INTRODUCTIONHOW TO CLAIMAs you’ve taken out a Jaguar Service Plan, you’re also covered byMOT Protect. So if your Jaguar fails its MOT test, MOT Protect will coverthe cost of repairs up to 750 Please read on for terms and conditions.Simply take your vehicle to the nearest Jaguar Retailer and hand over:It makes sense to keep this handbook in your vehicle, as you will needto show it to your Retailer if you have to make a claim.2 Proof of servicing.We hope that this handbook is easy to understand and explainsclearly all the benefits of your MOT Test Warranty. However if anythingis unclear, or you have any questions, please contact your supplyingRetailer or our Customer Services staff on 0344 573 8065.IMPORTANTThe cover provided only applies to the vehicle described inthe Service Plan Welcome Pack that will have been sent byEMaC Limited and accompanies this handbook.This MOT Test Warranty is not an insurance product but aguarantee provided by Jaguar Land Rover Ltd and administeredby Jaguar Approved Warranty Administration.1 This MOT Test Warranty booklet and your RegistrationConfirmation Letter.3 The previous valid MOT Certificate (if applicable) and thenotification of refusal to issue an MOT Certificate (W) citingthe reasons for failure.WHAT YOUR MOT TESTWARRANTY COVERSJaguar MOT Test Warranty covers the cost of repair, replacement and/or adjustment to the vehicle of the specified parts listed below whichare covered as a direct consequence of such parts being cited in a‘notification of refusal to issue an MOT certificate’ (form VT30), preparedduring the period of cover, as causing the vehicle to fail its MOT test.Accidental damage is not covered under this MOT Test Warranty.The Retailer will then take responsibility for establishing that the partsinvolved in the repair, deemed necessary by the ‘notification of refusal toissue an MOT certificate’ (VT30), are covered by this MOT Test Warranty.This Jaguar MOT Test Warranty will apply to the first three MOT testsdue when the vehicle is three, four and five years old (four, five and sixyears old in Northern Ireland) with a maximum of 100,000 miles.The Retailer will be responsible for obtaining prior authorisation fromthe Jaguar Approved Warranty Administration Claims Department.LAMPS, REFLECTORS AND ELECTRICAL EQUIPMENTLamps including Xenon, High Intensity Discharge (HID), Light EmittingDiodes (LED), reflectors, indicators, bulbs, headlamp levelling andcleaning devices (when fitted for HID or LED headlamps) and TyrePressure Monitoring Systems (TPMS) are covered for failure due to:Breakage, discolouration, electrical failure, misalignment, water ingress,and corrosion. Failure of the horn. Battery retaining bracket/stay/supportfor failure due to insecurity (please note the battery is not a covereditem). Switches, instrument panel, warning lights and wiring arespecifically excluded.STEERING AND SUSPENSIONManual and power steering units, operation of steering lock (where fitted),drag links, track rods/ends, transmission shafts, Constant Velocity (CV)joints and boots, shock absorbers, road springs, wishbones, anti-rollbar links, swivel joints, mountings and bushes, sub-frames and wheelbearings are covered for failure due to: Wear, seizure, leakage, andinsecurity. Steering wheel for cracks or fractures.BRAKESBrake master cylinder, wheel cylinders, calipers, discs, drums, electronicparking brake control, Electronic Stability Control (ESC) components,load compensator, Anti-lock Braking System (ABS), modulator/sensors/computers and brake pipes, hoses, cables are covered for failure due towear, leakage, seizure, splits/cracks, corrosion, adjustment and electricalfailure. Brake frictional material is excluded.SEAT BELTS AND SUPPLEMENTARY RESTRAINT SYSTEM (SRS)Mountings, belts, retractors and buckles, SRS components includingairbags, seat belt pre-tensioners and seat belt limiters are covered forfailure due to wear, non-function and insecurity.BODY, STRUCTURE AND GENERAL ITEMSVehicle structure is covered for corrosion. Failure due to accidentdamage is specifically excluded. Engine mountings for excessivemovement/insecure/fractured or damaged.FUEL AND EMISSIONSThrottle body, airflow meter, lambda sensor, Exhaust Gas Recirculation(EGR) valve, catalytic convertor, fuel injection Electronic Control Unit(ECU) and Diesel Particulate Filter (DPF) sensors are covered forfailure to meet MOT exhaust gas emission standards (warning lights,tuning and adjustments or any damage caused by contaminatedfuel and/or inappropriate fuel are not covered under this section).Fuel leaks are not covered.DRIVER’S VIEW OF THE ROADWindscreen wiper arms and blades, windscreen wiper motors, washermotors. Unless listed above, all other components are specificallyexcluded from the cover provided by this MOT Test Warranty.MOT PROTECT 3

MAXIMUM CLAIM LIABILITYWhere liability for the cost of repairs is admitted under this MOT TestWarranty, the Warranty Holder will be reimbursed repair costs up to amaximum aggregate of 750.00 (including VAT) during each periodof MOT Test Warranty.YOUR MOT TEST WARRANTY DOES NOT COVER The MOT test and re-test fee. Pre-MOT repairs and faults notedas “Advisory” which do not fail the MOT Test. Actual tuning and adjustments to the fuel system. Any component failure, damage or losses:– To components not directly covered under the terms andconditions of this warranty or covered by any other existingwarranties or insurances.– To the Warranty Holder in excess of the maximum claim liability.– Which are said by a qualified engineer appointed by theAdministrator to have existed before the start of this MOT TestWarranty. The supplying Retailer must rectify any such pre-existingfaults before this MOT Test Warranty starts.– As a result of water ingress e.g. through damaged or ineffectivedoor, window or roof seals, through doors or sunroofs left open,or caused by flood water.– Where the speedometer has been interfered with, altered,disconnected or does not work.– Which have resulted from a failure to arrange for an obvious faultto be rectified.– Liability for death, bodily injury or damage to other property orany loss caused directly or indirectly by the claim or event whichgives rise to claim under this MOT Test Warranty.– Caused directly or indirectly by war, riot, revolution or any similarevent or by vandalism, theft or attempted theft from the vehicle.– Liability that would not have attached to the Company under anyagreement or contract had that contract or agreement not beenin force.VEHICLES AND VEHICLE USES YOUR APPROVED WARRANTYDOES NOT COVER Non UK registered left hand drive and Grey Import vehicles.– Repairs, replacement or alterations not authorised by theAdministrator. Any public service vehicles such as police, fire vehicles, ambulancesand military vehicles.– Parts which have not failed the MOT Test but which are replacedor reported during routine servicing, or repair of other non-coveredparts that have failed. Any vehicle used for hire or reward such as taxis or drivingschool vehicles. Any vehicle with an unladen weight of more than 3.5 tonne GVW.– Which occur while the vehicle is outside the geographical territoriesdetailed in this booklet. Any vehicle used in any sort of competition, track days, rallyor racing.– Resulting from any act or omission that is negligent or against thelaw accident damage, misuse, neglect, overloading or abnormal use.– Which occurred as a result of any accessory being fitted (unless theaccessory is approved by the manufacturer for use on the vehicleand fitted according to instructions provided by the manufacturerof the accessory).MOT PROTECT 5

TERMS AND CONDITIONSTo help you understand this MOT Test Warranty, the conditions are set out below.Please take time to read them.1. Warranty Holder The Warranty Holderis the only person who is entitled to make aclaim under this MOT Test Warranty.2. Vehicle Any claim under this MOT TestWarranty must relate to the vehicle describedin the Registration Confirmation Letter.3. Warranty Period This Jaguar MOT TestWarranty will apply to the first three MOTtests due when the vehicle is three, four andfive years old (four, five and six years old inNorthern Ireland) or 100,000 miles, whicheveroccurs first.4. Authorisation No repairs are to becommenced until authorised by ourAdministrator.5. Payment for Repairs When a franchisedJaguar Retailer undertakes a repair, theywill obtain prior authorisation from ourAdministrator and will invoice us the costof the repair. In certain circumstances, ourAdministrator may authorise a repair byanother VAT registered repairer in the UK.6. List Prices This MOT Test Warrantydoes not cover costs that are more than themanufacturer’s UK warranty prices for partsand labour costs that are necessary to repairany failed parts.7. Invoices to Support Claims Withevery claim you make you must provide aVAT receipt from a Jaguar AuthorisedRepairer or other VAT registered repairer.All invoices should be made payable toJaguar Land Rover Ltd.8. Inspection of Vehicle and Parts JaguarApproved Warranty Administration reservethe right to inspect the vehicle beforeauthorising repairs and may also arrange forparts to be examined by a claims assessor.You may be asked to ensure that a faultypart is retained for our inspection followinga repair.9. Repair/Replacement of Parts JaguarApproved Warranty Administration’sobligations under this MOT Test Warranty arelimited to repairing or replacing at its optionany part(s) which prove to be defective.When replacing any defective parts genuineJaguar parts must be used.10. Dismantling the Vehicle It is yourresponsibility to authorise the dismantling ofyour vehicle. The Company will only pay fordismantling if it is part of a valid claim.11. Design Faults and Recalls Any damageto parts, which are being recalled by thevehicle’s manufacturer or which have inherentdesign faults are not covered by this MOTTest Warranty.12. Servicing and Service RecordsIf you do not follow the manufacturer’sservice schedules, this Warranty may notapply. When you have your vehicle serviced,you are allowed 1,000 miles either side of theservice mileage or one month either side ofthe time period, whichever is the sooner.A Jaguar Retailer or a VAT registered garageshould carry out the servicing, and receiptsretained as Jaguar Approved WarrantyAdministration are entitled to check theservice record in the event of a claim.13. Modification to Vehicle If the vehiclehas been modified in any way you mustdeclare this prior to acceptance of the MOTTest Warranty. This MOT Test Warrantyis designed to cover vehicles built to themanufacturer’s original specification. Ifyour vehicle has been modified with anynon-manufacturer supplied parts that areassociated to the items covered by theMOT Test Warranty, we reserve the right todecline any claim that may occur due to thefailure of a modified part. Any vehicle fittedwith wheels and tyres that exceed Jaguarmaximum approved size and diameter mustbe declared prior to application for thewarranty as fitment of such wheels and tyrescould Invalidate the MOT Test warranty.14. False Claims If you make a false claim,this MOT Test Warranty will be cancelled andyou will forfeit all benefits. No refund will bepaid in such circumstances.15. Other Warranties and InsuranceIf your claim is also covered by any otherWarranty, the Company will only pay its shareof the claim.16. Legal Proceedings Following theacceptance of any claim under this cover,we will have the right to conduct legalproceedings or enter into formal arbitrationon your behalf. In doing so, the company and/or their insurers will be entitled to take actionin your name. The cost of the action will beour responsibility, unless you have agreedin writing to an alternative arrangement.We will be entitled to any compensation and/or indemnity benefit obtained through theseproceedings, to the extent that these relateto costs or potential liabilities covered by theWarranty. We will also be entitled to the costsof this action, if they are assigned to you.25. The Administrator shall not be liablefor any statement or representation, writtenor verbal (by whomsoever made), whichcontradicts the Terms and Conditions in thisMOT Test Warranty, unless such statement orrepresentation is supported in writing by theCompany on their behalf.17. Invoices All invoices for repairs shouldbe made out to Jaguar Land Rover Ltd c/oJaguar Approved Warranty Administration.18. Administrator Jaguar ApprovedWarranty Administration is authorised byJaguar Land Rover Limited to act as theiragents in relation to this MOT Test Warranty.They manage and administer all JaguarApproved Warranty Services. All claims andcorrespondence should be submitted throughthem at the following address: JaguarApproved Warranty Administration,Jubilee House, 5 Mid Point Business Park,Thornbury, West Yorkshire BD3 7AG.19. Cancellation Rights You have theright to cancel this Warranty within 14 daysof receiving this booklet and RegistrationConfirmation Letter. Should you wish tocancel within this period please contactyour supplying retailer who will arrangecancellation and a full refund.20. It shall be clearly understoodand agreed that in the event of anydispute arising as to the extent of theliability, the decision of the assessor shallbe final and binding on the Administratorand the MOT Test Warranty holder.Note: Claims must be notified to andinvoices received by Jaguar ApprovedClaims Department within 30 days of thedate of completion of the repairs otherwisethey cannot be accepted. Claims notifiedor invoices received beyond this period willbe subject to review in terms of the reasonfor delay and it will be at the administrator’sdiscretion to accept such claims.23. Statutory Rights Nothing in theseconditions will reduce your statutory rightsrelating to faulty or mis-described goods.For further information about your statutoryrights contact your local Trading StandardsDepartment or Citizens Advice Bureau.24. Territorial Limits Cover under thisJaguar Approved MOT Test Warranty mayonly be granted to individuals residing, orcorporate bodies registered, in the UnitedKingdom.MOT PROTECT 7
