Both regular andtranscribed minutes may be found on our Town website.At 6:30pm Supervisor Russell Payne called the August 2020 meeting to order,and led everyone in the Pledge of Allegiance to the Flag.Public statements, announcements and questions:Supervisor Russell Payne requested that all Town Departments submit acomplete inventory list of vehicles, tools and supplies to the Town Supervisorby September 1. This list is a requirement of the State Comptroller’s Office.This was his second notification.

Continuing discussion regarding the Town Park regarding present COVID-19restrictions, and usage of the restrooms. It was decided that bathrooms couldbe opened while the town park is being rented, at the renter’s request, and ifthere is a town board member or town employee who is willing to open orclose the bathrooms during the requested time.Supervisor Payne stated that the town has received 8 FOIL requests fordocuments since January 1, 2020. He stated that the contents of thoserequests and any future FOIL requests will be posted on the Town’s website,and this has been approved by Town Attorney, Paul Webb.In accordance with the Real Property Tax Law Section 950, and the Town LawSection 35, Chautauqua County Real Property Tax Director, James Caflish, hascertified that Town of Carroll Clerk Susan Rowley, on April 28, 2020, made fullsatisfaction of the Tax Warrant issued to the Town of Carroll by the countyLegislators of Chautauqua County dated July 24, 2020.As of July 28, 2020, the town of Carroll has through communications to JohnGriffith, Director of Emergency Services for Chautauqua County, of the town’ssupport obtain their EMS Certificate for the purpose of providing a high-levelambulance service to the Town in accordance the New York State andChautauqua County law.Letters of Communications: Due to COVID-19, emails have been sent to theTown Clerk to be read to the Board at the monthly meeting. Supervisor Payneread to the Board, 6 emails that were received from residents.Attachment # 1-6The Town Board, Highway Superintendent and the Police Chief, and CodeEnforcement Officer all discussed ways to address the concerns the residentsexpressed in their emails.Supervisor Payne requested a motion to accept the July meeting minutes.Motion was made by Councilwoman Patty Ekstrom, with a second byCouncilman Kenneth Dahlgren. All in favor, Carried.Supervisor Payne requested a motion be made for authorization to pay theAugust Monthly Bills. Motion was made by Councilwoman Patty Ekstrom,with a second by Councilman Thomas Allison. All in favor, Carried.

Motion was made by Councilwoman PattyEkstrom, with a second by Councilman Thomas Allison. All in favor, Carried.Attachment # 7The Town of Carroll has received a proposal from Allied Alarm Services toaddress an upgrade of the Town Parks Surveillance System. This will be ayear round fully functional system, the current 10 cameras are not beingutilized year around, and the new equipment will be monitored by the PoliceDepartment in their office at the Town Hall. A decision to move forward onthis proposal was tabled until the September meeting.The Town of Carroll Historical Society sent a letter from Harold Bennet,President. The Historical Society is requesting permission to makeimprovements to the entrance way of the building with funding they havereceived by donations, with no cost to the town. The Society thanked thetown for the recent improvements made to the outside of the building. Amotion to enable to Historical Society to proceed with the improvements wasmade by Councilman Kenneth Dahlgren, with a second by CouncilwomanPatty Ekstrom. All in favor, Carried.The Town of Carroll has received an LED Lighting proposal from a contractor,Line Energy, of National Grid, to upgrade lighting for all town buildings, insideand outside, including the Town Park. This also includes a separate proposalfor Water Pump House 2A. National Grid has provided an incentive of 95%which is a total of 23,563.96 for their share, the town responsibility is only5% which is 1,240.21 of the total cost of the lighting project underconsideration. The board agreed that this a wonderful opportunity for thetown to replace lighting that will save the town energy costs in the future thatwill exceed the 5%, an estimated savings of 9,000 per year in energy costs.The board, along with town officials agreed that this would be a great

opportunity for the town. The town board decided to approve this oncontingency that they didn’t need to take additional bids for the work to becompleted. The board decided to accept the proposal contingent to theapproval of Town Attorney Paul Webb. Motion was made by CouncilmanThomas Allison with a second by Councilwoman Patty Ekstrom. All in favor,Carried.New Business:Supervisor Payne reported that Roger Wolfe has received a 300.00 water bill,and is seeking an adjustment in his water bill, as a 170.00 bill was incurredunder a previous owner and carried over from a previous landowner. He isseeking an adjustment of 170.00, which will bring his water bill to 130.00,which his tenant did not pay after he purchased the land contract. He wouldneed to pay the 130.00 within 30 days, or the bill would go back to 300.00.Motion was made by Councilman Kenneth Dahlgren with a second byCouncilwoman Patty Ekstrom to adjust Mr. Wolfe’s water bill by 170.00 aslong as it was paid within 30 days. If it is not paid within the 30-day periodstarting August 12, needing to be paid by September 11, the bill will revertback to 300.00. All in favor, Carried.Old Business:Further request of District 16 Legislator, John Davis, who has beenapproached by town residents, to reduce the speed limit along Frew Run Roadfrom the town limits to Peterson Road, and Ivory Road from the town limits tothe County Line. A Board Resolution to reduce the speed limit on Frew Runfrom the town limits to Peterson Road, and Ivory Road from the town limits tothe Cattaraugus County line, and to request the State Department ofTransportation to allow a traffic study to be completed. A resolution wasmade by a motion made by Councilman Thomas Allison with a second byCouncilman Kenneth Dahlgren. All in favor, Carried.Supervisor Russell Payne stated that in regard to Sealand Waste, LLC. Vs. theTown of Carroll, Town Attorney Paul Webb has made a motion to return thecase to Appellate Division to decide the final cause of action which is thatSealand Waste LLC is challenging that the Town of Carroll’s 2007 Waste

Disposal Law is arbitrary and conspicuous and that the Law in filed in anegregious manner. The new court date is scheduled for March 2021.Personnel:An appointment for Mr. Timothy Burkett to be appointed to the Town ofCarroll Board of Ethics, effective immediately. A motion was made byCouncilwoman Patty Ekstrom with a second by Councilman KennethDahlgren. All in favor, Carried.The monthly Town Supervisor’s report was received from BLB, and themonthly Town Clerk report was received by Susan Rowley.Police Chief William Nelson:Chief Nelson submitted a copy of his monthly report. Attachment # 8Chief Nelson also stated that he has spoken with NYS DOT and they haveassured him that they will paint “No Parking” markings on the pavement onMain Street, on either side of Water Street. He agrees that the cameras beingupdated at the Town Park will be very helpful. He also stated that the Townreceived one COVID NY Pause complaint during the Garage Sale days, and hestated that he worked during the Garage Sale days and he did not see anyissues for a complaint. He stated that they have addressed parking issuesalong Main Street by placing the Police Cones has helped with parking issues.Highway Supervisor James Mitchener:Supervisor Mitchener stated that the Highway Department has been verybusy. This month they were busy grinding the huge pile of brush behind theHighway Garage, and he would like to thank the Town of Ellicott for theirassistance with grinding and hauling to the County Landfill. He would like toremind and please ask the Town of Carroll Residents to remember that thebrush dump is NOT a C&D landfill. Some residents are dumping drywall andboards, and they are not a wood grinding facility, these items need to be takenby residents to an approved C&D waste facility. He thanks the town residentsto remember that these items do not belong in the town’s brush dump, it is forbrush and yard disposal items only. The Highway Department also completed

this year’s village street paving program with Midland Asphalt. They wereable to pave 15 town streets this year, 880 tons of Nova Chip was put down in8 days. The town employees preformed all of the work by doing all of therolling and surface prepping, hauling and traffic control which saved the towna total of 33,324.75. Superintendent Mitchener thanked the Towns of Ellicottand Poland for their assistance with trucking. He also stated that the TownPark bridge as the creek has undermined the concrete wing wall and wascollapsing into the creek, which was causing a large sink hole at the park endof the bridge. Superintendent Mitchener contacted the county, as it is acounty owned creek, and as the county did not have any crews available.Superintendent Mitchener contracted a DEC permit with the help of thecounty, and was able to secure an emergency stream disturbanceauthorization. This enabled the town to fix the issue and was able to keep theTown Park open for the residents. He stated there is some ongoing workhappening at the Town Park with paving and rock placement. They will berepaving from the bridge to the entrance of the park.Water Department Supervisor Daniel Sisson:Supervisor Sisson brought two water adjustments to the board. The first is at23 Mattison Street, the bill was 593.50. The water softener was causing theproblem, and he is asking for her bill to be reduced by half price, which will be 296.75. Also, on 17 Lincoln Street, the resident has a leaky toilet, which sheis in the process of getting repaired. Her bill was 204.50, her average bill is 102.00, so he is requesting the board reduces their bill to 102.75, both billsneeding to be paid in full within 30 days, or they will revert back to the largeramount. He is seeking board approval for both of these adjustments. Motionwas made by Councilman Dahlgren to reduce these two bills by the amountsuggested by Water Supervisor Daniel Sisson as long as they are paid within30 days. If they are not paid within the 30-day period starting August 12,needing to be paid by September 11, the bills will revert back to the originalamount. A second to the motion was made by Councilwoman Patty Ekstrom.All in favor, Carried.Supervisor Sisson also stated that the increase in water rates were to takeeffect on May 1st, and the board decided to hold off raising water rates untilAugust 1. Water rate increase will take affect this quarter and the Novemberbilling will reflect that increase. He also asked the board’s wishes on whetherto impose penalties on this quarter’s billing, due to COVID related issues, asthey were waived in the last quarter’s billing. Councilman Dahlgren made a

motion to extending forgiving water penalties for the current quarter andseconded by Councilwoman Patty Ekstrom. All in favor, Carried. SupervisorSisson asked if we are able to have an open meeting the next month, that hecould request a Public Hearing concerning the Water Rules and Regulations.Supervisor Payne and Councilman Dahlgren stated that they are wanted to tryto have a public meeting at the Fireman’s Blue Building for the Septembermeeting. He also stated that the water department had their annual countywater inspection in December, and Supervisor Payne received a very positivereport. The report also mentioned two water tanks need to be updated, whichSupervisor Sisson has a plan for. Supervisor Sisson also mentioned that thewater department and highway departments are working together on theMarden E. Cobb Waterway Trail and he stated it has turned out very nice andit should be completed in the next week or two.Code Enforcement Officer Alan Gustafson:Officer Gustafson stated that his office has been extremely busy this monthand he has issued 20 building permits, which is more than previous years. Hehas been working on many complaints and will be issuing court appearancetickets for those who are not complying to town complaints. He urges alltown residents that if you are replacing roofs, porches, decks or installing anew pool, a building permit is required. If you have questions, please contactthe town hall for verification as to if you need a permit. Swimming poolscapable of holding more than 24 inches of water require a building permit andalso a fence surrounding the pool. He also stated that there has been acomplaint of a rat infestation in the town and he is busy working on that issue.The Ad Hoc Zoning committee is still meeting every other week throughZOOM and working on some proposed changes to the Zoning Laws, and theyhave been very productive. They will make a presentation to the board soonconcerning any changes the committee has compiled.Animal Control Officer Nicholas Cusimano was not in attendance and noreport was given.Assessor Lisa Volpe was not in attendance; however, her Assessors Reportwas read. Legislator District 16 John Davis was also not able to attend.Town Council Reports:Councilman Kenneth Dahlgren:He has been working with the Zoning Committee on some ZOOM Meetings andhe is working on setting up more Committee Zoom meetings to get thosecommittee’s up and running as they have not been able to meet due to COVIDrestrictions.Councilwoman Patty Ekstrom: She just wanted to thank the Highwaydepartment for their continuous mowing on the side of the roads, it makes ahuge difference and she and the town residents appreciate it.Councilman Thomas Allison: Questioned the sale of some of the townproperty and wondered why it didn’t go out to public bid. Town SupervisorRussell Payne stated that real property did not need to go out to public bidaccording to The Association of Town’s Attorneys and our Town AttorneyPaul Webb. He also questioned if there was a Site Management Plan for theWalgren Road Property, Supervisor Payne stated that Paul Webb has the Plan.Councilman Thomas Allison also asked if the March 2021 date was a courtdate or a trial date? Supervisor Payne stated it will be presented on that date.Supervisor Russell Payne stated he has received many compliments from theresidents regarding the Highway Department’s paving of the town roads. This is the second notification. You will need to havethat done by September. A discussion continuing on the Town park, usage of therestroom parameters under the present covid-19 restrictions. Does anybody haveanything, any objections with going forward like we've been doing? Jim, anyproblem with that as far as what we've been doing?Superintendent James Mitchener: okay, as neededSupervisor Russell Payne: Ok, opening the opening as they are needed will beokay?Since January 1 2020, there's been a total of eight separate and distinct foilrequest for documents from the Town of Carroll, and in light of those requests,the contents of those requests and any foil request going forward from this dateon, will subsequently be posted along with the board minutes on the Town ofCarroll website. I'll start off with the firstone from Michelle Pitts, 1404 Scott Road, Frewsburg, New York.I am writing since I am unable to attend Town of Carroll town board meetings due to thembeing closed to the public STILL. I hope that this email does not go ignored as my phone callto the Town of Carroll offices for assistance has been. I reside on 1404 Scott Road; I called

the Town of Carroll looking for assistance on an ongoing issue on that road regarding codeenforcement. The parcel next to me was purchased by a man who lives in Jamestown. He isusing this land as some type of camp. In the last few years, he continually hauls garbage ontothe lot, has large fires, shoots off fireworks, etc. He has now begun to haul in campers that donot even appear to be road worthy. He has no running water, electric or septic on this land,nor a legal driveway. When he stays, where is the waste going? The land is littered withgarbage. There are multiple locations on this road that are “dumps,” littered withunregistered vehicles, garbage, etc. It amazes me that the Town of Carroll elected officialsthat claimed they were going to improve the township and provide leadership and assistancefor the citizens within the town, but a simple phone call can go unanswered. I feel that maybeif our town supervisor spent a little more time working on the issues and holding peopleaccountable in the Town of Carroll instead of using social media and photo ops for the PostJournal, maybe some things could get accomplished. I am asking that the land beinvestigated. I fear that human waste is being drained into the land and being that it bordersmine, it is a major concern of mine, let alone a makeshift campground/garbage pit. Below isthe parcel information regarding the property I am concerned about. I am sure that theproperty taxes we pay up there are more than comparable to the ones in the town limits andthese practices would not be accepted there. I politely ask that the town reads this exact emailat the town board meeting. Respectfully, Michelle PittsThe next email is entitled: Contaminated surface water running off onto a privateproperty, this comes from Trudy and Dave Bloomquist here in Town of Carroll:I would like to address the board and inquire about what the plan might be for thecontaminated surface water that drains onto our property from an unmaintained ditch put inby the town of Carroll. This ditch has been noted to have raw sewage in it. This has beenseen by Supervisor Payne, and Highway supervisor Mitchener. The town came severalmonths ago to attempt to fix the issues however they abandoned the project because it was toowet. They then enlisted the counsel of an outside contractor who put forth a plan forrectifying the situation. We have not seen or heard from anyone since that time.Is there in fact a plan for the town to do something about their ditch? I think it is still againstthe law to drain surface water onto another property. This is causing raw sewage, phosphatesand pond chemicals to flow uninhibited onto our property and allowing exposure to such toour livestock. This is an issue that was caused by the Town of Carroll not completing theditching project and not maintaining the ditch. It has caused unacceptable consequences toour property and we would like a resolution. Thank you, David and Trudy BloomquistThe next one is from Tracy Magnuson, of Magnum Graphx, here in the Town ofCarroll:Question for the Board:How do we go about asking the State to put lines in the no parking zones at the end of WaterStreet? Bill Nelson has done what he can, putting the cones out has helped but some peoplefeel they can move them, then cars park where it blocks the view to safely pull out. If lines

were painted and no parking it would probably for the most part take care of the problem.Tracy Magnuson, Magnum Graphx, Water Street, Frewsburg.The next one is regarding rat infestation in the Town of Carroll, this comes fromSouthern Tier Professional Pest Control, PO Box 231, Randolph, New York:Mr. Russell Payne -Town of Carroll Supervisor,On August 11th, I received a call from a property owner at West Main Street inFrewsburg. Upon inspection of that property and the properties located adjacent of myclients, I was able to not only identify a rodent issue but actually had a large rat scurry thegas line in the basement of my client’s property over my head. This property is wellmaintained and the basement is clean as well. That being said, as a pest managementtechnician it is my job to provide my client with a plan of action to not only remedy thesituation, but to also evaluate the environment around the property to ensure the best servicepossible by providing them with "tools" to ensure eradication of pests or rodents.The properties located next to or in close proximity of property, are in very poor condition, orjust not kept. The piles of tree branches, downed trees and debris and garbage that is notdisposed of will inhibit my ability to get this rodent problem in control and will eventuallyhave an effect on neighboring businesses and properties within the village. There is an openwindow in a home immediately connected to my client’s property as well as multipleunlicensed registered vehicles which also give shelter and nesting areas to rodents.I encourage you to reach out to your local businesses and village residents and advise themthat rats have a 21-day gestational cycle. From birth to adults’ rats take only three weeks tomature and go out on their own. At 5 weeks they reach sexual maturity and will begin matingand producing the next generation. As you can see this is very disturbing assessment for myclient as well as the Town of Carroll and those residents within the village limits.What the community needs to do to ensure this issue gets resolved quickly. Sanitation isfundamental to rat control and MUST BE CONTINUOUS. If sanitation measures aren'tproperly maintained the village faces a very serious implications in a very short period oftime. Rats carry disease many of which are serious, this alone should encourage propertyowners to take immediate action. When food, water and shelter are readily availablepopulations will increase rapidly.All garbage must be kept in Garbage cans with a tight sealed lid and be picked up regularly.

Grass must be kept short and trimming up against buildings and in flower beds must bemaintained.Piles of debris, brush, downed trees, junk, vehicles that are not operable must be cleanedup. All of these areas give rodents places to nest. Firewood can be kept neatly stacked offthe ground.Dogs and Pets that are fed outside should only be fed the amount of food they will eat at onefeeding and store pet food in rodent proof containers.Exclusion work "build them out” make sure that all seals and cracks and openings infoundations are repaired. Make sure all doors and windows have screens that fit tight. Ratsare great climbers make sure that any openings at the roof have been addressed.If there is anything, I can do to assist anyone please don't hesitate to reach out. With the COVID situation families were asked to only pick the bus alternativeif it was a necessity which may lead to more kids coming up and down the hill to get toand from school. With the amount of community members and children that utilizecoming up and down the hill on Ivory a sidewalk would add a layer of safety. would love to have Ivory Acres connected to town. Many of our guests have told us theywould love to be able to walk to either the Frewsburger or the Dinner Bell on Sundaymornings. Many have just wanted to stroll through town. Kelsey and I would also use them.In our opinion if the sidewalks were extended to at least Wigren Road many more peoplecould safely walk to town and even to the school. I know ourselves and our guests would loveto be connected to town. Can the feasibility of such a project be explored more thoroughly? Ifthere’s anything we can do to support this project in the future please let us know! Thankyou!
