The General Assembly has made provisions for thisprogram in each year’s budget, beginning in 2016. The program conditions and fundinglevels have changed from one year to the next and the General Assembly has not codifiedinto statute any of the provisions governing BOOST.4.It is currently unknown if the BOOST Scholarship Program will be fundedfor the 2020-2021 school year, and, if it is funded, how much money will be appropriatedfor the program or what eligibility conditions will be imposed for schools to receivefunding.5.The BOOST Scholarship Program for the 2019-2020 school year is governedby the provisions of the Fiscal Year 2020 Budget Bill, Chapter 565 of Maryland Laws2019. The application window for individual students to apply for BOOST scholarshipfunds was March 6, 2019 through April 17, 2019. Schools who wished to be consideredas BOOST eligible institutions for the 2019-2020 school year were required to submitapplications by December 31, 2018 to the then Nonpublic Textbook and TechnologyProgram. The Plaintiff, Bethel Christian Academy did not apply for the 2019-2020 schoolyear. The funding appropriated for the BOOST Scholarship program for the 2019-2020school year has been distributed in its entirety. As of August 2019, 2,768 scholarshipswere awarded to students and 1,134 students were placed on a wait list.

While many of youare familiar with the Parent Teacher Association (PTA), we want reiterate that we are the largest child advocacyorganization in the United States. The Maryland Congress of PTAs promote the PTA’ s mission to make everychild’ s potential a reality by engaging and empowering families and communities to advocate for all children.We are pleased to see that the Biblical Lifestyle Requirement of the 2017-18 school year Parent Handbook ofTrinity Lutheran Christian School (TLCS) is on the agenda for discussion on acceptance of either of the school’ sproposal to modify such language to comport with the eligibility requirements of the BOOST Program. MarylandPTA appreciates your being proactive to diligently approach the school for them to amend their handbook andhopefully, practice.The Maryland PTA has had a long-standing position of endorsing the use of public funds exclusively forpublic schools. Any consideration for funding the student tuition of private schools with tax payer dollars vialegislative appropriations must be met with the strongest application to hold schools accountable to the laws,policies and regulations pertaining to such administration of funds.It is important to hold schools not only accountable to eligibility requirements but also making schoolstransparent. Hence, given TLCS’s previous two years of being an awardee of BOOST funds while maintaining anopen discrimination policy disguised as a Biblical Lifestyle Requirement to refuse admission of an applicant or todiscontinue enrollment of a student based on the sexual orientation of a child’ s parents, it is warranted to say thata stronger partnership is needed between education advocacy organizations such as the Maryland PTA and MSDEto assist in holding schools accountable. It is doubtful that MSDE would have known of such policy if it weren’ tfor any outside organization.Thus, the Maryland PTA recommends that for all schools that have accepted BOOST funding since inceptionof the program during the 2016-17 school year as well as for those seeking eligibility henceforth, that followingbe required of all participating schools:Page 1 of 3

Withdrawingthe text from the Parent Handbook doesn’ t mean that it still won’ t be in practice. Hence, the omission of the textalong with an established public anti-discrimination policy is better suited to make the school accountable to theeligibility requirements of the BOOST Program.In terms of administration of the program by MSDE, Maryland PTA respectfully requests that an annual publiccalendar be established as soon as possible along with the minutes of meetings published within a designatedtime. Moreover, the agenda should be made public at least a week or more prior to the scheduled board meetingso that interested parties can provide feedback in a timely fashion.
