of the Medical Examiner’sOffice. In those instances where we respond, we will do so toresolve any criminal elements, and, if present, begin a criminalinvestigation. Often, just by the mere fact that the Homicide Unitresponds to an incident, generates inquiries from the media. Fornon-criminal cases, these guidelines are offered:A. Formal press releases will not be made by the Homicide Unitunless the incident is of an unusual nature or involves publicfigures. As the investigative agency, the San Diego CountyMedical Examiner’s Office will handle media inquiries in most ofthe above cases and the media should be referred to thatagency.B. The name of the victim will not be released by the Homicide Unituntil it is certain that the next-of-kin have been notified.C. The Homicide Unit normally will not release the name of asuicide victim; however, the homicide lieutenant, upon request,will release the name and age of a suicide victim, pursuant toGovernment Code section 6254(f)(2).
