LSHV’s Beacon Housing Pilot ProjectDRAFT Work Plan and BudgetJanuary 18, 2022-January 17, 2023In order to achieve LSHV’s and City of Beacon’s common goal of assisting Beacon tenants inmaintaining preserving their permanent housing as the NYS Moratorium on Evictions is slated tobe lifted on January 15, 2022, we are presenting this proposed project and its scope of services:Dedicated staff to assist Beacon tenants at risk of losing their rental units due tononpayment:With a funded amount of 25,000, LSHV can offer to dedicate .30 FTE paralegal and .03 FTEsupervising attorney, both based out of our Poughkeepsie office, to offer a direct line ofcommunication with Beacon residents faced with housing issues linked to nonpayment.Project Tasks:The paralegal will receive inquiries from Beacon residents by a method established by LSHV,and upon making contact with the tenant will provide the following services:1. The assigned paralegal will conduct an intake assessment to determine eligibility forLSHV legal assistance.2. If eligible, move forward with a legal assessment. If not eligible, without providing legaladvice specific to the ineligible applicant’s case, the paralegal will provide links to LSHVlegal guide documents that provide legal information on rights and responsibilities of thetenant, and a description of the housing court processes currently in place.3. For eligible households, the paralegal will conduct a holistic assessment of the householddemographics, household members and relationships, income sources and potentialincome sources, living situation, housing legal issues concerning building type, paymentissues and housing conditions.4. Refer the case opened and completed assessment to a supervisor, who will assign, asallowed by capacity, the housing case to a staff attorney and any other legal issueuncovered by the assessment to staff attorney(s) in other practice areas.5. Under the direction of the assigned housing attorney to make phone calls, write and sendletters and emails to obtain more information on the case, on the evidence that is neededto be obtained. Work with the client on listing the documents required for anyapplications for financial assistance, following up with client on receiving thosedocuments, working to complete applications for assistance and obtaining necessarysignatures from the client, submitting the applications, following up on the status of theapplications, recording the amount of assistance awarded in the case management systemand relaying to the attorney and client. These applications may include those to internal24

programs administered by LSHV or external programs, depending on fundingavailability.6. Support the housing attorney assigned to the Beacon client with a variety of tasks,including making calls to the client to keep them updated on the status of the case orapplications, or any other communications.7. In addition to making assignments of eligible Beacon housing cases, the assignedsupervisor will conduct periodic reviews with the paralegal on Beacon cases opened,applications in process by the paralegal, will review the number of ineligible applicantsand the legal information being distributed to them and direct any changes needed onmaterials distributed, discuss the trends the paralegal is seeing generally in the intakesand assessment to allow for any changes in strategy.Plan for access for tenants arriving at Beacon City Court:[City of Beacon/LSHV] will contact Beacon City Court to request a banner in plain sight ofincoming tenant parties at Beacon City court that announces the legal assistance contemplated bythis project with a table that offers contact information [and legal information sheets on rightsand responsibilities] for tenants to call for an eligibility determination for free legal assistanceand/or legal information about rights, responsibilities and court processes when faced with ahousing court proceeding. LSHV will determine a telephonic method for the Beacon applicantto reach the dedicated paralegal.25

CITY OF BEACONCITY COUNCILRESOLUTION NO. 24 OF 2022A RESOLUTION TO URGE THE STATE TO ADOPT SENATE BILL S2021 AND ASSEMBLYBILL A1007 AUTHORIZING CITIES, VILLAGES AND TOWNS TO REDUCE THE SPEEDLIMIT TO 25 MPHWHEREAS, Senate Bill S2021 and Assembly Bill A1007 have been introduced in the New YorkState Senate and New York State Assembly, respectively each entitled “AN ACT to amend the vehicleand traffic law, in relation to authorizing cities, villages and towns to reduce the speed limit to twenty-fivemiles per hours”; andWHEREAS, the purpose of this legislation is to afford cities, villages and towns the option to setthe maximum speed limit at 25 mph; andWHEREAS, Section 1643 of the New York State Vehicle and Traffic Law currently prohibitsthe City from adopting a City-wide speed limit of less than 30 mph; andWHEREAS, according to the AAA Foundation for Traffic Safety, a pedestrian struck by avehicle going 25 mph has a 25 percent risk of sustaining a serious or fatal injury, a 50 percent risk at 33mph and a 75 percent risk at 41 mph; andWHEREAS, the City seeks the option to lower the speed limit on all City streets from 30 mph to25 mph in order to improve safety for motorists, pedestrians and bicyclists and to reduce the occurrenceof serious injuries and fatalities in the City in pedestrian involved accidents; andWHEREAS, the research is clear that there are major safety benefits to the public when speedlimits are reduced from 30 mph to 25 mph; andWHEREAS, municipalities should be granted the authority to reduce speed limits on municipalroads to help decrease fatalities and the severity of injuries that can result from speed related accidents.NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Beacon herebyadopts this Resolution to urge the New York State Legislature to allow cities the option to reduce themaximum speed limit to 25 mph City-wide.-1-27

CITY OF BEACONCITY COUNCILRESOLUTION NO. 25 OF 2022EXERCISING EXTENSION OF 2021 REAL PROPERTY TAX EXEMPTIONS TO 2022 CITYASSESSMENT ROLL(REAL PROPERTY TAX LAW §459-c and REAL PROPERTY TAX LAW §467)PURSUANT TO EXECUTIVE ORDER 11.1WHEREAS, on December 26, 2021, Governor Kathy Hochul signed Executive Order 11.1which extended the terms, conditions and suspensions contained in Executive Order 11 until January 25,2022; andWHEREAS, Executive Order 11.1 temporarily suspends Subdivisions 7, 7-a and 8 of § 459-c ofthe New York State Real Property Tax Law (Exemption for Persons with Disabilities and LimitedIncomes), and Subdivisions 5, 5-a, 5-b, 5-c and 6 of § 467 of New York State Real Property Tax Law(Exemption for Persons Sixty-Five Years of Age or Over), to the extent necessary to permit the governingbody of an assessing unit to adopt a resolution directing the Tax Assessor to grant exemptions pursuant to§§ 459-c and Section 467 of the New York State Real Property Tax Law on the 2022 assessment roll toall property owners who received such exemption on the 2021 assessment roll, thereby dispensing withthe need for renewal applications from such persons; andWHEREAS, Executive Order 11.1 further provides that such governing body may adopt a locallaw or resolution which includes procedures by which the Tax Assessor may require a renewalapplication to be filed when he or she has reason to believe that an owner who qualified for either type ofexemption on the 2021 assessment roll may have since changed his or her primary residence, addedanother owner to the deed, transferred the property to a new owner, or died; andWHEREAS, it is the intention of the City Council of the City of Beacon to adopt such aresolution implementing these terms pursuant to Executive Order 11.1.NOW, THEREFORE, BE IT RESOLVED that the City Council, as the governing body of theCity of Beacon, authorizes the City Assessor to grant exemptions pursuant to §§ 459-c and 467 of theNew York State Real Property Tax Law on the 2022 City of Beacon assessment roll to all propertyowners who received such exemptions on the 2021 assessment roll even if an application for such anexemption has not been received on or before March 1, 2022 (the City of Beacon taxable status date); andBE IT FURTHER RESOLVED that the City Council of the City of Beacon authorizes the CityAssessor to require, in her reasonable discretion, that a renewal application be filed by any person(s) whoreceived exemption(s) under §§467 and/or 459-c of the Real Property Tax Law on the City of Beacon2021 assessment roll who may have since changed his or her primary residence, added another owner tothe deed, transferred the property to a new owner, or died; andBE IT FURTHER RESOLVED that such renewal application, when deemed required in thereasonable discretion of the City Assessor, shall be filed in person, by mail or by electronic mail (PDF);and30
